RANDOLPH COUNTY PLANNING BOARD
June 2, 1992
1. Chairman Bill Dorsett called the meeting of the
Randolph County Planning Board to order at 7 : 00
p.m.
2 . Hal Johnson called roll of the Board members: Bill
Dorsett, Chairman, present; Phil Brower, Vice
Chairman, present; Jim Routh, present; Lynden Craven,
present; Charles Adams, present; Aweilda Williams,
present; Doyle Stout, present; Arlie Culp, Alternate,
present; and Maxton McDowell, Alternate, absent.
3 . Lynden Craven made the motion, seconded by
Charles Adams, to approve the Minutes of the Randolph
County Planning Board meeting of May 5, 1992 and the
Randolph County Board of Adjustment meeting of May
5, 1992 . The motion passed unanimously.
4 . REQUESTS FOR REZONING:
A: ANDY & KEITH AIKENS, Trinity, North Carolina, is
requesting that 125. 33 acres located on SR 1553
(Old Mountain Road) , Trinity Township, be
rezoned from Residential Agricultural to
Residential Mixed/Conditional Use. Zoning Map
#6795. It is the desire of the applicant to
develop a mobile home park of approximately 90
spaces.
Andy & Keith Aikens were present with their
engineer, Dan Pritchard of Jamestown
Engineering.
Andy Aikens addressed the board and said that
it was his intention to develop a well designed
and managed Mobile Home Park. Mr.
Aikens said that he felt the proposed
development was compatible with the existing
mobile home parks and manufactured housing
currently located on this portion of Old
Mountain Road. He said that he has made every
effort to comply with County development and
environmental concerns. Mr. Aikens said a Park
manager would reside on the premises.
Dan Pritchard, Engineer, explained to the Board

all the preparation that had gone into this
proposed development. Glen Simpson, Soil
Scientist, has preformed soil evaluations on the
site, the property was flown for topographical
maps, tentative plans for attachment to Davidson
Water Company's system, etc. Approximately 20
acres have been set-a-side for common areas and
designed in such a way to also act as a buffer
zone to adjoining properties. Pritchard stated
that park restrictions far exceed the current
County regulations for mobile home parks and a
full-time manager would remain on the premises
to aid in enforcement. Pritchard described the
plan as compatible to the adjoining properties.
Pritchard added that this project would be
developed in 5 phases with a completion date of
1995. Pritchard advised the Board that the
proposed Mobile Home Park and plans had been
designed to meet County subdivision standards
(with future road paving) should future
developers desire to so develop it.
LAWRENCE BEVERE, Old Mountain Road, presented a
petition to the Board of approximately 115 area
residents in opposition to this request.
Mr. Bevere asked that his petition be
returned to him after presenting it to the
Board. Bevere stated that this development could
cause traffic hazards (being located in a sharp
curve) , fire hazards (1 1/2 miles of roads and 90
mobile homes located in this area with 1 fire
hydrant at the entrance of the park being
proposed) , and lower property values.
THERE WERE 32 PEOPLE IN THE MEETING ROOM IN
OPPOSITION TO THIS REQUEST.
DONNA LEWIS, Old Mountain Road, stated that this
development of 90 mobile homes would cause our
taxes to go up to provide school buildings for
the children, school buses for transportation,
sheriff personnel and equipment for security,
and the development would lower tax values.
Lewis stated that in her opinion this would be a
pure case of taxation without representation.
DOYLE GALLOWAY, adjoining property owner, stated
that this would cause his 2100+ sq. ft. house to
be lowered in value. Galloway stated that he
had spoken with Major Allen McNeill, Randolph
County Sheriff's Department, and he said that
his department did not have money, personnel, or
equipment to handle what is currently in

