1775 MINUTES
RANDOLPH COUNTY PLANNING BOARD
December 6, 1988
There was a meeting of the Randolph County Planning
Board on Tuesday, December 6, 1988, at 7 :00 p.m. , in Court-
room B, Randolph County Courthouse, 145 Worth Street, Ashe-
boro, North Carolina.
1 . Doyle Stout, Chairman, called the Randolph County
Planning Board meeting to Order at 7 :00 p.m.
2 . Hal Johnson, Planning Director, called roll of the
members: Doyle Stout, Chairman, present; Lynden
Craven, Vice Chairman, present; Charles Adams,
present; Ray Farlow, present; Guy Troy, present;
Bill Dorsett, present; Maxton McDowell, Alternate,
present (substituting for resigned member Tal
Harrison) ; and Arlie Culp, Alternate, absent .
3 . Chairman Stout asked for a motion to approve the
minutes from the November 8, 1988 Planning Board
meeting. Ray Farlow made the motion, seconded by
Lynden Craven, to approve the Minutes of the
Planning Board meeting of November 8th. The motion
passed.
4 . ESUkDIVISION
A: WOODRIDGE ESTATES (Final Plat) ; Richland
Township; SR 2605. 24 Lots. Walter Lee
Roberts - Owner .
Lynden Craven made the motion, seconded by Ray
Farlow, to approve the final of Woodridge
Estates . The motion passed.
5 . VARIANCE :
A: Judy Scarlett, High Point, North Carolina, is
requesting a Variance to construct a house
with the side setback of 9 ft . in lieu of the
required 10 . ft setback (of the County
Zoning/Subdivision Ordinance) .
Judy Scarlett was present at the hearing and
explained that construction had all ready
began on the house and the side setback of 9
ft . was not intentional. Scarlett stated that
she did not realize until after the foundation
had been constructed that the house was not
sitting 10 ft . of the property line.
Brett Robbins, adjoining property owner ,
stated that he did not feel the side setback
requirement (not being met) was intentional,
but he felt the property owner should have to
construct a fence to protect his property
because his garage opens to the side and the
fence would provide a divider between the
homes.
Bill Dorsett, Board member, stated that he
felt because of the narrow frontage of the

lots that this may become a forced problem (of
meeting the side setback requirement) and not
an intended mistake if the houses were built
in line with each other .
Ray Farlow, Board member, stated that the lots
increased by width further into the lot and
the houses could be built back off the road
and meet the required setbacks .
Bill Dorsett stated that granting this
Variance would not be setting a precedence for
this subdivision. Dorsett made the motion,
seconded by Lynden Craven, to grant this
Variance. The motion passed unanimously.
6. REZOuING REQUESTS
A: Donald Lanier , Asheboro, North Carolina, is
requesting that approximately 1 acre located
at the intersection of SR 1001/SR 1312,
Concord Township, be rezoned from Residential
Agricultural to Highway Commercial. Zoning
Map #7609 . It is the desire of the applicant
to use the property for commercial develop-
ment .
Hal Johnson, Planning Director , stated that
Mr . Lanier had asked him (since the request
had been filed) if it would be possible for
the request to be changed to Conditional Use
rezoning . Donald Lanier was present at the
hearing and stated that he would like the
request be be for Highway Commercial/Condi-
tional Use for a convenience store. Johnson
asked Lanier if he was aware that if he
requested this condition, a convenience store
would be the only type of development allowed
on this property. Lanier stated that he
understood he would be restricted to only a
convenience store.
There was no one present at the hearing in
opposition to this request .
Lynden Craven made the motion, seconded by
Maxton McDowell, to recommend approval for the
Conditional Use rezoning. The motion passed
unanimously.
B: Jon L. Hoglen, Franklinville, North Carolina,
is requesting that approximately 48 acres
located at the dead end of SR 2514 , Providence
Township, be rezoned from Residential Agricul-
tural/Residential Restricted to Residential
Mixed/Conditional Use. Zoning Map #7795. It
is the desire of the applicant to develop and
operate a 30 space mobile home park on this
property.
Jon Hoglen was present at the hearing and
showed the Board a general outline of his
plans for the property. Hoglen stated that he
wants a clean park with all new mobile homes
because he lives on the property. Hoglen
stated that in the general area there were 2
mobile homes on his property and approximately
4 site built homes on this narrow dirt road.
Hoglen stated that this property was
surrounded with wooded and farm land and there
is not much housing in the area. Hoglen
showed the Board an aerial photo on this area
and said that he realized this property had
marsh land and a creek and these areas would
not perk . Hoglen stated that he would

