Vice Chairperson Aweilda Williams called to Order the Randolph County Planning Board at 7 : 00 p.m. 2 . Roll Call of the Members: Jim Routh, Chairman, absent; Aweilda Williams, Vice Chairperson, present; Bill Dorsett, present; Charles Adams, present; Lynden Craven, present; Tim Poole, present; Phil Brower, absent; and Maxton McDowell, Alternate, absent. 3. Charles Adams made the motion, seconded by Bill Dorsett, to approve the Minutes of the Randolph County Planning Board meeting on November 15, 1994 and the Randolph County Zoning Board of Adjustment meeting of November 15, 1994. The motion passed unanimously. 4 . REQUESTS FOR PROPERTY REZONING: A: C.E.R. DEVELOPMENT COMPANY, Asheboro, North Carolina, is requesting that 254. 12 acres off Pisgah Covered Bridge Road (addition of Quail Ridge Subdivision) , Union Township, be rezoned from Residential Agricultural to Residential Mixed. �' Zoning Map #7646. It is the desire of the applicant to develop 36 additional lots (average lot size 7+ acres) . Sonny Edmondson explained that the largest lot would be 10+ acres with the smallest lot being 5+ acres . There will be private roads with the same restrictive covenants as in the established Quail Ridge sections. Geraldine Schmit, Quail Ridge resident, said that she was told (by the developers) that she could not purchase a smaller lot (she purchased a 30 acre tract) and did not feel it would be fair to allow these developers to now develop smaller lots in behind these large lots. Diane Woodall, Quail Ridge resident, said that she was told (by the developers) that all the remaining property would be sold in 50+ acres and now they are trying to divide the property into smaller lots than the existing development. Woodall said that these tracts will be even further off the State Maintained Road and will create a large amount of traffic on this private drive . There were 5 people present in opposition. Bill Dorsett questioned if the same people were developing this extension as developed the lots currently in Quail Ridge Subdivision. The citizens answered yes . Dorsett asked who was currently maintaining the existing road and stated that the road was beingwell maintained. The residents of Quail Ridge answered that the developers are continuing to maintain the streets until all the lots are sold then the property owners will begin to maintain the roads . Morgan Woodall, adjoining property owner, expressed concern of the addition financial burden it would cause on the residents to enforce the private road maintenance agreement. Woodall said with this many residents there would probably be a higher number that would not comply. Bill Dorsett said he felt the State should take over the road if this many lots are allowed on on road (approximately 70 lots) . Dorsett said that the regulations designed to allow private roads was not meant for this large of a development or this many residents on a single road. Lynden Craven said that the subdivision met the County' s requirements , for this reason, made the motion to recommend to the Commissioners that this request for rezoning be approved. The motion died for a lack of a second. No other member would make a motion, for this reason, the request was rescheduled to be heard on January 5 , 1995. No further action was taken. B: NEAL CRAVEN, Asheboro, North Carolina, is requesting that 55 . 34 acres located off Manorview Road, Cedar Grove Township, be rezoned from Residential Agricultural to Residential Mixed. Zoning Map #7658 . It is the desire of the applicant to develop 37 additional lots at Crestview Manor Subdivision. Craven said that this property is land-locked except for a 50 ' easement that he has through a mobile home subdivision he developed. Craven said the subdivision would only allow a mobile home built since 1984 . There was no one present in opposition to this request. Bill Dorsett made the motion, seconded by Charles Adams , to recommend to the Commissioners that this request be approved as consistent with the development of adjoining properties . The motion passed unanimously. C: BILL WHITAKER, Climax, North Carolina, is requesting that 57 . 30 acres located on Mack Lineberry Road (off Hwy 22N) , Providence Township, be rezoned from Residential Agricultural to Residential Agricultural to Residential Restricted. Zoning Map #7796 . It is the desire of the applicant to develop 35 lots for site built homes . Property Owner: Peter Chang Yol Kim & Others . Whitaker was present and explained that he lives across the road from this site. Whitaker said he purchased the property to develop site built homes on the land instead of someone possibly developing the property with mobile homes (either a park or subdivision) . Whitaker said that the homes would have a minimum of 1500 sq. ft. of heated space. Lynden Craven noted that the preliminary plat showed two roads running parallel and ending in a cul-de-sac . Craven asked Whitaker if he would be willing to allow a loop road into the subdivision to give better access to the properties for emergency personnel (such as fire trucks , ambulances , sheriff vehicles , etc . ) . Whitaker agreed. Aweilda Williams questioned easements across the road for septic tank systems. Whitaker said that the property has a large amount of land in the center that would not perk and for this reason he used sewage easements to gain this number of lots . Planning Director Hal Johnson said he did have a problem with these easements for sewage disposal. Johnson said they would only create problems in the future with septic tanks being on the opposite side of the road from the resident. Johnson also pointed out the easement that would cross another lot and stated that this could create problems between two neighbors . Whitaker agreed to get with Johnson between this meeting and the Commissioners ' Meeting to settle some of these concerns the Board had. David Farlow, adjoining property owner, told the Board that his property is several 100 feet away from this site. Farlow said that he knew that the property was going to be developed and stated that he was pleased to see this type of development verses any mobile home development in the Community. Betty Petty, 6033 Old Liberty Road, presented the Board with a petition of 44 names of residents who live in the area opposed to this development. Petty said that she feels this would create problems with a restricted development moving into an agricultural community. Petty said that she has a chicken house (near this property) and a lagoon (for hogs) and that agricultural activities have smells that some people would be opposed to. Petty said she wanted to be sure that this development (if approved) would not create problems for the farmer on his existing business and possibly limit his expansion in the future. Johnson explained that the State of