Randolph County much less with this proposed
development of a large mobile home park.
Galloway stated that the recreation areas that
are being proposed are gullies and children
would not be able to plan here. Galloway
criticized restrictions saying that they would
not be able to be enforce. Galloway asked the
Board not to take away everything he had worked
for in the last 7 years.
HARLEY CASE, adjoining land owner, hand cleaned
his property of trees and brush. Case stated
that he already has 9 1/2 mobile homes adjoining
his property. Case added that there is no
garbage service in this area so all the garbage
ends up on his property.
A CITIZEN stood up in the meeting and prayed
thanking God our Lord for his good community
free of drugs, liquor, and sin. He continue to
ask God not to allow such development in his
community.
JOHN SMIRZNAK, Finch Farm Road, said that he was
aware that rural areas of Randolph County were
changing but stated that this would be a
landmark decision because this decision would
determine the type of development that would
continue in this area.
JIM THOMAS, adjoining property owner, stated
that this development would be detrimental to
public health, safety, and welfare because of
problems such as water pollution, littering, junk
problems, added septic tank systems, stray
animal control problem, traffic conditions, road
maintenance, crime, etc. Thomas added that this
would be a giant step backwards for Randolph
County.
BOARD MEMBER CHARLES ADAMS stated that he drove
a school bus for 4 years on this road and that
all buses traveling on this road are at full
capacity. Adams added that this would possibly
over-burden Trinity School System.
Phil Brower made the motion, seconded by Lynden
Craven, to recommend to the Commissioners that
this request be DENIED based on concerns
presented by area citizens at this meeting. The
motion passed unanimously.
B: ROGER LAMBETH, Asheboro, North Carolina, is
requesting that approximately 1 acre (out of 63
acres) located on SR 1686 (Mt. Shepherd Road) ,

Tabernacle Township, be rezoned from Residential
Agricultural to Light Industrial/Conditional Use.
Zoning Map #7712 . It is the desire of the
applicant to construct a frame shop (building
size 150' x 50' ) .
ROGER LAMBETH was present at the meeting and
explained to the Board his intentions to
construct a 150'x 50' building to employ 8
people for a frame business to operate 6 days a
week from 7 am to 5 pm. When asked about noise
levels generated by the business, Lambeth stated
the saws should not be heard but there would be
a large fan to control dust that would be heard.
MARVIN SPENCER, adjoining property owner, said
he wanted to go on record as being opposed to
this rezoning.
ROBERT OSLEY, representative for Mt. Shepherd
Methodist Church, stated that the Church had met
concerning this request and was not in
opposition to this request but did not feel
adequate buffer zones had been established.
CHAIRMAN BILL DORSETT expressed his opinion that
it would be inappropriate to locate a business
on this road. Dorsett added that if this
activity was allowed he felt the Board should
require adequate buffer zones at the road and
the adjoining property line of Mt. Shepherd
Church.
BOARD MEMBERS JIM ROUTH & AWEILDA WILLIAMS
expressed their concerns of the need for
adequate buffer zones and the need for Lambeth
to be courteous to the Church during funeral
services at the cemetery.
Lambeth stated that he would be willing to shut
down during funeral services if the Church would
notify him prior to the services.
Aweilda Williams made the motion to recommend to
the Commissioners that this request be APPROVED
with the following restrictions:
*no outside storage
*business be courteous to church services
(concerning noise)
*adequate evergreen screening (buffer zones) at
the road frontage and on side property line
adjoining Mt. Shepherd Church.

This motion was seconded by Phil Brower. The
motion passed unanimously.
5. SPECIAL USE PERMIT REQUESTS:
CHAIRMAN BILL DORSETT asked that anyone desiring to
give testimony to the Board concerning any Special
Use Permit Requests being heard to please stand and
be sworn in as required by N.C. regulations.
Chairman Dorsett administered the oath
(approximately 75 citizens took the oath) .
A: ASSOCIATION OF HAPPINESS FOR ALL MANKIND,
Asheboro, North Carolina, is requesting a
Special Use Permit for the development of Day
Camping & for the development of a Camping &
Meditation Retreat facility on 33 1/2 acres
location on Hwy 134, Union Township, Zoning Map
#7656, Zoning District RA.
STAN DAVIS, Vice President of AHAM, told the
Board that AHAM has been legally chartered as a
church since 1978 . Davis described the
plan as a wish list and stated that this
would be the maximum buildings and would
probably be 20 to 25 years before it would
be completed. Davis stated that he was
._, aware that this request was thoroughly covered
at last month's Board meeting. Davis addressed
5 concerns raised by the community:
Security: Davis stated that the organization
required advanced registration to allow them to
screen all visitors of their retreat center.
The center also requires visitors to sign in and
out and to complete additional evaluation forms.
Children's safety: Children must be accompanied
by adults when in the woods or around the lake.
Davis stated that their programs are for adults
and older teens and there will be a children
center constructed for the few visiting
children.
Maintain Peace & Sanctity: The center requires
silence during meditation times; all doors to be
closed quietly; all lights must be out by 11 pm;
no alcohol, illicit drugs or fire arms allowed
on the premises; all conversation should be kept
at a minimum; no radios only tape recorders
allowed with ear phones.
Property Values: Davis told the Board the
center would increase property values because of
their involvement with preservation of the