purchase and post no trespassing signs on the
adjoining land owners property.
Chairman Stout asked if there was anyone
present to speak in opposition of this
request .
Sylvan Routh, adjoining land owner , stated
that Grays Chapel School was at 100% capacity
now and that he felt this may set a precedence
for this area if a mobile home park was
developed here. Routh also expressed concerns
of the drainage basin to Ramseur Watershed.
Alvin Ward, adjoining land owner and business
owner in the Grays Chapel Community, stated
this is a very tight knit community with a lot
of fine homes . Ward stated there is only one
subdivision in the immediate area with lot
sizes not smaller than 5 acres and there area
not any mobile home parks. Ward also stated
that he was a business owner in Grays Chapel
and stood to gain as much as anyone in this
community from this park and he was opposed to
it.
Annie White (lives across the road from this
property) stated her opposition to the added
traffic to this dead end dirt road. White
stated there was a lot of traffic and dust on
this road and that the neighbors in the area
are all having trouble with the well water
supplies (not being adequate) .
Chairman Stout asked for a show of hands of
the citizens present in opposition to this
request and approximately 60 persons raised
their hands .
Junius Routh, adjoining land owner, told the
Board that the neighbors loved John and didn' t
want to hurt John but they don 't want John to
hurt them either .
Guy Troy stated that he did not feel a mobile
home park would be in keeping with the land
development plan for this low density area.
With that statement Troy made the motion to
recommend this request be denied. Charles
Adams seconded the motion and the motion to
recommend this request be denied passed
unanimously.
C: Kermit Morgan, Trinity, North Carolina, is
requesting that approximately 6 acres located
on SR 1534 1/2 mile west of Marlboro Church
Road, New Market Township, be rezoned from
Residential Agricultural to Residential Mixed/
Conditional Use. It is the desire of the
applicant to develop a manufactured home park
of 25 spaces with central water and sewer .
Kermit Morgan was present at the hearing and
told the Board that his property was approxi-
mately 6 acres (approximately 200 ' x 1000 ' )
and adjoined Countryside Mobile Home Park on
one side and a junkyard on the other . Morgan
stated that he plan for 25 mobile homes with
water from Davidson Water Company and sewer to
the treatment plant in Countryside Mobile Home
Park. Morgan stated the access road would be
42 ft . wide with 21 ft. on his property and
the other on the property of the junkyard.
Morgan stated that he would maintain the
entire road. -

There were 4 people present in opposition to
this request _ One gentleman (adjoining land
owner) stated his concerns of the added
traffic to Roy Farlow Road and his concerns of
the crime rate increasing in this area because
of the added mobile home park .
Betty Tutterow, Route 1, Sophia, (adjoining
property owner) stated her concerns of the
treatment plant and the odors the neighbors
have to deal with (at this time) in the Summer
months. Tutterow stated that this had been
reported to the local Health Department and
nothing has been done. Hal Johnson, Planning
Director, explained that these treatment
plants were permit by the State (not the local
Health Department) and she would need to
contact the State with her concerns.
Bill Dorsett, Board member , stated that he was
not speaking against Ms. Tutterow, but that if
the Health Department approved this system
(for the additional hook-ups) the Board would
need to go by this approval.
Kermit Morgan stated that the adjoining mobile
home park was owned by Walt Daniels with
approximately 65 spaces and that the system
had been approved for 100 mobile homes.
Guy Troy made the motion, seconded by Lynden
Craven, to recommend this request be denied
because of the increased density to the area .
The motion passed unanimously.
D: Atlantic Timber Company, Hickory, North
Carolina, is requesting that approximately 90
acres located on SR 1121 across from the
intersection of SR 1121/SR 1133, Union Town-
ship, be rezoned from Residential Agricultural
to Residential Mixed. Zoning Map #7656 . It
is the desire of the applicant to develop a
residential mixed subdivision (both site built
or manufactured housing) of 20 lots. (William
Marlin Presnell & Others -Owners.)
Mike Cusimano, representative for Atlantic
Timber Company, was present and explained that
all the lots off the main road would 5+ acres
and the lots fronting on the main road would
be 2+ acres in size. Cusimano stated that the
Health Department expressed signs of perking
problems in the upper left hand corner of the
tract and if further study proved this area
would not perk it would be sold to an adjoin-
ing property owner for agricultural purposes.
Approximately 25 people were present at the
hearing in opposition to this request .
Everette Brim, adjoining land owner, presented
the Board with a petition of 146 signatures
opposed to this request, because these people
did not feel this type of housing would be
compatible to the area. Brim stated this was
a family farming community and that the
community all ready has a park on Hwy. 134
that is an eyesore. Brim added that the only
people that would benefit would be the out of
town developer _ Brim also expressed his
concerns of what this development would do to
the value of adjoining property.
Cusimano explained that his company shares

