RANDOLPH COUNTY PLANNING BOARD
January 10 , 1989
There was a meeting of the Randolph County Planning
Board on Tuesday, January 10 , 1989 , at 7 : 00 p.m. , in Court-
room B, Randolph County Courthouse, 145 Worth Street, Ashe-
boro, North Carolina.
1 . Doyle Stout, Chairman, called the Randolph County
Planning Board meeting to Order at 7 :00 p.m.
2. Hal Johnson, Planning Director , called roll of the
members: Doyle Stout, Chairman, present; Lynden
Craven, Vice Chairman, present; Ray Farlow,
present; Guy Troy, present; Charles Adams, present;
Bill Dorsett, present; Maxton McDowell, Alternate,
present (substituting for resigned member Tal
Harrison) ; and Arlie CulP•L Alternate, absent .
3 . Ray Farlow made the motion to approved the Minutes
of the Randolph County Planning Board meeting,
December 6, 1988 and the Minutes of a Community
Meeting of the Planning. Board, January 5, 1989 .
Lynden Craven seconded this motion and the motion
passed.
4. SUBDIVISIONS
The Planning Board reviewed the following Final
Subdivision Plats:
A: RIVERVIEW ESTATES (Final Plat) ; Trinity
Township; SR 1554 . 4 Lots. Dwight Meredith -
Developer .
B: J. LAND ESTATES (Final Plat) ; Columbia Town-
• ship; SR 2458. 8 Lots. J. Hampton Pike -
Owner .
C: COUNTRY ACRES ESTATES (Final Plat) ; Back Creek
Township; SR 1511 . 3 Lots. Craven, Craven, &
McDuffie - Developers.
D: TOOMES WOODS, Section 2 (Final Plat) ; Level
Cross Township; SR 2101. 22 Lots. Worth
Heath - Owner .
Hal Johnson, Planning Director , explained to the
Board that the preliminary plats for these subdivi-
sions have been reviewed and approved.
Ray Farlow made the motion, seconded by Charles
Adams, to approved the final residential subdivi-
sion plats. The motion passed unanimously.
7 . SPECIAL- USE P„EPM T REQUEST
A: Tommy Garner , Seagrove, North Carolina,

requested a Special Use Permit for a Rural
Family Occupation to operate a beauty shop in
a building approximately 14 ' x 24' near the
residence on approximately 78 acres located on
the east side of SR 2875 just before SR 1002,
Brower Township, Residential Agricultural

Zoning District, Zoning Map #8625 .
Tommy Garner was present at the hearing and
asked the Board if this Special Use would
change the Agricultural Zoning of the land.
Garner was answered that it would not.
Hal Johnson explained to Garner that if this
Special Use was granted that the building
could only be used for a beauty shop and would
not allow a change of use in the future (such
as an automotive repair shop, etc. ) .
Lynden Craven made the motion, seconded by Guy
Troy, to approved this request for a Special
Use Permit. The motion passed unanimously.
6 . REZONING REQUESTS
A: Iris R. Ellington, Thomasville, North Caro-
l _na, is requesting that approximately 30 1/2
acres located on the east side of SR 1404 near
the intersection of SR 1404/SR 1400,. Taber-
nacle Township, be rezoned from Residential
Agricultural to Residential Mixed. Zoning Map
#6793 . It is the desire of the applicant to
develop a 14 lot mobile home subdivision.
Iris Ellington was not present at this hearing
but her realtor , Chrystle Deweese, was present
to represent her . Deweese presented the Board
with a preliminary set of restrictions for the
proposed subdivision.
Hal Johnson told the Board that this site was
located in the City of Asheboro' s watershed.
Johnson asked Deweese if the County Health
Department had been on the property for soil
evaluations . Deweese stated that the Health
Department had not been on the property.
Deweese explained that there is a mobile home
park in front of the property, vacant land to
the side of the property, and basically a low
density area of the County. Deweese stated
that the remainder of the property (not shown
on the preliminary plat) would be used for a
horse pasture.
Approximately 30 people were present at the
hearing in opposition to this request.
Worth Younts, property owner of the corner of
Highway 64/SR 1404 (approximately 2 miles of
the proposed site) , showed the Board a map of
the general area. Request for mobile home
developments (that had been deny) , this
request site, Little Uwharrie River, and
Uwharrie River , was highlighted on the map.
Younts expressed his concerns of the dangerous
effect this request (approval) could have on
Asheboro' s water supply (because of the close
proximity of Little Uwharrie River) . Younts
explained his concerns of the need for added
law enforcement and educational facilities in
the area. Younts added that this area was
primarily a rural agricultural community of
low density.
Pam Thayer , resident of SR 1404 and member of
Northwest Randolph Property Owners Associa-
tion, presented a petition with 95 signatures
of residents in the area opposed to this