environment (on their property) . Davis added
that because of the high quality buildings being
constructed on the property it would enhance the
values.
Increased Automobile Traffic: Davis stated that
Hwy 134 is gaged for far more vehicles than it
currently services. Davis stated that District
Highway Engineer Jeff Picklesimer explained to
him that Hwy 134 is designed for a "medium"
capacity of 8, 000 cars per day and that at
present approximately 2 , 500 cars (only 25% of
capacity) .
Davis then addressed the Board concerning false
rumors being spread through the community.
Davis stated that these rumors were being
maliciously spread by narrow-minded ignorant
people. Davis informed the Board the rumors
stated that this organization were devil
worshipers, a satanic cult, and nudists. Davis
stated that this type of activity is not
condoned on the property and told the Board that
they are not devil worshipers, they embrace all
denominations of all religions (Christianity,
Jewish, Muslim, Buddhism, etc. ) to use their
retreat center. Davis extended an open
invitation to everyone in the community to visit
the retreat center. Davis described the group
as a spiritual group not a religious group.
There were approximately 15 people present that
had attended meditation training at this center.
TRISH ROGERS, teacher in Randolph County School
System, explained to the Board that her teenage
children had attended meditation training at the
center and have learned respect, love, and
concern for their elders.
RICHARD STOCKNER, native of Randolph County,
told the Board that he was diagnosed with an
incurable disease and that he should learn
mental healing (meditation) . Stockner said that
these people (AHAM) have taught him how to
properly meditate.
BOB WALKER, Asheboro businessman, stated that
their teachings have taught him the values of
being quiet and how to handle stress.
ELIZABETH McDONALD, President of the Board of
AHAM, explained that this type of meditation has
�.., brought her closer to Jesus Christ. McDonald
told the audience that love is the most powerful
emotion that love is everything. McDonald told

the community members present that she wanted
them to know that AHAM loves them no matter what
decision is made.
BOARD MEMBER DOYLE STOUT named several persons
(that had visit AHAM) and asked Davis if he knew
these people. Davis answered yes. Stout said
that he had questioned these people and found
them to be extremely intelligent and
professional (mortgage officer, teacher,
attorney, photographer, housewife, etc. ) . Stout
asked Davis if the type of meditation his
organization used was similar to the same type
of meditation that he does prior to him
beginning his martial arts training; a mind
cleansing meditation not religious. Davis
answered similar. Stout stated that he lived in
this community and that he was sure his
neighbors would not say the things that Davis
stated had been rumored. Davis said that the
rumors could have been made by persons outside
of the community.
JOHN MEGERIAN, Attorney representing opposition
to AHAM's request, first address the Board by
saying that love may be what its all about but
that's not what zoning is all about. Megerian
said that Davis is making this seem wrong to
oppose such a "nice, quiet" group of people that
these people (in opposition) are here on some
sort of witch hunt and that they are
narrow-minded, ignorant people. Megerian said
that Davis is wrong that these people are not
nuts and that they have every right (and it is
not wrong) to come to these Public Zoning
Hearings and tell their members of Government
that they oppose this issue. Megerian described
this request as a business (be it non-profit or
not) and that no matter how "nice" this group is
if 400 people leave one site a the same time
they will be a noisy bunch of "nice" people.
Megerian said that Davis made this request seem
(if approved) that this would allow the area to
be nice and quiet. Megerian added that the area
is already nice and quiet. Megerian told the
Board that at total capacity (if completely
filled) would be in excess of 1000 people.
Megerian responded to the security answers (that
Davis brought to the Board) as being a joke.
Megerian stated that how could the neighbors
feel safer just because AHAM requires the guest
to complete a form, Megerian added that this was
the same type of requirement the Holiday Inn
would ask of you prior to booking reservations.
Megerian said that this request would