North Carolina protects the farmer and all farms are exempt from Zoning Regulations. Petty said that they also have lots of farm traffic on these roads during the summer. Petty added discussion of her concerns for the schools and the water .., problems this area has experienced. Gene Hackett, 3837 Jess Hackett Road, said he is a hog farmer, and expressed his concern of this kind of "county/ city" development moving into the community. Hackett said they move into a restricted subdivision and don' t realize that the subdivision is the only restricted area (not adjoining properties) . There were 10 people present in opposition to this request. Lynden Craven made the motion, seconded by Bill Dorsett, to recommend to the Commissioners that this request be approved as consistent with the Land Development Plan with the restriction that Whitaker (working with Hal Johnson) come up with a satisfactory subdivision plan (work on road system and sewer easements) prior to the Commissioners ' meeting. The motion passed unanimously. D: MID-STATE PROPERTIES, Seagrove, North Carolina, is requesting that 12 .28 acres located at 7014 US Hwy 220S, Richland Township, be rezoned from Residential Agricultural & Light Industrial to Light Industrial. Zoning Map #7666 . It is the desire of the applicant to continue to use the property for industrial purposes. Jack Lail was unable to attend meeting. Johnson explained that this property is located directly across from the Mid-State Plastic Plant. A portion of the property has been zoned a couple of years ago for industrial purposes . The applicant now desires to zone the entire parcel for comparable development. There was no one present in opposition to this request. Charles Adams made the motion, seconded by Bill Dorsett, to recommend to the Commissioners that this request be approved. The motion passed unanimously. 5. SWEARING IN OF THE WITNESSES: "Do you swear or affirm that the information you are about to give is the truth, the whole truth, and nothing but the truth, so help you, God. " 12 citizens took the Oath. 6 . SPECIAL USE PERMIT REQUESTS: A: RANDOLPH COUNTY BOARD OF EDUCATION, Asheboro, North Carolina, is requesting a Special Use Permit to construct a new elementary school (750 student capacity) on 41 . 55 acres located on Old Greensboro Road, Level Cross Township, Zoning Map #7766 , Zoning District RR. Bob Scherer, School System representative, explained the need for an additional elementary school to help with the over-crowding burden (placed on the system due to development in this area) placed on the New Market, Randleman, and Grays Chapel School Districts . The Town of Randleman has agreed to allow the School System to run lines from their plants to provide water and provide sewer disposal. NCDOT has agreed to widen the road for better access and Piedmont Natural Gas will run lines to this site. The 42 acre tract will allow the school to have room for expansion of a possible middle school in the future. LEON FRAZIER, Old Greensboro Road, asked where the building would be located on the parcel. Scherer explained that it would be on the southern end of the property and that the water would be coming up Old Greensboro Road. Frazier was pleased. Charles Adams made the motion, seconded by Lynden Craven, to approve this request for a Special Use Permit. The motion passed unanimously. B: JERRY ROUTH, Franklinville, North Carolina, is requesting a Special Use Permit to operate a welding shop from an existing building (48x50) at his residence located at 4144 Douglas Drive, 44 .20 acres, Liberty Township, Zoning Map #8705, Zoning District RA. Routh explained that this would be a part time business with no additional employees . Routh said his full time job is grading work but that he builds trailers and does other welding work on the side. There was no one present in opposition to the request. Bill Dorsett made the motion, seconded by Charles Adams , to approve this request for a Special Use Permit. The motion passed unanimously. C: GARY WARREN, Denton, North Carolina, is requesting a Special Use Permit to construct a storage building (30x60) for classic cars at his residence located at 3365 Old Tree Road, on 5 . 10 acres, Concord Township, Zoning Map #6689 , Zoning District RA. Warren explained that he plans to use the building to store classic cars (corvette, chevy truck, ford truck, and others he may have in the future) and personal storage. There was no one present in opposition to the request. Lynden Craven made the motion, seconded by Bill Dorsett, to approve this request for a Special Use. Permit. The motion passed unanimously. D: MATTIE MERCER, Seagrove, North Carolina, is requesting a Special Use Permit to obtain an automotive dealership for an existing office (64x96) at her residence located at 171 Leather Road, 11 . 7 acres, Richland Township, Zoning Map #7664 , Zoning District RA. Property Owner: Sherrill McNeill. McNeill explained that he operated a leather business and an auction from this building for several years . Mercer said she would have approximately 15-20 cars with no additional employees and there would be no repair work done on site. There was no one present in opposition. Lynden Craven made the motion, seconded by Charles Adams , to approve this request for a Special Use Permit. The motion passed unanimously. E: CHARLIE MILLER, Trinity, North Carolina, is requesting a Special Use Permit to operate a welding business in an existing building (24x40) at his residence located on 5582 Walking Stick Drive, . 93 acres, Trinity Township, Zoning Map #7706 , Zoning District RA. Miller stated that he plans this to be a part-time business that may work in to full-time in the future. Miller has one employee and his working hours are from 8 am to 6 pm. Randolph Miller, Walking Stick Drive, explained that the road Miller would be using for his business continues on to service 5 residences and currently the Miller ' s occasionally use his property to turn around. Brooks expressed concern of this added traffic coming down to the end of this dead end private road to turn around. Howard Miller and Vera Chisholm, Walking Stick Drive, spoke about the speed bumps Charlie Miller placed in the private road without telling any of the neighbors . Miller also expressed concern of the noise this business may create. Miller said that he would try to make sure his customers did not continue down the private road. Lynden Craven made the motion, seconded by Bill Dorsett, to approve the request for a Special Use Permit with the following restrictions : **make provisions for customers to turn around on the property (not continue down the private road) **no excessive amount of outside storage and it must be kept out of site. **operation hours of 8 am to 6 pm, Monday through Saturday The motion passed unanimously. 7 .