some of these concerns and that the company
decided on this mixed type of housing because
this is the general type housing in the area
and it seemed to be in harmony with the
community. Cusimano stated that he felt sure
that his company would require permanent
foundations under any type of home and would
control the quality of housing in this subdi-
vision.
Jerry Gillispie (lives in front of property)
stated that he purchased his property that was
grown up with weeds, etc. and cleaned it up
and remodeled it. Gillispie stated that he
would like to see nice homes built on this
property and would not like to see the County
down grade it ' s zoning classification.
Gillispie stated he felt the present zoning
classification should remain.
Bruce King, adjoining land owner, stated that
he felt the new residences would be opposed to
this farming community and its odors and would
hinder the farming community from expanding.
Jay Gooden, Asheboro, stated that this area
had a shallow water table and could not
support the added septic tanks and he wanted
this to remain a healthy environment .
Frank Lamb, adjoining land owner, stated that
he was in the mobile home business and was not
opposed to mobile homes, but felt these 20
homes sites would be opposed to his farm of
60,000 chickens .
Phyllis Hildred, area resident, stated that
where this access would be located would be in
a terrible blind spot on the main road and she
expressed her concerns of the safety of school
buses on the road.
Willie Gillispie (lives in front of Church)
stated that he had lived here for 36 years and
that the community was crime free and would
like to see the community remain the same.
Guy Troy made the motion to deny rezoning the
property to Mixed Residential, however to
recommend the property be rezoned Residential
Restricted so as to allow only site built
homes or Class A Double Wide Manufactured
Housing with permanent foundations. Troy
stated that based on the concerns expressed by
area citizens, this Zoning classification
would be more compatible with the surrounding
community for major residential subdivision
development. Lynden Craven seconded the
motion and the motion passed with a split vote
of 4/2 with Ray Farlow and Charles Adams
voting against the motion.
E: James R. Voncannon, Asheboro, North Carolina,
is requesting that approximately 3 1/3 acres
located on 220S between SR 2848/East Edgewood
Street, Richland Township, be rezoned from
Residential Agricultural to Highway Commer-
cial . Zoning Map #7665. It is the desire of
the applicant to sell the property for commer-
cial development.
James Voncannon was present at the hearing and
�-- stated that a store building has been located
on the property for years.

There was no one present in opposition to this
request .
Ray Farlow made the motion, seconded by Guy
Troy, to recommend this request be approved as
being in keeping with the general area . The
motion passed unanimously.
F: Hazel Ann Ferguson, Asheboro, North Carolina,
is requesting that approximately 6 acres
located off Highway 220S, on SR 2843, be
rezoned from Residential Restricted To Resi-
dential to Residential Agricultural/Condi-
tional Use. Zoning Map #7667 . It is the
desire of the applicant to construct a build-
ing (24' x 30 ' ) to operate a beauty shop.
Ferguson was present at the hearing and stated
that the Health Department had all ready
approved the site for a septic tank and that
she could have put the business in her base-
ment, but preferred the business in a separate
building .
There was no one present in opposition to the
request .
Guy Troy made the motion, seconded by Charles
Adams, to recommend this request be approved.
The motion passed unanimously.
G: Joe Glenn Talbert , Thomasville, North Caro-
lina, is requesting that approximately 2 1/2
acres located on Old I-85 at the Guilford
County Line, Trinity Township, be rezoned from
Residential Agricultural to Light Industrial/
Conditional Use. Zoning Map #6799 . It is the
desire of the applicant to construct a build-
ing (100 ' x 200 ' ) for the purpose of wholesale
sales and warehouse storage of heating and air
�.., conditioning supplies.
Joe Talbert was present at the meeting and
stated that he did not realize this property
was not zoned for his intentions (industrial) ,
because the property adjoins commercial
activity and I-85. Talbert stated that part
of this tract was in Guilford County and this
part was zoned industrial in Guilford County.
There was no one present in opposition to this
request .
Lynden Craven made the motion, seconded by Ray
Farlow, to recommend this request be approved
as being consistent with the land development
plan. The motion passed unanimously.