request. Thayer explained that this petition
was only circulated for signatures approxi-
mately 3 days . Thayer expressed her concerns

of the added traffic (on the dirt end of SR
1404) and road condition problems with 30
additional cars using the road.
Wayne Fuller , Winston-Salem, (owns property
adjoining the proposed site) , showed the Board
a map of how his property adjoins the proposed
subdivision site. Fuller explained to the
Board that his main concerns was the run-off
and pollution being dumped (by natural
drainage flow of the land) in to Asheboro
City' s water supply. Fuller added his
concerns of damaged property values, density
problems, and the damage to the rich heritage
of the Fuller Mill Community this request
would cause.
Linda Swafford, adjoining property owner and
member of the Northwest Property Owners
Association, told the Board that she felt
privileged to speak before this Board, because
the Northwest Property Owners Association
fault for Zoning in this County to promote
orderly growth and to enjoy the way of living
this community chose. Swafford expressed her
concerns of the County roads (not equiped to
handle large amounts of traffic) , added
density, school system, and the damage this
would do to the history/tradition of this
community. Swafford added that she felt the
concerns of these 95 current residents of this
area should out way the request of the 14 new
residential sites.
Vincent Bridges, member of Friends of the
Little Uwharrie, expressed his concerns of
this type of development being proposed
approximately 1000 ft. from the designated 100
year flood plain, and the type of run-off into
this Class A drinking water stream.
Guy Troy stated that this area did not seem to
be environmental sound, not only land use but
also water supply, and for this reason Troy
recommended this request be denied. Maxton
McDowell seconded this motion and the motion
passed unanimously.
B: Allen Bullard, Asheboro, North Carolina, is
requesting that approximately 120 acres
located on SR 1504 (Spero Road) , approximately
2 miles from Highway 220 By Pass, Back Creek
Township, be rezoned from Residential Agricul-
tural to Residential Restricted. Zoning Map
##7743 . It is the desire of the applicant to
develop a 76 lot residential subdivision.
Allen Bullard was not present at the hearing
but Barbara Coltrane, real estate agent,
represented Bullard.
Hal Johnson told the Board that the restric-
tions the Planning Department had received for
this subdivision were very strict and only
site built houses would be developed. Johnson
also stated that this request was in keeping
with the character of the area.
One gentleman from the audience said that he
wasn' t opposed to the request, he attended the
hearing to see what type of housing would be
allowed in the development. Johnson stated
that only stick built homes would be allowed.

Ray Farlow explained that the requested zoning
(Residential Restricted) was the most

restricted zoning in the County.
Farlow made the motion, seconded by Lynden
Craven, to recommend to the Commissioners this
request be approved. The motion passed
unanimously.
C: Donald Lanier , Asheboro, North Carolina, is
requesting that approximately 70 acres located
approximately 1 mile off Highway 705 fronting
on the north side of SR 2862, Richland Town-
ship, be rezoned from Residential Agricultural
to Residential Restricted. Zoning Map #7684.
It is the desire of the applicant to develop a
residential subdivision (site built) of 11
lots.
Donald Lanier was present at the hearing and
explained his intentions of developing a site
built subdivision (all lots fronting on state
maintained road) with a minimum lot size of
approximately 2 1/2 acres.
There was no one present at the hearing in
opposition to this request.
Ray Farlow made the motion, seconded by
Charles Adams, to recommend to the Commis-
sioners this request be approved. The motion
passed unanimously.
D: Lissie R. Phillips, Archdale, North Carolina,
is requesting that approximately 6 acres
located on SR 1616 approximately 1 1/2 miles
on the left from Business 85, Trinity Town-
ship, be rezoned from Residential Restricted
to Residential Mixed/Conditional Use. Zoning
Map #6798. It is the desire of the applicant
to develop 2 additional spaces for a total of
a 5 space mobile home park .
Lissie Phillips was not present at the meet-
ing, but was represented by her grandson, Jeff
Jennings. Jennings described the area as
being a mixed type of developmentwith indus-
trial, manufactured housing, and site built.
Jennings stated that the spaces (applying for)
would be located in the rear of the tract and
that Phil Pearman, Sanitarian with the County
Health Department, had approved a soil evalua-
tion of one of the spaces. Jennings stated
that the 3 existing spaces have been there
since prior to 1979 and there were plans to
build a new road for all 5 spaces with a 60
ft . right of way.
Randle Brown, adjoining property owner , stated
that every resident living on the road was
against additional expansion of this park .
Brown told the Board that this road had mainly
site built residents ranging from 60-100 ,000
dollars in value. Brown added that the 3
existing mobile homes were not being well
cared for .
There were seven people present at the hearing
in opposition to this request.
Meredith Helsby, resident of SR 1616 (2 houses
up from this property) , stated that this area
(Mendenhall Road) was designated (by the High
Point Enterprise) as "no man' s land" because
of run down property clutter with debris, etc.
and that it was his opinion that the Commis-
sioners established Zoning regulations to help

