Doyle Stout, Vice Chairman, called to order the Randolph County Planning Board meeting at 1 :30 p.m. 2. Hal Johnson, Planning Director, called roll of the members: Doyle Stout, present; Ray Farlow, absent; Charles Adams, present; Guy Troy, present; Tal Harrison, present; Lynden Craven, present; Bill Dorsett, present; Maxton McDowell, Alternate (substituting for regular member Ray Farlow) ; Arlie Culp, Alternate, present. 3. Doyle Stout asked for a motion to approve the minutes for the December 9, 1987, Planning Board meeting. Guy Troy made the motion to approve the minutes, seconded by Lynden Craven, the motion passed. 4. Hal Johnson announced to the Board that the Board of County Commissioners appointed Bill Dorsett and Lynden Craven regular members to the Planning Board at the Commissioners January 4, 1988 meeting. Mr. Johnson also stated that the Commissioners had appointed Allen Holt, REMC, Asheboro, North Carolina, to serve on the Planning Board as an Alternate member at the same meeting. Linda Skeen, Randolph County Clerk of Superior Court, administered the required Oath of Office to Mr. Holt. 5. Hal Johnson explained to the Board that because of the resignation of Chairman Don Hancock it would be necessary to elect Chairman and Vice Chairman positions for the term of January to July, 1988. Tal Harrison made the motion to nominate Doyle Stout as Chairman of the N....i Planning Board. Charles Adams seconded this motion and the motion passed. Mr. Stout had been Vice Chairman to the Planning Board since 1979 and is from Union Township. Tal Harrison made the motion to nominate Charles Adams as Vice Chairman to the Planning Board. Lynden Craven seconded this motion and the motion passed. Mr. Adams had been a regular member of the Board since 1982 and was an Alternate member for two years prior. Mr. Adams is from Trinity Township. 6. SUBDIVISION: A. SOUTH CREEK, Section 3 (Final Plat) ; Grant Township; SR 2839; 14 Lots. Phillip Craven, Neal Craven, and Bob McDuffie - Owners. Hal Johnson explained to the Board that this subdivision would be for manufactured housing and because of large acreage tracts there will be a private, graveled road. Johnson also stated that a copy of the deed restrictions was in the Planning Office and that the restrictions would exceed the County regulations. The owners were present at the meeting. Tal Harrison made the motion, seconded by Charles Adams, to approve the final plat. This motion passed. 7. REZONING REQUESTS: A. Roby Kidd, Jr. , Asheboro, North Carolina, is requesting that approximately 5 acres of land lcoated right off Highway 64 on SR 2611, approximately 2 miles on right, Grant Township, be rezoned from Residential Agricultural to Highway Commercial. Zoning Map #7790. The applicant has an existing electrical business on property. Hal Johnson told the Board that when the County was zoned Mr. Kidd's property was not picked up as Commercial property and that his existing business was considered a non-conforming use. Mr. Kidd wants his property to be considered a conforming use. Roby Kidd, Jr. , was present at the meeting and explained to the Board that he had 6-8 employees and only four remained in the business all day because the others worked in the field. He also told the Board that most of his work was contracted by phone or mail, but that some people did come to the business for service. There was no one present at the meeting in opposition of this request and the Planning Department had not received any complaints concerning the request. Guy Troy made the motion, seconded by Lynden Craven, to recommend to the Commissioners this request be approved. The motion passed. • B. David & Dreama Brown, Thomasville, North Carolina, is requesting that approximately 1 acre of land located off Highway 62, Hillandale Subdivision, Section 2, Lot 157, Trinity Township, be rezoned from Residential Restricted to Residential Agricultural/Conditional Use. Zoning Map #6797. It is the desire of the applicant to use an existing building for the sale of fresh seafood. Mr. Johnson explained to the Board that the department had not received any complaints on this request and that there were no deed restrictions on this subdivision to prohibit this type of operation. Dreama Brown was present at the meeting. Ms. Brown explained to the Board that this would be a seasonal business with no cooking of fish and that the traffic flow would probably be 20 to 30 cars a week. Ms. Brown told the Board that she checked with the County Health Department to see what kind of regulations she would need to follow and was told there were none. Guy Troy asked Hal Johnson if this property was located in a large Residential Restricted District and was answered yes. Tal Harrison made the motion, seconded by Charles Adams, to recommend to the Commissioners this request be approved. The motion was approved by a 4/3 vote with Doyle Stout, Guy Troy, and Bill Dorsett voting against the motion. C. Robert Wayne