RANDOLPH COUNTY PLANNING BOARD

There was a meeting of the Randolph County Planning Board on Wednesday,
March 9, 1988, at 1 :30 p.m. , in Courtroom B, Randolph County Courthouse, 145
Worth Street, Asheboro, North Carolina.
1 . Doyle Stout, Chairman, called to order the Randolph County Planning Board
meeting at 1 :30 p.m.
2. Hal Johnson, Planning Director, called roll of the members: Doyle Stout,
Chairman, present; Charles Adams, Vice Chairman, present; Ray Farlow, absent;
Guy Troy, present; Tal Harrison, present; Lynden Craven, present; Bill Dorsett,
present; Maxton McDowell, Alternate, present (substituting for regular member
Ray Farlow) ; Arlie Culp, Alternate, present; and Allen Holt, Alternate,
absent.
3. Chairman Stout asked for a motion to approve the minutes for the February 3,
1988 Planning Board meeting. Bill Dorsett made the motion, seconded by Guy
Troy, to approve the minutes. The motion passed.
4. SUBDIVISIONS:
A: HIGH MEADOWS SUBDIVISION (Final Plat) ; Grant Township; SR 2834 (Cox
Road) ; 19 Lots. Frank E. Snyder - Owner.
Hal Johnson explained to the Board that this subdivision would be
for site built homes, met all subdivision requirements, and was located
in an E-1 zoning district. Johnson also stated that the Planning
Department had received a letter from the Health Department confirming
that the property was suitable for septic tanks.
Maxton McDowell made the motion, seconded by Tal Harrison, to
approve the final plat of High Meadows Subdivision. The motion passed.
B: TWIN CREEK SUBDIVISION (Preliminary Plat) ; Grant Township; NC 159;
25 Lots. Donald & Martha Bristow and Glenn & Wanda King - -Owners.
Glenn King, Owner, was present at this meeting and told the Board
that site built homes would be located in this subdivision. He also
stated his intentions of writing deed restrictions that would include
prohibiting poultry houses, hog lots, etc. within the subdivision.
Guy Troy made the motion, seconded by Charles Adams, to approve the
preliminary plat for Twin Creek Subdivision. The motion passed.
C: PISGAH WOODS (Final Plat) ; Union Township; SR 1114; 18 Lots.
Herman K. McDowell and W. Reid Kearns - Owners.
Hal Johnson explained to the Board that these lots would be fronting
on an existing graveled state road, so that maintenance of the road would
be up to the State.
McDowell and Kearns was present at the meeting and told the Board this
would be a mobile home subdivision. McDowell also told the Board that
the saw mill operation would he removed from the subdivision site in
approximately 3 weeks (before any mobile homes were moved in) .
Lynden Craven made the motion, seconded by Tal Harrison, to approve
the final plat of Pisgah Woods. The motion passed.
D: DEER RUN ESTATES (Preliminary Plat) ; Franklinville Township; SR 2132;
46 Lots. Worth Heath - Owner.
Hal Johnson told the Board that this subdivision met all of the
subdivision regulations and that the lots would be approximately 1 to 2
acres in size.
Worth Heath, Owner, was present at the meeting and told the Board
that this subdivision would be for site built homes and manufactured
housing.
Tel Harrison made the motion, seconded by Bill Dorsett, to approve
the preliminary plat for Deer Run Estates. The motion passed.
At this time, following proper procedure, the Planning Board adjourned to serve
as the Randolph County Board of Adjustment.
5. VARIANCE:
A: R. Tony Hill, President, Colonial Country Club, Inc. , Thomasville,
North Carolina is requesting a Variance to construct a new clubhouse
building for Colonial Country Club, Colonial Club Drive, with a
side setback of 5' in lieu of the required 10' side setback.
Tony Hill, President of Colonial Country Club, was present at the
meeting. Hill expressed his reasoning of needing the variance as
this would save the club an estimated 25,000 - 50,000 dollars if
they could avoid tearing down the old club house until the new club
is constructed.
Aaron Allred, architect, stated that the structure would not
encroach on the State's right of way and that the closest residential
structure to the site is around 570' . The nearest point of the building
to the edge of the road would be 25' .