to clean up this area of the County.
Christine Helsby, resident of SR 1616, stated
that her and her husband lived in the Orient
for 40 years with wall to wall people and
their intent in purchasing property and
retiring in this area was because of the quiet
residential character of the area.
Jeff Jennings (representive for applicant)
told the Board that his grandmother had lived
in this area for the past 40 years and she
depended on the park for income.
An elderly lady in the audience told the Board
that the park residents fight and come over to
her property when she is not at home. She
added that she was frightened for more mobile
homes to be added to the park.
Mrs. Gray, resident of SR 1616, stated that
she felt since the Phillips were no longer
residents of SR 1616 and did not occupy the
property, they should not be allowed to expand
the park.
Ray Farlow, Board member, stated that he was
aware that the County had worked hard in
assessing what areas of the County should be
zoned Residential Restricted and as of now he
has not seen any of these areas that needed
down zoning. Farlow added that he did not see
that retaining the property as Residential
Restricted that it would cause any kind of
hardship on the Phillips and for these reasons
Farlow made the motion to recommend to the
Commissioners the request be denied. Bill
Dorsett seconded this motion, and the motion
passed unanimously.
`,. E: Henry Beane, Randleman, North Carolina, is
requesting that approximately 9 1/2 acres
located off Southmont Drive - cross over 220
By-Pass - first right on Twelve-Tree Road at
the dead end, Cedar Grove Township, be rezoned
from Residential Agricultural to Residential
Mixed/Conditional Use. Zoning Map #7659 . It
is the desire of the applicant to develop a 12
space mobile home park .
Henry Beane was present at the hearing and
stated that he had owned the property (was
raised there) for approximately 60 years and
that only one mobile home was on the property
at this time (his foster son ' s home) . Beane
stated that this property was surrounding by
mobile homes and that he planned to keep the
trees on the back portion of the property for
a buffer zone. Beane added that his son would
manage the park .
Jim Neely, represented Thayer , Thayer, and
Neely property, stated that their adjoining
property was subdivision (platted and recorded
in 1946) for site built residences. Neely
stated that this property buffered his pro-
perty from all the existing mobile home parks.
Steve Campbell, adjoining mobile home park
owner, stated that Beane only had a 25 '
easement to his property. Campbell explained
that Beane would have to cross through
Campbell' s Mobile Home Park approximately 300
ft. to get to his property. Campbell stated
that this easement would not be adequate for

this type of development.
Ray Farlow expressed his concerns of how
accessable this property is (because of the
25 ' easement) .
Bill Dorsett made the motion, seconded by Guy
Troy, to recommend to the Commissioners this
request be denied. The motion passed
unanimously.
F: Rebecca Ruth Morris, Franklinville, North
Carolina, is requesting that approximately 1
1/2 acres located on the northwest corner of
the intersection of SR 2138/SR 2128, Franklin-
ville Township, be rezoned from Residential
Restricted to Highway Commercial/Conditional
Use. Zoning Map #7774. It is the desire of
the applicant to construct a building (approx-
imately 30 ' x 60 ' ) to operate a convenience
store.
Bobby and Rebecca Ruth Morris were present at
the hearing. Bobby Morris stated that his
residence is located in back of this proposed
site. Morris added that he had not decided if
gas pumps would be located on this site
because of the expense of the required
insurance for the pumps.
Edwin Julian, Route 1, Franklinville (adjoin-
ing property owner) , stated that he was
speaking for 34 residents of the Millboro
Community that signed a petition in opposition
to this request (that was turned in to the
Planning Department) . Julian read this letter
for the record (letter/petition attached to
these minutes) . Julian expressed his concerns
of the dangerous 90 degree curve in front of
this site. Julian added that the residents of
Millboro would like to see this area remain
rural residential agricultural zoned.
Ruth Morris stated that the curve had been
considered and no entrance would be on SR
2128. Bobby Morris stated that this property
was adjoined (in the rear) by a mobile home
park .
Approximately 20 people were present at the
hearing in opposition to this request.
Guy Troy stated that this area was a very
rural residential countryside area.
Guy Troy made the motion, seconded by Charles
Adams, to recommend to the Commissioners this
request be denied. The motion passed
unanimously.
At 8: 10 p.m. (after hearing this request) Maxton McDowell
excussed himself from the meeting.
G: Henry L. Delk, Sr. , Denton, North Carolina, is
requesting that approximately 9 1/2 acres
located on the southwest corner of inter-
section Highway 64/SR 1326, Cedar Grove
Township, be rezoned from Residential Agricul-
tural to Light Industrial. Zoning Map #7731.
It is the desire of the applicant to use the
property for industrial development.
Henry L. Delk, Sr. , was not present at the
hearing, but was represented by his son, David
Delk.