Mosley, High Point, North Carolina, is requesting that approximately 3 acres of land located on the south side of SR 1921 between SR 1923 and SR 1922, New Market Township, be rezoned from Residential Agricultural to Light Industrial/Conditional Use. Zoning Map #7738. It is the desire of the applicant to locate and operate a junkyard on the property. Hal Johnson explained to the Board that there were vehicles (junked) located on the property prior to zoning in July 1987 and that Mr. Mosley wishes to expand. Mr. Mosley was present at the meeting and told the Board that the cars were 300' off the road, not very visible from the road, and the vehicles are located approximately 5 feet from the property line. Mr. Mosley was asked why the cars were so close to his property line and he explained that some had been there but more were moved there recently. He also told the Board that the cars were there before a neighbor bought the property and built his house. Mr. Mosley presented the Board with a petition from neighbors that were in favor of a junkyard being located on the property. Guy Troy asked Mr. Mosley why so many of the addresses were from Pleasant Garden and Randleman instead of High Point. Mr. Mosley answered that he had worked for these people. Mr. Mosley was asked how many vehicles were on the property at the present time and he answered 11 vehicles at this time and only about 10 would be added if this was approved. Mr. Mosley also told the Board that his business (located across the road) was at this location at one time but it burned in 1978. Hal Johnson asked Mr. Mosley if he had plans for buffer zones or other protections for the adjoining property owners because this type of business has an attendancy to grow. Mr. Mosley said there were trees on the property that would not be removed. Guy Troy stated that as a Planning Board this request should be considered in the light of the development plan because the commissioners approved the Land Development Plan to be considered in such cases. Chairman Stout asked if there was anyone present to speak in opposition of this request. 2 of 4 Kim Angel, adjoining property owner, explained to the Board that his house sat back of the road and that the cars located on the property at this time were approximately 65 feet from his house. He also said that the cars were lined up the property line. He and Mr. David Angel (another adjoining property owner) stated that they felt the community would be better served if it was left residential. Chairman Stout asked how many persons in the audience in favor of this request were adjoining property owners. Two raised their hands. Richard Hill, adjoining property owner, told the Board that the appearance of the property was well maintained. Richard Coltrane stated that Mr. Mosley was the most important resident in the neighborhood. Gene Hiatt stated that the junkyard was there before the Angels were. Kim Angel told the Board (in reference to this statement) that after a neighbor disput the cars were moved to the property line. Joe Gaddy told the Board that Mr. Mosley was an asset to the Community and that he depended on him for repair work. A concerned citizens also added that several elderly people felt . they could come to get things cheaper and not be ripped off. Guy Troy made the motion, seconded by Bill Dorsett, that the Board recommend to the Commissioners this request be denied because the request is not in keeping with the Land Use Plan. This motion was approved with a vote of 5/2. Charles Adams and Maxton McDowell voted against the motion. D. Richard Stockner, Asheboro, North Carolina, is requesting that approximately 27 acres of land located on the east side of Highway 220 approximately 100 ft. north of Intersection SR 1938/Highway 220 Business, Level Cross Township, be rezoned from Residential Agricultural to Light Industrial. Zoning Map #7768. It is the desire of the applicant to use the property for industrial development. (Property Owner - Fred Johnson) Richard Stockner was present at the meeting and told the Board that at this time there was not a planned use for the property that they wanted it rezoned for future development. He stated that Business 220 has been a major thoroughfare for many years and that the majority of new development in this area has been commercial. Chairman Stout asked if there was anyone present to speak in opposition of this request. Mrs. Robert Ransdale, neighboring resident, stated that the property was beautiful with wildlife and she did not want to see it developed with industry. She also told the Board that although there has not been much residential development recently the Board should consider the existing residences. Mrs. Ransdale then presented the Board with letters from neighboring property owners that were against the request. Ann Whitesell, neighboring resident, told the Board that she was against this type of development in this area. Evelyn Harris, Seagrove, North