10OctoberPB MINUTES RANDOLPH COUNTY PLANNING BOARD October 8, 1991 There was a meeting of the Randolph County Planning Board held at 7: 00 p.m. , Tuesday, October 8, 1991, in the Commissioners' Meeting Room, Randolph County Office Building, 707 McDowell Road, Asheboro, North Carolina. 1. Chairman Lynden Craven called the meeting to order t 7 :00 p.m. 2 . Hal Johnson, Planning Director, called roll of the Board members: Lynden Craven, Chairman, present; Bill Dorsett, Vice Chairman, present; Charles Adams, present; Doyle Stout, present; Aweilda Williams, present; Jim Routh, present; Phil Brower, present; Maxton McDowell, Alternate, present; and Arlie Culp, Alternate, present. 3 . Jim Routh made the motion, seconded by Charles Adams, to approve the Minutes of the September 9, 1991 meeting. The motion passed. 4. Charles Adams made the motion, seconded by Aweilda Williams, to approve the Minutes of the .September 26, 1991 meeting. The motion passed. 5. SPECIAL USE PERMIT REQUESTS: (Final Action) A. LILTON WILLIAMSON, Trinity, North Carolina, is requesting a Special Use Permit to store a loader, backhoe, dump truck, trailer, gravel, dirt, utility building, tractor, flat-bed truck, and bushhog, on approximately 1 acre located at the end of SR 1857 (Calvert Road) , Trinity Township, Zoning Map #7717, Zoning District RA. REBECCA WILLIAMSON, explained that this is a one man operation and the property would only be used for storage of equipment, etc. Williamson stated that no customers would be coming to the property and the property would be completely fenced. Williamson added that her husband had been in this business for several years. Hal Johnson, Planning Director, told the Board Williamson may have a problem because this subdivision (McDowell Acres) has deed restrictions that date back to the 60's and specifically call for residential development only. Johnson added that he RANDOLPH COUNTY PLANNING BOARD MINUTES October 8, 1991 Page 2 was aware that this subdivision had experienced some perking problems. MR. McDOWELL, Developer of this subdivision, stated that at the time these private deed restrictions were imposed, the purpose was to restrict against rental units or mobile home park development. McDowell stated that he lives in McDowell Acres and has more land than anyone in this development, and would not want to allow anything that would hurt his property values. McDowell stated that all the roads in this development are State maintained. McDowell added that there are many more things in this area that are more of an eyesore. AUSTIN MARTZ, Route 4, Trinity, expressed his opposition to gravel and dirt being hauled in and out. Martz stated he felt heavy equipment traveling on this road would damage the pavement. Martz said he lived closest to this property. down this road MARQUERITTE MARTZ, Route 4, Trinity, stated that there are lots in this subdivision with perking problems but she felt in the future sewer would be brought out to this property because there is all ready public water in this area. the future, that water was only the EARL BAKER, Route 4 , Trinity, stated that he purchased the land based on these restrictions and that McDowell should not be allowed to change them. THERE WERE 11 PERSONS PRESENT IN OPPOSITION TO THIS REQUEST. Aweilda Williams made the motion, seconded by Doyle Stout, to deny this request as not consistent with the Land Development Plan for this area. The motion passed unanimously. B. STEVEN D. DUNKER, Staley, North Carolina, is requesting a Special Use Permit to operate a golf driving range at his residence located on 36 acres on the northeast corner of Hwy 64/SR 2474 , Columbia Township, Zoning Map #8732, Zoning District RA. JOHN MEGERIAN, Attorney representing Dunker, stated that this property is located on Hwy 64 approximately 1 mile from Chatham County. Megerian said Dunker had spoken to most of his neighbors and all seemed to not have any problems with this type of activity being on the property. Megerian presented the Board with a layout plan of his proposal and letters of adjoining RANDOLPH COUNTY PLANNING BOARD MINUTES October 8, 1991 Page 3 property owner in favor of request. Megerian described his client as a landscape architect (minus a couple of college hours of credit) who lives on the property and would have operating hours of 10 am to 10 pm. Hal Johnson, Planning Director, told the Board, the Planning Department had received numerous calls from adjoining property owners in support of this request. Dunker told the Board of his plans to plant natural tree buffer zones around the property. Dunker said the business would be open 7 days a week - Weekdays 10 am/10 pm - Saturdays 10 am/8 pm - Sundays 1 pm/6 pm. Dunker stated that the Athletic Directors from Jordan Mathews High School and Eastern Randolph High School had contacted him in support of this activity and stated the golf teams (from the high schools) would be interested in using the facilities. GREG TALBERT, Adjoining Property Owner, described the area as a farming residential community. Talbert expressed concerns of added traffic, and stated that nothing about this request would improve the neighborhood. Talbert said there were not commercial activities for miles from this area. THERE WERE 2 PEOPLE PRESENT IN OPPOSITION TO THIS REQUEST. MRS. TALBERT expressed concerns of this site becoming an eyesore. Talbert added her concerns of problems with lighting. Jim Routh made the motion, seconded by Aweilda Williams, to approve this request with the following restrictions: type of lighting (high pressure sodium) hours of operation: weekdays 10 am/10 pm Saturdays 10 am/8 pm Sundays 1 pm/6 pm buffer zones - must follow plans as submitted concession stand secondary to driving range - no advertisement of concessions The motion passed unanimously. 