Delk stated that there was presently a cabinet
shop on the property (on approximately 1 acre
of the property) . Delk stated that the
proposed development was one building for
light manufacturing and another building for
the storage of construction equipment, etc.
David Lambeth, adjoining property owner ,
stated that he had lived beside the property
for 5 years (in a white house) and the day
after Christmas he moved into a new house he
built (that adjoins this property) . Lambeth
showed pictures to the Board of his property
and the property owned by Henry Delk . These
pictures were used to explained to the Board
all the dumping (of trash) problems that have
occurred in this area since the construction
of the cabinet shop.
Hal Johnson explained to Lambeth that he would
need to contact the Health Department concern-
ing these dumping problems. Rebecca Lambeth
stated that she was employed with the Health
Department and had made numerous attempts to
ask the Environmental Health Section to help
with this problem and had received no help.
Johnson told the Lambeth' s that this problem
would be turned over (from the Board) to the
Health Department to be looked in to.
Rebecca Lambeth expressed her concerns of the
noise problems they were already experiencing
from the cabinet shop (at odd times of day/
night) and also that the people from the
cabinet shop had set up targets and were
shooting guns out on this property. Lambeth
also added her concerns of the added traffic
to this area .
Ray Farlow stated that there were areas all
over the County were residential and business
districts met and that he felt this was a good
time to establish a type of buffer for this
property. Farlow stated that the County had a
capable Planning Staff that could visit the
property and decide (for the Planning Board to
recommend) what would be considered an ade-
quate and appropriate buffer zone.
Bill Dorsett made the motion to recommend to
the Commissioners this request be approved
with appropriate and adequate buffer zones.
Lynden Craven seconded this motion and the
motion passed unanimously.
H: Jack Oldham, Trinity, North Carolina, is
requesting that approximately 3 1/2 acres
located at the dead end of SR 1760, Trinity
Township, be rezoned from Residential Agricul-
tural to Light Industrial/Conditional Use
Zoning Map #7705. It is the desire of the
applicant to use an existing building of 2500
sq. ft. to fabricate foam rubber (making
sponges and bonding poly) .
Jack Oldham was present at the hearing and
explained to the Board that he was trying to
start a small (family) business of bonding
poly. Oldham stated that this existing
building had been used in the past for a music
hall.

There was no one present at the hearing in
opposition to this request.

Hal Johnson told Oldham that he would need to
comply with the State Building Codes (concern-
ing the building) and Health Department
regulations (concerning the septic tank
system) for this property to be used for this
business .
Lynden Craven made the motion, seconded by Guy
Troy, to recommend to the Commissioners this
request be approved. The motion passed
unanimously.

Dear Board Members:
We the undersigned, as members of the community known as Miliboro,
would like to express our concern over the proposed rezoning request for
1i acres of land at the intersection of SR 2138/SR 2128 from residential
to highway commercial conditional use.
The property in question lies in the heart of our community. The
residential restricted agricultural zoning which we now enjoy suits the
character and wishes of the majority of our resident property owners. While
we bear no enmity toward Rebecca Ruth Morris personally, we are adamantly
opposed to any change in the current residential restricted zoning which
would allow commercial use of this particular property. We feel that there
are important questions which are at the present unanswered such as, adverse
environmental impact on surrounding properties due to unknown future use of
this property and undesirable social changes in the community.
Considering the history of previous attempts to operate stores along
SR 2128 and SR 2138, we feel that this venture may not be long lived.
: Consequently, we fear the next use or tenants of this property will attempt
operations even less desirable for our community. We would like to protect
our residential neighborhood, our property and our tranquillity.
