09SeptemberPB • MINUTES • RANDOLPH COUNTY PLANNING BOARD September 10, 1991 There was a meeting of the Randolph County Planning Board on Tuesday, 7:00 p.m. , September 10, 1991, in the Board of Commissioners Meeting Room, Randolph County Office Building, 707 McDowell Road, Asheboro, North Carolina. 1. Chairman Lynden Craven called the meeting to order at 7:00 p.m. 2. Hal Johnson, Planning Director, called roll of the Board members: Lynden Craven, Chairman, present; Bill Dorsett, Vice Chairman, present; Charles Adams, absent; Aweilda Williams, present; Phil Brower, absent; Jim Routh, present; Doyle Stout, absent; Arlie Culp, Alternate, present; and Maxton McDowell, Alternate, absent. 3. Bill Dorsett made the motion, seconded by Aweilda Williams, to approve the minutes of the August 6, 1991, Planning Board. The motion passed. 4. SPECIAL USE PERMIT REQUEST: (Final Action) A: JAMES INGOLD, Randleman, North Carolina, is requesting a Special Use Permit to allow automotive repair/body work at his residence located on approximately 1 acre on Highway 220, (south of Providence Church Road/Hwy 220) ; Level Cross Township, Zoning Map #7767, Zoning District RA. James Ingold was present at the meeting and explained to the Board that a business has been at this location for approximately 20 years. Ingold described the business as a hobby (part-time work) of restoring old Pontiacs. Ingold presented the Board with a petition in-favor of his request from his adjoining property owners. THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS REQUEST. Arlie Culp made the motion, seconded by Jim Routh, to approve this request for a Special Use Permit. The motion passed unanimously. 5. REZONING REQUESTS: A: PHILLIP HENLEY, Asheboro, North Carolina, is requesting that approximately 30 acres located on SR 2611 (Grayson Byrd Road) , Franklinville Township, be rezoned from Residential Agricultural to Residential Mixed. Zoning Map #7781. It is the desire of the applicant to develop a manufactured housing subdivision of 37 lots. Phil Henley was present at the meeting and told the Board this development would be for both site built and manufactured homes with a minimum homes size of 1000 sq. ft. and no homes older than 3 years with permanent underpinning. Henley stated the roads would be paved and minimum lot sizes would be 30,000+ with restrictions of no junk vehicles, no chicken houses, garbage control, landscaping, etc. Henley added the restrictions would also maintain a buffer zone to adjoining properties. Henley presented the Board with a letter in-favor of this request from an adjoining land owner and also presented the Board with pictures of the surrounding area. Henley described the adjoining properties as a mobile home sales lot, a mobile home park, some site built homes, and a mobile home supply sales business. Hal Johnson, Planning Director, presented the Board with a lengthy petition (approximately 150 names) against this request Planning Board Minutes September 10, 1991 Page 2 submitted to the Planning Office. CAROLYN McKENZIE, adjoining property owner, expressed her concerns of over crowding the school system, too much development allowed in one area, and the effect this development would have on existing well systems in the area. McKenzie presented the Board with a letter of opposition from adjoining neighbors. HELEN RICH, adjoining property owner, expressed her concerns of property values being effected in the area. Rich stated that the surrounding area (of this site) is mainly restricted site built developments. THERE WERE 8 PERSONS PRESENT IN OPPOSITION TO THIS REQUEST. Bill Dorsett stated that he did not come to this meeting with a clear decision (for this request) because of the possibility of the area becoming commercial or residential. • Jim Routh made the motion to recommend to the Board of Commissioners that this request be denied. Routh said that because of statements that have been made (by adjoining property owners) and the fact that the County can not limit the density in this area he did not feel this development would be compatible to the area. This motion was seconded by Bill Dorsett and the motion passed unanimously. B: RUSSELL JOE HOFFMAN, High Point, North Carolina, is requesting that approximately 25 acres located on SR 1636 (Cashatt Road) , Tabernacle Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7714. It is the desire of the applicant to develop a 16 lot restricted residential subdivision. Joe Hoffman was present at this meeting and told the Board the average lot size would be 40,000+ sq.ft. Hoffman stated that this site is located across the road from Hunter's Woods Subdivision that is also zoned RR. Hoffman added that restrictions would be placed on the property to prevent the development of chicken houses, junk vehicles, etc. THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS REQUEST. • Aweilda Williams made the motion, seconded by Arlie Culp, to recommend to the Commissioners that this request be approved as consistent with the Land Use Plan for this area. The motion passed unanimously. C: SOPHIA INVESTMENTS, INC. , William E. Mathers, Attorney, Sophia, North Carolina, is requesting that approximately 54 acres located orf SR 1929 (Spencer Road) , New Market Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7747. It is the desire the applicant to develop a restricted subdivision of 29 lots. Bill Mathers told the Board extension restrictions would be recorded for this development. Mathers added that these would included 1500 sq. ft. minimum (of heated sq. ft.) house size, no manufactured homes, no junk vehicles, etc. Mathers stated that the average lot size would be approximately 2 acres. THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS REQUEST. Aweilda Williams stated that this is certainly the type of subdivision the Board liked to see developed. Williams made the motion, seconded by Jim Routh, to recommend to the Commissioners that this request be approved as consistent with the Land