11NovemberPB MINUTES RANDOLPH COUNTY PLANNING BOARD '.,. .�`- November 5, 1991 There was a meeting of the Randolph County Planning Board held at 7: 00 p.m. , Tuesday, November 5, 1991, in the Commissioners' Meeting Room, Randolph County Office Building, 707 McDowell Road, Asheboro, North Carolina. 1. Chairman Lynden Craven called the meeting to order at 7: 00 p.m. 2. Hal Johnson, Planning Director, called roll of the Board members: Lynden Craven, Chairman, present; Bill Dorsett, Vice Chairman; present; Charles Adams, absent; Doyle Stout, present; Aweilda Williams, absent; Jim Routh, present; Phil Brower, present; Maxton McDowell, present, Alternate, substituting for Charles Adams; and Arlie Culp, present, Alternate, substituting for Aweilda Williams. 3. Bill Dorsett made the motion, seconded by Phil Brower, to approve the Minutes of the Randolph County Planning Board meeting on October 8, 1991. 4 . REOUESTS FOR SPECIAL USE PERMIT: A: ESTELLE GOLDSTON, Ramseur, North Carolina, is requesting a Special Use Permit to operate a beauty shop at her residence located on Hwy 49 approximately one mile off Hwy 64, Columbia Township, Zoning Map #8713 , Zoning District RA. Goldston was present at the hearing and explained her plans of operating a beauty shop at her residence in an existing 600 sq. ft. building. There was no one present in opposition to this request. Arlie Culp made the motion, seconded by Phil Brower, to approve Goldston's request for a Special Use Permit. The motion passed unanimously. B: FRANK DILLS, Trinity, North Carolina, is requesting a Special Use Permit to expand an existing appliance repair business near his residence located on approximately 1/2 acre on SR 3142 (Payne Street) , Trinity Township, Zoning Map #7704, Zoning District RA. Dills was present at this hearing and told the Board his business had been in operation for 15 years at RANDOLPH COUNTY PLANNING BOARD MINUTES November 5, 1991 Page 2 this location. Dills stated that there would be no employees (but himself) and the addition of 14' x 50' for storage only (not to expand the business) to move the storage inside. Dills stated that approximately 3 cars per day would visit his business. Dills added that there are no private deed restrictions against a business being operated on his property. B. L. KENNEDY, Trinity, North Carolina, (adjoining property owner) stated that this property did have deed restrictions and that this business was next to his residence. Kennedy stated that this addition would be close to his property line. Hal Johnson, Planning Director, stated that as best as the Planning Staff could determine there are no restrictions on this property. Kennedy presented the Board with 2 letters from neighbors opposing expansion of this business. Board member Bill Dorsett stated that the business is in a residential district and has been since before zoning regulations. Dorsett said he felt there should be a provision that he screens this from public view. Dills agreed to building 8' screened privacy fences. Bill Dorsett made the motion, seconded by Jim Routh, to approve this request with the requirement of 8' screened privacy fences located in the front and side of this business. The motion passed. C: WAYNE DOUGLAS ROBERTS, SR. , High Point, North Carolina, is requesting a Special Use Permit to operate a Turkey Shoot at his residence located on 6. 6 acres on SR 1928 (Cedar Square Road) , New Market Township, Zoning Map #7747, Zoning District RA. Roberts was present and told the Board he owns approximately 21 acres at this location and the turkey shoot is in the middle of his property. The Shoot Range is approximately 400 ft and the targets are set up so the shot is going down hill into a bank. Roberts said the business operated from 7 :00 p.m. - 12 : 00 p.m. , Wednesday through Saturday. Roberts lives on the property and the parking area is approximately 200 ft off the road in a field. Roberts stated that he would post the property _ (trespassing signs) and that he only allowed 12 gauge shot guns with 9 shot shells. Roberts had a petition signed by his neighbors in favor of this request. RANDOLPH COUNTY PLANNING BOARD MINUTES November 5, 1991 Page 3 MICHAEL & DORIS CRAYTON, adjoining property owners, were present at the hearing with concerns of noise problems, safety hazards, and late operational hours. Crayton presented the Board with a petition