6. REZONING REQUESTS: RANDOLPH COUNTY PLANNING BOARD MINUTES October 8, 1991 Page 4 A. JOSEPH RICHARDSON, Randleman, North Carolina, is requesting that 27.32 acres located on SR 2661 (Old Liberty Road) , Franklinville Township, be rezoned from Residential Agricultural to Residential Agricultural/Conditional Use. Zoning Map #7773 . It is the desire of the applicant to operate an outdoor recycling storage area with a commercial demolition landfill (applicant will reside on property) . Richardson was present and stated that his grandfather purchased this land in 1945. Richardson said he and his brother currently helps Randolph County with their recycling efforts at the Landfill. Richardson stated that the County pays him to remove old appliances (refrigerators, stoves, air conditioners, washers/dryers, etc. ) from the landfill. Richardson stated that he and his brother had recycled approximately 325,000 pounds of "white goods (refrigerators, stoves, air conditioners, washers/dryers, etc. ) " in the past 6 months. Richardson said these "white goods" must be broken down before they can be sold to junkyards. Richardson stated that the landfill (if approved) would only be for concrete, stumps, bricks, shingles, etc. - no raw garbage would be allowed. Richardson stated they would accept "white goods" and fill-in materials. Richardson said there are currently approximately 200,000 pounds of "white goods" on the property to be dismantled and sold, Richardson obtained these products from the County Landfill. Richardson told the Board operating hours would be from 8 am/5 pm during the Winter and 8 am/6 pm during the Summer. Richardson said that an existing house on the property would be used for an office and the scales would be located at this house. Richardson added that he did not feel this would lower property values of his adjoining land owners. Richardson said that he planned to operate this landfill for 10-15 years and then plant Christmas trees on the land. Richardson added that if this was approved it would extend the life time of the County Landfill. Maxton McDowell left the meeting at 8:22 p.m. Chairman Craven asked how many people were present in opposition to this request. Approximately 42 people raised their hands. DON HEARD, Route 2 , Wicker-Lovell Road, Randleman, expressed his concerns of traffic problems because Old Liberty Road is not suitable for truck traffic or any added traffic. Heard stated that the property is all ready become an eyesore with junk, "white goods", etc. and is very visible from Old Liberty Road. RANDOLPH COUNTY PLANNING BOARD MINUTES October 8, 1991 Page 5 Heard told the Board about several 55 gallon barrels located on the property and stated that no one knew what was in these barrels. barrells DON WARD, Route 1, Franklinville, stated that there are 100's of old appliances that have recently been moved to the property and become an eyesore in the community. Ward expressed concerns of Freon being released into the area and possibly the ground water systems. Ward added that when the timber is removed from this property it will cause erosion and run-off problems. JOHN DOHLINGHAUS, Route 1, Franklinville, stated his concerns of contamination to well waters and Deep River and the many fire hazards this type of activity could cause. ANDY BROWER, Route 2, Randleman, (lives across the street from the site) told the Board that he did not understand why he pays to take his old appliances to the County Landfill and the County pays this man to bring them back in his neighborhood. RAY STEVENS, Route 2, Randleman, told the Board he had concerns of Freon and capacitators being left and contaminating the water supplies in this area. LIBBY MOORE, Route 2, Randleman, stated that the Health Department has not been able to get a clear water reading on the 2nd well they have drilled. FRANKIE ARNETTE, Route 2 , Randleman, said that she had spoken with the State Hazardous Waste Commission and could not be told that this would be safe. FRANKLIN ALLRED, Route 2, Randleman, said this would no doubt be an uncontrolled situation. CATHY BROWER, Route 2, Randleman, said that the neighborhood was all ready experiencing severe smoke problems from the burning of wire. Board Member Bill Dorsett asked Richardson if he had brought in more materials than what he grandfather had on the land several