Use Plan for this area. The motion passed unanimously. Planning Board Minutes September 10, 1991 Page 3 D: JACK RAYLE, Pleasant Garden, North Carolina, is requesting that approximately 116 acres located on SR 2104 (Hockett Country Lane) , Providence Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7778. It is the desire of the applicant to develop a restricted residential subdivision of 70 lots. JIM WILSON, Attorney (for Jack Rayle) , was present and explained to the Board their intention of developing a resticted subdivision (at this site) in 5 stages beginning with the road frontage .lots. Wilson stated that the approximate lot sizes would be 1 to 4+ acres. Wilson added that the restrictions would include a minimum house size of 1400 sq. ft. (of heated space) , no junk cars, no poultry, etc. Wilson added that Rayle would be trying to protect his home of 5 acres in the middle of this development. Bill Dorsett complimented Mr. Rayle on this type of development and explained that this Board smiles on this type of restricted request. MRS. MILLER, adjoining property owner, told the Board this •• rezoning would completely surround her property. Miller stated that this was the reason her and her husband were concerned about what was being planned for this tract of land. Miller said she felt a site built development would enhance this area. THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS REQUEST. Bill Dorsett made the motion, seconded by Arlie Culp, to recommend to the Board of Commissioners that this request be approved as consistent with the Land Development Plan for this area. Themotion passed unanimously. E: C & E PALLET COMPANY, INC. , Beauford Greene, Agent, Asheboro, North Carolina, is requesting that approximately 3 acres located on the west side of Hwy 220, at the intersection of Hwy 220/SR 2920, Richland Township, be rezoned from Residential Agricultural to Light Industrial/Conditional Use.- It is the desire of the applicant to construct a building of approximately 30' x 40' with parking area to operate a truck terminal. Greene was present at this meeting and explained that this business (across from this site) has grown and needs more room to expand and park the trucks. The office is located across the road. Hal Johnson stated that the Planning Office has had complaints of the truck traffic using the residential drive (at Happy Hollow) instead of using an entrance/exit on to Hwy 220. Johnson asked if this expansion was granted would it help to eliminate this problem. Greene said it would. Greene added that there are plans to fence the property. IRVING COMER, neighboring property owner, expressed concerns of dust, truck traffic times (day and night) , noise, etc. Comer said that he had tried to purchase 75' of this property and could not. Comer added that he would like to see a buffer of trees between this business and his property line. Bill Dorsett asked if Carl Cheshire (owner of C & E Pallet) could tell the Board how much area he would be willing to designate as a buffer zone of trees. Cheshire stated that because the property had not been surveyed he could not answer the question because he did not know what the width if the property would be. Greene told the Board that the property could be surveyed in time for the Commissioners' meeting. Planning Board Minutes September 10, 1991 Page 4 Aweilda Williams made the motion to recommend to the Commissioners that this request be approved with an adequate buffer zone set once the property is surveyed. Arlie Culp, seconded this motion and motion passed unanimously. F: GEORGIA R. MENIUS, Asheboro, North Carolina, is requesting that approximately 3 acres located at the intersection of Hwy 220/Hwy 159, Cedar Grove Township, be rezoned from Residential Agricultural to Highway Commercial. JOYCE DAVIS, Realtor (for Menius) , stated her feelings that if the property was rezoned it would conform with surrounding properties. Davis stated that there is a natural buffer of a stream at the rear of the property to buffer the residential property in the rear. WALTER OVERTON, adjoining property owner, stated his concerns of junk, trash, contamination of the creek, and added that he would like to see the property remain residential. THERE WERE 3 PEOPLE PRESENT IN OPPOSITION TO THIS REQUEST. • Bill Dorsett stated that he felt if the Board granted this request it could open it up to any type of development; he expressed his feelings that a conditional use should be required. Dorsett added that he was not opposed to commercial development of this land but that he did not feel this request should be granted at this time. Hal Johnson stated that the Land Use Plan for this area has projected this to be commercial (for the last 12 years or so) . Dorsett told Ms. Davis that it was not his intention to completely shoot this request down, but that it was his opinion that she should find a client with a specific purpose for this property and then bring the request before the Board. Arlie Culp made the motion, seconded by Aweilda Williams, to recommend to the Commissioners that this request be approved as consistent with the Land Use Plan. The motion passed with a 4/1 vote with Bill Dorsett voting against the motion. G: DESIGN MASTER DISPLAY CORPORATION, Jerry Hardy, President, High Point, North Carolina, is requesting that approximately 18} acres located on SR 1619 (Prospect Street Extension) , Trinity Township, be rezoned from Residential Agricutural to Light Industrial. Zoning Map #6798. It is the desire of the applicant to use the property for industrial development. JERRY HARDY WAS NOT PRESENT AT THIS MEETING. THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS REQUEST. Lynden Craven stated that this are seems to be turning industrial. Craven said that he did not see any reason not to recommend approval of this request. Arlie Culp made the motion, seconded by Bill Dorsett, to recommend to the Commissioners that this request be approved. The motion passed unanimously. 6.