Carolina, told the Board she rented her property (that adjoins this request) for farming and she wanted to know what assurance she would have that there would be no drainage into her fields. Hal Johnson explained to Ms. Harris that the State would regulate the land erosion. Bill Lawrence stated that he was not against this type of zoning but that he may need to have his property rezoned if this property is. Robert Whitesell, neighboring resident, stated that he felt the community would be better served if the property was left residential and not rezoned industrial. Board member Bill Dorsett stated that the only type of development on the 'east side of Business 220 was residential and all other land was open fields. Mr. Dorsett stated that he felt if this rezoning was approved it would be introducing industrial growth on this side of Business 220 and that he did not feel this was the proper use. Bill Dorsett made the motion, seconded by Charles Adams, that the Board recommend to the Commissioners this request be denied to protect area residences and to promote orderly growth. The motion was approved by a 4/3 vote with Doyle Stout, Tal Harrison, and Maxton McDowell voting against the motion. E. Richard Stockner, Asheboro, North Carolina, is requesting that approximately 12 acres of land located 6 miles north of Randleman to Level Cross on the east side of Highway 220 Business, Level Cross Township, be rezoned from Residential Agricultural to Light Industrial/Conditional Use. Zoning Map #7768. It is the desire of the applicant to use the property for a unified business development. (Property Owner - Lillian Hayworth) 3 of 4 Richard Stockner was present at the meeting and stated that Business 220 has been a major thoroughfare for years and that there was a large demand for commercial development. He also said that the majority of new development was commercial and that there were several farms but they were not productive. Stockner told the Board that the area was changing from rural to commercial and industrial development. Stockner said that by allowing this unified business development of ten buildings it would mean an increase of $1800 to $2000 dollars to the County (tax wise) and it would also have benefits for Level Cross Fire Department. Stockner told- the Board that it was just a question of whether we want Randolph County to remain a bedroom county or if we wanted new businesses in the County. Jeff Schwarz (represented by Stockner) stated that he had already developed 9 businesses in this area prior to Zoning regulations. Chairman Stout asked if there was any opposition to this request. Parrish Clodfelter, adjoining resident, expressed his concerns of so many buildings on this size tract, outside storage, and problems area residences already face with existing industrial development. Clodfelter stated that if this property is rezoned we will have a metal building dump. Clodfelter presented the Board with letters from area residents that are against this rezoning. Ann Whitesell stated that she was against this type of development in this area. Mrs. Robert Ransdale asked the Board to consider the existing residents that are in the area. Board member Bill Dorsett stated that the only type of development on the east side of Business 220 was residential and all other land was vacant. Mr. Dorsett stated that he felt if this rezoning was approved it would be introducing industrial growth on this side of Business 220 and that he did not feel this was the proper use. Bill Dorsett made the motion, seconded by Charles Adams, to recommend to the Commissioners this request be denied to protect area residences and to promote orderly growth. The motion was approved by a 4/3 vote with Doyle Stout, Tal Harrison, and Maxton McDowell voting against the motion. 8. VARIANCE: A. Weldon Williams, Sophia, North Carolina, is requesting a Variance to construct a site built home on Carole Drive, Carraway Hills Subdivision, on 24,969 sq. ft. in lieu of the required 30,000 sq. ft. Weldon Williams was present at the meeting and told the Board that he purchased the property in 1986 and was not trying to deceoie the County but at the time of purchase the County only required 20,000 sq. ft. per building lot. Williams also stated that he had paid so much for the land that he needed to build both houses. Chairman Stout asked if there was any opposition to this request and there was none. Bill Dorsett made the motion, seconded by Lynden Craven, to approve the request. The motion passed. 9. MISCELLANEOUS: A. Hal Johnson advised the Board that the County Commissioners had reviewed the Planning Board's recommendations for the regulation of placement of new Poultry Houses in areas of County jurisdiction. The Commissioners delayed a decision pending a ruling by the N.C. Attorney General regarding whether "Poultry Houses" would constitute a "bona fide farm" under N.C. law, thus exempting them from County regulatory authority.