Chairman Stout asked if there was any one present at the meeting
to speak in opposition of this request.
Dr. Rick Jackson, resident in Colonial Country Club Estates,
expressed his concerns of the clubhouse being located this close to
a public street. He stated that this would cause traffic problems
and problems with the people that live in Colonial Country Club Estates.
Mr. Allred explained that the right of way was 60' , the road was a
20' road, and only one corner of the building would be located 35' from
the center of the road.
Charles Adams, Vice Chairman, withdrew his vote from this request
expressing his conflict by being a member of this country club. Arlie
Culp, Alternate, substituted for Mr. Adams.
Tal Harrison made the motion, seconded by Arlie Culp, to approve
this Variance. The vote was 6 to 1 with Guy Troy voting against the
motion. The motion was approved.
At this time, following proper procedure the Planning Board re-convened.
6. REZONING REQUESTS:
A: Timothy Z. Allen, Denton, North Carolina is requesting that approximately
6 acres of land located on the west side of intersection SR 1307/1308,
Concord Township, be rezoned from Residential Agricultural to Residential
Mixed/Conditional Use. Zoning Map #6689. It is the desire of the
applicant to develop the property with a 5 space mobile home park.
Hal Johnson explained to the Board that Allen had cut a road in
particially graded and ditched. Johnson also stated that the Planning
Office had not received any opposition prior to the meeting.
Allen was present at the meeting and stated that he had no intentions
of expanding the park in the future. The Board also viewed a preliminary
plat of the park showing large lot sizes and the road.
Chairman Stout asked if there was any one present at the meeting to
speak in opposition of this request and there was none.
Guy Troy made the motion, seconded by Lynden Craven, to recommend
approval of the request to the Commissioners. The motion passed.
B: Dorothy May Bass, Trinity, North Carolina, is requesting that
approximately 5i acres of land located off SR 1406, Tabernacle
Township, be rezoned from Residential Agricultural to Residential
Mixed/Conditional Use. Zoning Map #7703. It is the desire of the
applicant to develop a mobile home park on the property.
Dorothy Bass was present at the meeting and explained to the Board
that she owned 14 existing lots in Thayer Plantation Subdivision and
she wanted 7 mobile home spaces on these lots. She also stated that
she would use a private well for the water supply and individual septic
tanks for each lot. She also said that she had been maintaining the
road for 14 years and would continue to do so.
Chairman Stout asked if there was any opposition to this request.
John Floyd, Valley Road, Thomasville, expressed his concerns of
rental property/mobile home park being located in this community. He
stated that there was no rental property in the area at this time. He
also that he owned approximately 200 acres adjacent to this site and
had planned to develop his property in the future with site built
residential structures. Floyd stated that there was all ready an existing

problem with trash along the road side and this would only create
a larger problem for the area residents. Floyd also said he had
a petition signed by area residents that he would present to the
Commissioners on April 11 .
Ann Bostic, neighboring property owner, stated that the State
Highway Department was planning to take over this road and that she
had not heard anything about a petition from the neighbors.
Chairman Stout stated that the Planning Board would not be able
to consider the petition in making their decision because the petition
was not present to the Board, but that the Commissioners would consider
the petition If it was present to them.
Tal Harrison made the motion, seconded by Charles Adams, to
recommend to the Commissioners this request be approved. The motion
passed.
C: Charles & Geneva Cannell, Staley, North Carolina, is requesting that
approximately } acre of land located on SR 2469 approximately 1} miles
from Staley Town limits, Columbia Township, be rezoned from Residential
Agricultural to Highway Commercial/Conditional Use. Zoning Map #8733.
It is the desire of the applicant to locate general construction
materials (casing pipe, etc.) and trucks related to business.
Charles Cannell was present at the meeting and explained to the
Board that he will leave the trees at the road for a buffer, and
told the Board what would be stored on the property: a 40' trailer,
2 pickup trucks, 2 ten wheeler trucks, and casing pipe. He stated
that he was going to have to move his business in Greensboro and that
he would only be in business for a couple of more years before his
retirement so he decided to locate the business near home. Cannell
also stated that he would be willing to put a fence or gate in front
of the property.
Tal Harrison asked Mr. Cannell how much pipe would be stored on
the property at one time and Cannell stated that only around 20 pieces
would be.