drastically change the character of the
neighborhood and that he questioned this
activity (because of its size) being allowed in
a RA zoning district even with a Special Use
Permit. Megerian reminded the Board that it was
Mr. Davis that must prove this activity will not
endanger the health, safety, and welfare of the
community, not the community's responsibility
(as per the County zoning regulations) .
Megerian presented an appraisal of the adjoining
(to this request site) property prior to the
proposed development and an appraisal if this
was developed. Megerian stated that these
appraisals were performed by Joyce Davis (an
expert in real estate) and that this activity
would depreciate the property value by 30%
because the character of the area would no
longer by rural/agricultural but would become
tourist/business. Megerian stated that the
location and character of this request would not
be in harmony with community, the request would
cause traffic problems, devalue property in the
community. Megerian stated that his clients had
not slandered anyone by calling anyone a devil
worshiper, his clients have just expressed their
right to oppose this issue.
JOYCE DAVIS, Real Estate Appraiser, Asheboro,
addressed the Board and stated that it was her
professional opinion that a Retreat Center as
currently proposed would reduce adjoining single
family housing values by approximately 30%.
Davis told the Board that she based her
appraisals on 15 years of real estate
experience and 3 years of performing
professional appraisals.
ADJOINING PROPERTY OWNERS JERRY GALLESPE, GARY
BRADY, JEANETTE LUNDY, JANES YOUNG, ROGER
CARLSON, WENT ON RECORD AS BEING OPPOSED TO THE
REQUEST. THERE WERE APPROXIMATELY 250 PEOPLE
HERE IN OPPOSITION TO THIS REOUEST.
STAN DAVIS, VICE CHAIRMAN AHAM, followed up by
saying that he did not say this community was
ignorant or narrow minded, he said those persons
responsible for the rumors were. Davis added
that the traffic statistics were given to him by
NCDOT. Davis added that he did not feel the
facility would ever be more than 50% capacity.
BOARD MEMBER CHARLES ADAMS stated that he has
been a Quaker Minister for 26 years and that
the Quaker's have experienced being hung for
their different beliefs. Adams said that he did

not feel this group (ARAM) would do any harm but
that he did feel this site did not contain an
adequate amount of land. Mr. Adams added that
the adjoining property value evaluation provided
by Joyce Davis should be considered in relation
to the property evaluation provided him by
former Planning Board member (Davis) in
1980; that a junkyard 1/4 mile from his
residence would not have any effect on his
property values.
BOARD MEMBER JIM ROUTH said that he felt that as
a Board we have the responsibility to listen
to the citizens (not just land development
plans) and that if the Board neglects the
opinions of this many community members then we
are not doing proper service.
Doyle Stout made the motion, that based on the
specific concerns expressed by the area
residents, the request be DENIED. Lynden Craven
seconded the motion. The motion passed
unanimously.
VICE CHAIRMAN PHIL BROWER explained to the
citizens present that the decision of the
Planning Board was made because of the density
level effect this request would have.
CHAIRMAN BILL DORSETT told the citizens present
that this Board had made a heart felt decision
and that them (citizens) being present did have
an effect on the decision of this Board.
Dorsett encouraged the citizens to go home and
tell their neighbors that they had made a
difference by attending this meeting.
B: STEVEN BERNSTEIN & ASSOCIATES, (agents for Centel
Telephone) , Monroeville, Pennsylvania, is
requesting a Special Use Permit to located a 300'
cellular tower and a 12x28 equipment shelter on
approximately 2 acres located on Hollow Hill Road
SR 2406) , Liberty Township, Zoning Map #8707,
Zoning District RA.
RONALD G. BIZICK, III, agent for Centel,
described the property as being owned by Henry
York III and that this would be a lease
agreement for a 220' tower (much less than
original request of 300' ) with guyed wires of
127' . Bizick stated that the closest residence
would be 272 ' from this site and that would be
Mr. Duncan's Property. Bizick described the
tower with 800-900 watt mega-hurts with
documents supporting his statements that the

