Chairman Bill Dorsett called to order the Randolph County Planning Board meeting at 7: 00 p.m. 2 . Roll Call of Board Members: Bill Dorsett, Chairman, present; Phil Brower, Vice Chairman, absent; Jim Routh, present; Lynden Craven, present; Charles Adams, present; present; Doyle Stout, absent; Aweilda Williams, absent; Arlie Culp, Alternate, present (substituting for regular member Phil Brower) ; and Maxton McDowell, Alternate, present (substituting for regular member Doyle Stout) . 3. Lynden Craven made the motion, seconded by Jim Routh, to Approve the Minutes of the Planning Board meeting held on September 15, 1992 . The motion passed unanimously. 4. REQUESTS FOR PROPERTY REZONING: A: ANDY & KEITH AIKENS, Trinity, North Carolina, is requesting that 125. 33 acres (Old Mountain Road) , Trinity Township, be rezoned from Residential Agricultural to Residential Mixed/Conditional Use. Zoning Map #6795 . It is the desire of the applicant to develop a single family, owner occupied, residential subdivision allowing single wide manufactured houses. JOHN MEGERIAN, Attorney, represented Andy & Keith Aikens. Megerian explained to the Board that this request had come before the Board a few months ago and at that time the adjoining land owners didn' t seem to have a problem with mobile home development. The problem seemed to be that the individuals that would live in this development would be renting the property and would have no roots in the community therefore would be more likely to not take care of the community. Megerian stated that this request had been altered to be sensitive to this concern, that this would be owner occupied lots allowing the individuals that purchased the lots to construct a house, locate a mobile home, or develop the property with a modular home. Megerian stressed that this would not be a mobile home park, that mobile home development would be allowed, but the lots would be owner occupied. Megerian stated that his clients would consent to conditional use zoning allowing the Board the impose restrictions to their choosing on this subdivision. Megerian said that his clients have a proposed set of restrictions that would consist (but not be limited to) of the following: *only single family development, no apartments allowed *all mobile homes placed on the lots would be required to be brick underpinned within 90 days of location *no junk vehicles allowed Megerian stated that he and his clients felt, from comments made by the Board of Commissioners and Real Estate Appraisers in attendance at the last hearings , that this type of development (mobile home subdivision) would be the highest and best use of this land. Megerian said that in fact the community is filled with countless mobile homes and this type of development would be in harmony with the community. Megerian said that concerns of traffic problems being generated by the entrance location on Old Mountain Road should not be relevant in make a decision because this plan has been approved by Jeff Picklesimer, NCDOT District Highway Engineer, in fact Picklesimer stated that the road was designed for much more traffic flow than Old Mountain Road has experienced. Megerian stated that this project would be developed in phases and that his clients would be willing to allow the Board to decide when each phase could be developed and how many lots would be in each phase. BILLY JOE STRICKLAND, adjoining land owner (across the road) , stated that he was in opposition to this request when the development was going to be a mobile home park but that since the lots will be sold he would have no opposition to this request. JOHN WHITEHEART, Whitley Mountain Road, stated that he felt this type of development would be good for the community. ANDY AIRENS stated that it was his intention to develop more subdivisions in Randolph County that this is not the only development planned. KEITH AIRENS told the Board that many people in the community were upset because they had closed a drug house down when they purchased the property. Aikens stated that people have been shooting at his home and family; Aikens told the people in attendance that this type of behavior would send you to hell. Aikens stated that mobile homes don' t make people �.. bad. THERE WERE 17 PEOPLE PRESENT IN FAVOR OF THIS �-- REQUEST. ART BEVAN was present in opposition to this request and asked for everyone present in opposition to stand. Approximately 30 people stood. Bevan stated that there was no difference between a trailer park and a mobile home subdivision. Bevan stated that the current low density Residential Agricultural zoning should remain or the property should be rezoned to Residential Restricted. Bevan said that the trend of development in this area was site built homes with a RR zoned subdivision 1 . 10 miles north of this site, a RR zoned site 1 mile southeast of this site, and a RR zoned site . 5 miles from this site. Bevan added that Residential Restricted developments create more tax dollars. PAMELA MERRITT, Finch Farm Road, expressed her opinion that this type of development should end in this area. Merritt stated that this development would be a high density low-cost development and that the trend in this area is low density high-cost developments . Merritt stated that this request could cost problems with traffic, schools, road maintenance, etc. Merritt stated that the U. S. Constitution states that no one is gaurenteed to profit. THOMAS JENKINS, Forestdale South, stated that he owns property in a neighboring subdivision and that he will not build in this development if this is approved because of the effect it will have on property values. DOYLE GALLOWAY, owns adjoining farm, expressed his concerns of what effects this type of development will have on the Uwharrie River Watershed. JIM THOMAS, High Point and an adjoining property owner, told the Board he felt the proposed development would not be