Hal Johnson told the Board that he had received several complaints
from area residents (Melvin Collins, Dean Cox, and Jimmy Langley) that
were opposed to this request.
Bill Dorsett expressed to the Board that the zoning ordinance
requires that commercial outdoor storage to be enclosed by a fence not
less than 8' in height which completely screens from view the stored
materials.
No opposition was present at the meeting.
Charles Adams made the motion to recommend the request be approved
with the restriction of maintaining the trees on the property and a
50' setback. Lynden Craven seconded this motion and the motion passed
with a 5 to 2 vote. Bill Dorsett and Guy Troy voted against the motion
because the motion did not include completely enclosed screening.
D: James Hayden, Asheboro, North Carolina, is requesting that approximately
2 acres of land located in Caraway Acres Subdivision, lots 3-5, on SR
1332, Concord Township, be rezoned from Residential Agricultural to
Light Industrial/Conditional Use. Zoning Map #7710. It is the desire of
the applicant to construct a 20' x 40' building and use the property
for the operation of automotive salvage and repair business.
James Hayden was present at the meeting and told the Board that
a few of his cars had been existing on the property.
Bill Dorsett expressed to the Board that the zoning ordinance
requires new junkyards to have a minimum lot size of 3 acres.
James Hayden withdrew his request.
E: Don Hicks, Trinity, North Carolina, is requesting that approximatley
10 acres of land located on SR 2502, Liberty Township, be rezoned from
Residential Mixed to Light Industrial/Conditional Use. Zoning Map #8707.
It is the desire of the applicant to construct a building for a Auto
repair and salvage yard. (Clyde Pierce - Property Owner.)
Don Hicks was present at the meeting and explained that he wanted
a 30' x 50' building, would be storing older cars, would not stack cars,
and if he could afford it he would put up a fence, but it would be kept
neat and clean. Hicks stated that maximum number of cars on the property
would be 400 and the crushing process would be done with a portable
mini crusher. Hicks also stated that he would not use the back section
of the property for vehicle storage.

Gene Pierce, Route 1, Liberty, expressed his opinion that this
community had enough eye sores to deal with on this road.
Harry Levinson, Owner of Carolina Mobile Home Park (adjacent
property) , stated his concerns that he may have to shut down his park
because he fears that the run off of the junkyard will contaminate
the park's well (which is only 150' away from the proposed junkyard
_,. site) . Levinson also stated his concerns of the junked vehicles being
so close to his mobile homes.
Jack Smith told the Board that most of land in the area was
residential and that there are no commercial business in the area.
Smith expressed his opinion to the Board that if Mr. Hicks was from
Trinity Township for him to do his "junk" business there. Smith
also expressed to the Board that he had been a member of the Greensboro
Planning Board and that we should be having these meetings at night
because these meetings were inconvenant to anyone other than retires,
County employees, and very few business people.
Bill Dorsett expressed to the Board that the zoning ordinance
requires junkyards to be completely screen with a durable wall or
fence at least 8 feet high wich screens from view the stored items.
Guy Troy expressed his opinion that a junkyard a this location would
an unsightly mess that would be visable from US 421.
James Smith, adjoining property owner, stated that some residents in
this area were all ready dealing with water problems and this would only
create more water problems for adjoining residents.
James King, attend the meeting to speak for a neighbor property
owner, Buddy Mabe, that feels the community all ready has to many eye
sores on the road to deal with. He also stated that he had stock on
the stream that ran at the bottom of this property and he feared problems
would be created from the run off of this junkyard.
Jenny Collins, property owner across the road, stated that she
strongly opposed this junkyard because it would become an eye sore in
the community.
Don Hicks stated that he did not realize that there was this much
opposition to his request but that he did not plan to have a "junkyard"
he planned for a neat salvage yard.
Guy Troy made the motion, seconded by Bill Dorsett, that the Board.
recommend to the Commissioners this request be denied. The motion passed.
7. MISCELLANEOUS:
A: The Board discussed interpreting more specifically what type of fencing
should be around junkyards.
B: The Board discussed change the meeting time from day to night and decided
to make a decision at the next regularly scheduled meeting.
