RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT
July 7, 1992
1. Chairman Bill Dorsett called to Order the Randolph
County Zoning Board of Adjustment meeting to order
at 7 : 00 p.m.
2 . Roll Call of Board members: Bill Dorsett, Chairman,
present; Phil Brower, Vice Chairman, present; Jim
Routh, present; Charles Adams, present; Lynden
Craven, present; Aweilda Williams, present; Doyle
Stout, present; Arlie Culp, Alternate, present;
and Maxton McDowell, Alternate, present.
3 . VARIANCE:
REVIEW OF CASE:
DONALD KIRBY, High Point, North Carolina, is
requesting a Variance for an addition of a garage to
his residence with a side setback of 6' in lieu of the
required 10' . Location: Spencer Acres, Section 2 ,
Lot 19 , SR 1929 (Spencer Road) , New Market Township,
Zoning Map #7737 , Zoning District RA.
Chairman Bill Dorsett asked that anyone desiring to
give testimony in the matter of the Request for
Variance please stand and be sworn in as required by
N. C. regulations. Donald Kirby, High Point, North
Carolina, stood and was sworn in by. Chairman Dorsett.
**Arguments for Granting Request
Donald Kirby was present and stated that he had
owned the property for 2 years and that his
house was built prior to him purchasing the
property. Kirby stated that it was his
intention to construct and addition of a 2-bay
garage to his residence but because of the odd
shape of his lot he would not be able to meet
the required 10' setback.
Hal Johnson, Planning Director, stated that
Kirby had filed a letter, from his adjoining
property owner, in the Planning Department,
stating no opposition to this request.
**Arguments Against Granting Request

There was no one present in opposition to this
request.
**Board Discussion: Conclusions based on Findings of
Fact
The Board found that Kirby had met the
following findings of fact required prior to
approval of a Variance:
1. The Board found that a hardship was not a
result of the applicant's own doing.
2 . The Board found that this variance would not
violate the intent of the County Ordinance.
3 . The Board found that the use will not
substantially injure the value of adjoining or
abutting property.
**Order of Board of Adjustment
Lynden Craven made the motion to APPROVE this
request for a Variance based on the Board's
Findings of Fact. Charles Adams seconded this
motion and the motion passed unanimously.
4 . The Board meeting adjourned at 7 : 07 p.m.