years ago. Richardson said they had to because the County did not provide enough space at the landfill for them to work. CATHY BROWER told the Board that Richardson is all ready operating the business he is requesting. RANDOLPH COUNTY PLANNING BOARD MINUTES October 8, 1991 Page 6 Bill Dorsett told Richardson, just for the record, that if this request was denied by the Board of Commissioners he would have to cease operation and remove these appliances from the site. Doyle Stout made the motion, seconded by Bill Dorsett, to recommend to the Commissioners that this request be DENIED because of population in this area. The motion passed unanimously. B. BERRY BOWERS, Thomasville, North Carolina, is requesting that approximately 73 acres located on SR 1401 (Kennedy Farm Road) , Tabernacle Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #6794 . It is the desire of the applicant to develop a site built residential subdivision of 35 lots. Bowers was present and told the Board the proposed lot sizes range from 1 to 20 acres and the minimum house size would be 1, 500 sq. ft. Bowers added that this type of development should increase property values in the area. ALVIN MYERS, Route 3, Thomasville, presented pictures of the area to the Board. Myers stated that this is not the type of development the people in this area wants and presented the Board with a petition of people in the area against this request. Myers spoke of possible pollution to the Uwharrie River and concerns of density. RICK NELSON, Route 3, Thomasville, expressed concerns of perking problems in this area and possible contamination to Asheboro's Watershed. ED LEES, Route 3, Thomasville, expressed concerns of pollution to Uwharrie River. THERE WERE 15 PEOPLE PRESENT IN OPPOSITION TO THIS REQUEST. Doyle Stout made the motion, seconded by Phil Brower, to recommend to the Commissioners that this request be denied because subdivision development incompatible to this area. The motion died because of a vote of 2 - 5. Bill Dorsett made the motion, seconded by Jim Routh, to recommend to the Commissioners that this request be APPROVED. The motion passed with a 5 -2 vote with Doyle Stout and Phil Brower voting against the motion. RANDOLPH COUNTY PLANNING BOARD MINUTES October 8, 1991 Page 7 C. DON LANIER, Asheboro, North Carolina, is requesting that approximately 57 acres located at the intersection SR 1118/SR 1109, Union Township, be rezoned from Residential Agricultural to Residential Mixed. Zoning Map #7645. It is the desire of the applicant to develop a manufactured housing subdivision of 21 lots. Lanier was present and told the Board the average lot size would be approximately 2 3/4 acres, no junk vehicles, no mobile home older than 1980, etc. DANNY KILBY, adjoining land owner, expressed concerns of mobile home development, junk vehicles, school over-crowding, and traffic hazards with the one lane bridge on this road. HAROLD STRIDER, adjoining property owner, feels property is currently zoned currently (RA) and doesn't feel this would be compatible to the area. BETTY ZORN, adjoining land owner, described this property as being raped when the timber was removed for profit. Zorn stated that there is a mobile home subdivision 2 roads down from this property and describes it as a tragedy to the area. Phil Brower made the motion, seconded by Charles Adams, to recommend to the Commissioners that this request be DENIED as not compatible with the area. The motion passed with a 6/1 vote with Jim Routh voting against the motion. D. LESTER DAVIS, Sophia, North Carolina, is requesting that 29.42 acres located on SR 1929 (Spencer Road) , New Market Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7747 . It is the desire of the applicant to develop a restricted residential subdivision of 17 lots. Lester Davis was not present at the meeting. THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS REQUEST. Bill Dorsett said this type of development seems appropriate for this area. Jim Routh made the motion, seconded by Charles Adams, to recommend to the Commissioners that this request be APPROVED as consistent with the Land Development Plan for this area. The motion passed unanimously. RANDOLPH COUNTY PLANNING BOARD MINUTES October 8, 1991 Page 8 E. DAVID FOGLEMAN, Randleman, North Carolina, is requesting that 1. 30 acres located on SR 2116 (approximately 1 mile east of Polecat Creek) , Providence Township, be rezoned from Residential Restricted/Residential Agricultural to Residential Agricultural/Conditional Use. Zoning Map #7776. It is the desire of the applicant to use an existing building to sell socks. David Fogleman was present and explained to the Board that this is a family (father/son) business and will be operated from an existing building. THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS REQUEST. Charles Adams made the motion, seconded by Aweilda Williams, to recommend to the Commissioners that this request be APPROVED. The motion passed unanimously. 7 . The meeting adjourned at 9:43 p.m. THERE WERE APPROXIMATELY 125 CITIZENS IN ATTENDANCE OF THE MEETING.
