03MarchBOA - P.'iINUTES RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT March 7 , 1989 There was a meeting of the Randolph County Zoning Board of Adjustment on Tuesday, March 7 , 1989 , at 7 : 00 p.m. , in Courtroom B, Randolph County Courthouse, 145 Worth Street, Asheboro, North Carolina . 1 . Vice Chairman Lvnden Craven called to Order the Randolph County zoning Board of Adjustment meeting at 7 :00 p.m. 2 . Hal Johnson, Planning Director , called roll of the members: Lynden Craven, Vice Chairman, present; Charles Adams, present; Ray Farlow, present; Guy Troy, present; Bill Dorsett, present; and Aweilda Little, present. 3 . Lynden Craven announced that the request (for a Variance from the County Unified Development Ordinance) of Randy W. Lynch, off SR 2417 , Liberty Township, would be postponed until the next regular Planning Board meeting, because Lynch has not gotten all the information the Board asked for concerning his easement . 4 . Vice Chairman Craven stated that the next request • (for a Variance from the County Unified Development Ordinance) was J. Wilson Hunt, developer and the applicant ' s agent, Paul Bollinger . Hal Johnson, Planning Director, gave a brief review of the case of the Variance for the proposed development of Asheton Woods Subdivision, Phases II and III (approximately 50 acres) located on SR 1404 • (Fuller Mill Road) in Tabernacle Township. Johnson stated that this case is an appeal from the inter- pretation of the County Director of Planning and Zoning relative to current County Zoning Regula- tions that require single wide manufactured housing subdivisions to be located in the appropriate zoning district. Johnson stated that the Board heard pro and con aqruments concerning this case at the Board of Adjustment meeting, February 14 , 1989 . In September 1983 the Board of Commissioners passed new Zoning regulations that required a major "subdivision to be located in the proper zoning district for type of development . The two zoning districts designated for major residential subdi- vision development were Mixed Residential (MR) and Restricted Residential (RR) . The MR zoning district allows development of site built homes , single wide mobile homes, and double wide mobile homes . The RR zoning district allows development of site built homes and Class A double wide manu- factured homes on permanent foundations. The original plat of Asheton Woods , Section 1 (preli minary) was submitted in July 1987 and did not show specific additional development such as individual lot surveys and road design, although it did reflect future development. Johnson opened the meeting for discussion of the Board. Guy Troy, Board member , stated that after studying March 7 , 1989 Page 1 the testimony (given at the previous meeting) , he did not feel that there had been any financial loss of the developer and that he felt the decision of the Planning Board should be upheld, for these reasons he would make the motion to deny this request for a Variance- s., Ray Farlow, Board member , stated that the Board looked long and hard about the impact Section 1 would have on this community before it was approved. Farlow added that he felt this property would be more enhanced to develop in large tracts. Bill Dorsett, Board member, expressed his concerns of the density of this area. Dorsett added that the Board didn' t give the developer any reason to believe that Sections 2 & 3 would be approved. Charles Adams, Board member , seconded Guy Troy' s motion (to deny the request) . The motion passed unanimously. Hal Johnson was asked to prepare the Order of the Board of Adjustment and forward it to the appli- cant . 5.