signed by several of the adjoining property owners requesting this be approved but with the following restrictions: *October 1 - January 2 (Seasonal Operation) *Close no later than 10: 00 p.m. *Wednesday through Saturday (Days of Operation) BARBARA HINSHAW, adjoining property owner, expressed her concerns of the bright lights, the noise problem, late operation hours, and traffic. Hinshaw added that the guns being fired so often caused the dogs in the neighborhood to be a noise problem. There were 3 people present in opposition of this request. Jim Routh stated that he felt the restriction requests of the adjoining land owners seemed to be very reasonable and that he would make the motion to approve this request with the following restrictions: *October 1 - January 2 (Operate Seasonal) *Business must close no later than 10: 00 p.m. *Days of Operation - Wednesday through Saturday *Straw bales must be placed behind the targets to allow added safety protection. Arlie Culp seconded this motion and the motion passed unanimously. 5. REQUESTS FOR PROPERTY REZONING: A: TERRY TROTTER, Thomasville, North Carolina, is requesting that 5.7 acres located on SR 1339 (Ross Wood Road) at the Davidson County Line, Tabernacle Township, be rezoned from Residential Agricultural to Residential Mixed/Conditional Use. Zoning Map #6782 . It is the desire of the applicant to build 4 rental dwellings on the property. Trotter was present at this meeting and explained to the Board that this property was from a division of property among heirs. Trotter stated that 4 new site built rental houses would be built approximately 900-1000 sq. ft. in size. Trotter stated that this property is accessed by a private drive and that because this road is an access to 6 properties and maintained by the owners, he plans to bare the extra expense of maintaining the road. RANDOLPH COUNTY PLANNING BOARD MINUTES November 5, 1991 Page 4 Hal Johnson asked Trotter if he was aware that the property could not be subdivided. Trotter stated that he was aware the homes could not be sold separately but they could be sold as a package. Johnson provided the Board with copies of 2 letters of concern. There was no one present in opposition to this request. Arlie Culp made the motion, seconded by Jim Routh, to recommend to the Commissioners that this request be APPROVED. The motion passed unanimously. B: DONALD LANIER, Asheboro, North Carolina, is requesting that approximately 69 acres located on SR 1341 (Loflin Hill Road) , Tabernacle Township, be rezoned from Residential Agricultural to Residential Mixed. Zoning Map #6791. It is the desire of the applicant to develop a 53 lot subdivision for manufactured housing. Don Lanier was present and explained this subdivision would contain lot sizes of 1+ acres (approximately twice the required size) , underground utilities, require mobile homes to be no older than 1985 models, and the timber on the property would remain (except for roads and home sites) . Lanier stated that some of the neighbors in this area were contacted and said they had no opposition. Davidson County Water, Inc. would service the development. JIM & PEGGY WALLACE, were present and expressed opposition to mobile homes being located on this property. Wallace said his plans were to subdivision his property (across the road) into 4 tracts (12 1/2 acres each) for his children. Wallace stated that he would like to see this property development Residential Restricted. J. B. DAVIS, adjoining land owner, stated that in the future he plans to develop and move to his property and feels this type of development would not be appropriate for this area. Davis stated that he knew there was a need for this type of development but he felt it should be placed somewhere else in the County. There were 7 people present in opposition to this request. Board member Doyle Stout stated that he felt it was the County responsibility to protect the people that RANDOLPH COUNTY PLANNING BOARD MINUTES November 5, 1991 Page 5 live in this area and that he did not believe this type of development was appropriate for this community. Doyle Stout made the motion to recommend to the Commissioners that this request be DENIED on the grounds that this development would greatly increase the density level of this low density community. Bill Dorsett seconded this motion and the motion passed with a 6 - 1 vote. Maxton