in harmony with the residential development occurring along the east side of Old Mountain Road, and Finch Farm Road. Mr. Thomas felt the character of development should maintain its Restricted Residential land use pattern. (In addition to persons addressing the Board, the following letters were presented to the Board expressing opposition to the request; Jim Thomas; John Holton; and Pamela Merritt. ) No further persons spoke in opposition to the request. Chairman Dorsett then ended the citizen comment phase of the hearing and opened the meeting for Board member comments. CHARLES ADAMS, said that he was concerned over the proposed density of the development and the impact the subdivision would have on area schools. Adams also said that he felt the proposed development did not meet the "spirit and intent" of the County' s zoning ordinances. Hal Johnson, Planning Director, reviewed with the Board some of the Planning issues relative to a decision on this project. Johnson said that concerns relative to road construction; existing highway vehicle capacity; suitability of soils for septic tanks; watershed protection; and erosion control problems had all been adequately addressed by the professional engineers; surveyors; and soil scientists that had previously given testimony to the Board in support of the applicants rezoning request. Any increase in population to an area will impact the public schools ability to serve the student population, however, the proposed development is designed to be completed in sections. This would spread out the growth over a 2-3 year time period. Johnson said that the issue to be determined by the Board was the long range strategic intent of the County' s land use plan in this area. Particular thought should be given to the long range impact of development trends along the east side of Old Mountain Road, and the area west of Finch Farm Road. After discussion, Charles Adams made the motion, seconded by Lynden Craven, to recommend to the County Commissioners that this request for Residential Mixed Zoning be DENIED as not compatible with the land use plan for the impacted area. This motion passed unanimously. B: KEN MCDOWELL & REID KEARNS, Asheboro, North Carolina, is requesting that approximately 50 acres located on SR 2106 (Racine Road) , Providence Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7777 . It is the desire of the applicant to develop an additional 42 lots to Woodfield Acres Subdivision. (Property Owner - W.E. Hockett) . KEN MCDOWELL & REID KEARNS were present at the meeting and explained to the Board that Mr. Hockett had contacted them to purchase and develop his farm in the same manner that Woodfield acres had been developed. McDowell stated that this would add approximately 42 lots to this development that restricts to only site built homes of no less than 1200 sq. ft. of heated space. THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS REQUEST. LYNDEN CRAVEN made the motion, seconded by CHARLES ADAMS, to recommend to the Board of Commissioners that this request be approved as consistent with the land development in this area. The motion passed unanimously. 5 . REQUESTS FOR A SPECIAL USE PERMIT: A: RICHARD C. BOWN, Asheboro, North Carolina, is requesting a Special Use Permit to operate a rural family occupation of a race-car workshop in an existing building located on 5 acres on SR 1193 (Old N.C. Hwy 49) , Concord Township, Zoning Map #7619, Zoning District RA. RICHARD BOWN was present with adjoining property owners . Bown explained his plans to operate a Race Car Business that would race in the Busch Grand National Series. Bown said that normal operating hours would be 9 am to 7 pm with very little noise. Bown said he would be considerate of his neighbors . THERE WAS NO ONE PRESENT IN OPPOSITION OF THIS REQUEST. MAXTON MCDOWELL made the motion, seconded by Arlie Culp, to APPROVE this request for a Special Use Permit. The motion passed unanimously. B: WALTER R. LANIER, JR. , Asheboro, North Carolina, is requesting a Special Use Permit to allow selling, towing, and storage of automobiles at his residence located on a 67 acre tract on SR 1193 (Old NC Hwy 49) ; Cedar Grove Township; Zoning Map #7720; Zoning District RA. WALTER LANIER was present at the meeting and explained to the Board that he has lived in this community for 33 years. Lanier stated that he and his son have been operating a towing business for 4 years. Lanier said that he would like to use an area of land located behind his hog lots to store the cars until insurance companies settle their cases. Lanier stated that because his son was trying to get his dealers license he found out he was not properly zoned for this activity. EARL GREENE, adjoining property owner, stated that he has lived in the community for 50 years and that he would not be in opposition to Lanier having 10 acres in behind his barn to locate the wrecked vehicles. Greene stated that he would like to see a buffer of 100 ft. imposed on his front property line and his rear property line. BRENDA GREENE, adjoining land owner, expressed her concerns for run off of oil, anti-freeze, etc. THERE WERE 8 PEOPLE PRESENT CONCERNING THIS REQUEST. MAXTON MCDOWELL made the motion to APPROVE this request for a Special Use Permit with the following restrictions: *10 acres located behind the barn *100 ft. buffer setbacks (front/back property lines) *no permanent storage of vehicles *no selling of parts or stripping of cars on site LYNDEN CRAVEN seconded this motion. The motion passed unanimously. 6. MISCELLANEOUS BUSINESS: The November regular meeting of the County Planning Board will conflict with election night. For this reason Charles Adams made the motion, seconded by Lynden Craven, to move the meeting date to November 10, 1992 . The motion passed unanimously. 7 . The meeting adjourned at 8: 56 p.m. There were approximately 100 citizens present at the meeting.