tower would not cause interference to Satellite
reception, TV reception, etc.
LEE HARDIN, adjoining property owner, Hollow
Hill Road, stated that he did not want to walk
out of his back door of his residence and see
this unsightly tower each day. Hardin stated
that he has placed his life-savings into this
home. Hardin added that he did not think that
Centel had obtained the proper right-of-ways to
the property in question.
DALE GILMORE, officer of Gilmore Plant & Bulb,
stated that he was in opposition to this request.
LARRY SALMON, adjoining resident, expressed his
concerns of space being leased (with less mega-
hurts such as pager systems) that may cause
problems of interference to TV's and radios,
etc.
Lynden Craven made the motion, seconded by Phil
Brower, to DELAY any action on this request
because the proper right-of-ways had not been
obtained. The motion passed unanimously.
C: GEORGE VUNCANNON, Asheboro, North Carolina, is
requesting a Special Use Permit to obtain a
dealers license at his residence located on 27
1/2 acres on Hwy 64 East just before Click's
Barber Shop, Franklinville Township, Zoning Map
#7772 , Zoning District RA.
George Vuncannon was present and explained to
the Board his plans to transfer his dealer's
license to this location.
THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS
REQUEST.
Lynden Craven made the motion, seconded by
Charles Adams, to APPROVE this request for a
Special Use Permit as consistent with the Land
Development Plan for this area. The motion
passed.
D: LACY DUNN, Asheboro, North Carolina, is
requesting a Special Use Permit to construct an
addition to an existing business for upholstering
furniture on 18. 5 acres located on Business 220
Hwy approximately 1 mile south of the Block
Plant, Cedar Grove Township, Zoning Map #7659,
Zoning District HC-CU.

Lacy Dunn was present at this hearing and
explained that he plans to construct a building
for lease purposes.
THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS
REQUEST.
After review and discussion, Lynden Craven made
the motion, seconded by Doyle Stout, to APPROVE
this request for a Special Use Permit. The
motion passed unanimously.
E: JERRY EDWARDS, Trinity, North Carolina, is
requesting a Special Use Permit to operate a
beauty shop and pest control business in an
existing building of (26x50) building at his
residence located on 9 . 8 acres on SR 1558
(Hopewell Church Road) , Trinity Township, Zoning
Map #7707 , Zoning District RA.
Edwards was present at this hearing and
explained his intentions for an existing
building to locate his business and his wife's
business behind his residence. Edwards stated
that he had 2 employees for his pest control
business.
THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS
REQUEST.
Charles Adams made the motion, seconded by Doyle
Stout, to APPROVE this request for a Special Use
Permit. The motion passed unanimously.
7 . ADOPTION OF PRIVATE ROAD NAMES: Asheboro Postal
District - Routes 4, 7, 8, & 11
There were 5 people present concerning private road
names for this postal district.
A citizen was present to be sure that B&B Trail off
of Lee Valley Road would retain its name.
Hal Johnson reviewed with the Board various Road Name
changes and adjustments made after receiving
additional citizen input and/or petitions.
After review and discussion Charles Adams made the
motion to APPROVE these private road names along with
some corrections of State Road names. (See
attachment) Aweilda Williams seconded this motion
and the motion passed unanimously.

8 . ADOPTION OF ADDRESS RANGES: Asheboro Postal District
- Routes 1, 4, 6, 7, 8, 10, & 11 (Private & Public

After review and discussion, Charles Adams made the
motion, seconded by Aweilda Williams, to APPROVE the
adoption of the attached address ranges. The motion
passed unanimously.
9. The meeting adjourned at 10:45 p.m. There were
approximately 350 people present at the meeting.

The Public is advised that on Tuesday, June 2, 1992 ,

The Public is advised that on Tuesday, June 2 , 1992,
at 7 : 00 p.m. , in the Commissioners' Meeting Room, Randolph
County Office Building, 707 McDowell Road, Asheboro, the
Randolph County Planning Board will conduct a Public Hearing as
required to adopt official Private Road Names and Address
Ranges for those roads located in the Asheboro Postal District
Routes 4 , 7 , 8, 11. For purpose of this Countywide project, a
PRIVATE ROAD is defined as meeting the following criteria:
1. The Road is open for general public traffic travel and
serves a minimum of 3 residences or addressable structures
in separate and different ownership.
2 . The Road is not State maintained.
3 . The Road is not located within the corporate limits of a
municipality.
Interested citizens are invited to attend this meeting and
will be given the opportunity to make comments or suggestions.