McDowell voted against the motion. C: PHIL HENLEY, Asheboro, North Carolina, is requesting that approximately 30 acres located on SR 2611 (Grayson Byrd Road) , Franklinville Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7781. It is the desire of the applicant to develop a restricted residential subdivision of 37 lots. Vance Roberts, agent, told the Board the development would be for site built homes and the lot sizes exceeds the County restrictions. Roberts told the Board that all the surrounding subdivisions had lot sizes of 20, 000 sq. ft. (almost 1/2 the size of this development's lots. ) . BILL & CAROLYN MCKENZIE, Hwy 64, presented the Board with a petition of 14 signatures in opposition to the number of lots proposed for this development. McKenzie told the Board that they are not opposed to the Residential Restricted Zoning just the number of lots. Vance Roberts told the Board that he and his partners are already dealing with so many things against them. Roberts said the property adjoins a mobile home park, a used mobile home sales lot, and is across the road from a mobile home supply sales business. Roberts said with these variables the lots would already be difficult to sell for site built development lots. Bill Dorsett said this would be an improvement to the area and would be very appropriate. Jim Routh made the motion, seconded by Arlie Culp, to recommend to the Commissioners that this request be APPROVED. The motion passed unanimously. 6. MISCELLANEOUS: A: Amendment to County Zoning Ordinance VESTED RIGHTS AMENDMENT Senate Bill 766 - G.S. 153A-344 . 1 RANDOLPH COUNTY PLANNING BOARD MINUTES November 5, 1991 Page 6 Hal Johnson explained to the Board that the State has past a Senate Bill #766 that requires Counties and Local Governments to add the VESTED RIGHTS AMENDMENT to their local ordinance. The Home Builders Association was concerned because properties were being purchased for development and before the development could begin local governments were changing the zoning of the property. Randolph County will require a developer to have a site specific development plan to be approved through the Conditional Use Rezoning process. This would grant the developer a vested time period of 2 years . Doyle Stout made the motion, seconded by Maxton McDowell, to make this amendment to our zoning ordinance. The motion passed unanimously. B: Miscellaneous Business The Planning Board adopted a resolution to honor Richard Petty for the many outstanding contributions he has made to Randolph County during his 16 years of service as County Commissioner and the numerous charitable activities he has been involved with. The resolution is to name the portion of U.S . Highway 220 extending between its intersection with Hwy 311 (Randolph County) and N.C. Hwy 62 (Guilford County) in his honor. A copy of the resolution is attached. Bill Dorsett made the motion, seconded by Doyle Stout, to adopt this resolution. The motion passed unanimously. 7. The meeting adjourned at 8 :52 p.m. There were approximately 75 citizens present at this meeting. RESOLUTION WHFREIIS, Richard Petty, has made outstanding contributions to the public welfare during his 16 years of service as a Randolph County Commissioner and has given of his time in support of numerous charitable activities; and WHEREAS, Richard Petty's 200 NASCAR Grand National career victories places him in an unprecedented position at the top of his profession; and WHEREAS, U. S. Highway 220 is the primary highway traveling near Richard Petty's home, Petty Enterprises, and the Richard Petty Museum, in Level Cross, North Carolina, and WHEREAS, after 34 years of NASCAR Grand National racing, Richard Petty has become a true American legend; and has dedicated his final year of professional racing as a "Fan Appreciation Year" and NOW, THEREFORE, BE IT RESOLVED, by the Randolph County Planning Board under authority granted to it by the Board of County Commissioners through County Road Naming Ordinances, that the North Carolina Board of Transportation be asked to dedicate the following portion of U.S. Highway 220 in honor of RICHARD PETTY as one expression of appreciation from a grateful State: That portion of U.S. Highway 220 extending between its intersection with U.S. Highway 311(Randolph County) ; and N.C. Highway 62 (Guilford County) ; a distance of 8 miles. This is the 5 day of November 1991.
