April 4, 1989
There was a. meeting of the Randolph County Zoning Board
of Adjustment on Tuesday, April 4, 1989 , at 7 : 00 p.m. , in
Courtroom B, Randolph County Courthouse, 145 Worth Street,
Asheboro, north Carolina .
1. Vice Chairman Lynden Craven called to Order the
Randolph County zoning Board of Adjustment meeting
at 7 : 00 p.m.
2 . Hal Johnson, Planning Director , called roll of the
members: Doyle Stout, Chairman, present; Lynden
Craven, Vice Chairman, present; Charles Adams,
present; Guy Troy,present; Bill Dorsett, present;
P.weilda Little, ;present ; and Jim Routh, present .
3 . Lynden Craven announced that the first case before
the Board was Randy U. Lynch (applicant asking for
a Variance to develop a one acre lot homesite with
no State Road frontage out of a 5. 37 acre tract) .
Pal Johnson, P:La.. n;s.ng Director , asked if Mr . Lynch
was present; he :was not . Johnson advised that the
Board may wish to consider postponing this request
since Lynch was not ?resent to answer questions of
concerns of the Board (from the last meeting) .
This request was postponed until Randy Lynch could
�.- be present at a Board meeting.
4. Lynden Craven stated that the second case before
the Board was Charles Royal of Trinity Township.
Hal Johnson, Planning Director, gave a brief
summary of this case. Johnson stated that the
Variance (from the County Unified Development
Ordinance) was from the required minimum set backs
(side, rear , and front set back requirements) , and
permission to locate this manufactured home on this
extremely .small lot . Johnson told the Board that
the Health Denartnent had explained that the septic
tank system (that is located on this lot) was
located outside of the Class A Flood one, however ,
in order to locate a residence on this lot it would
have to be placed in this flood zone. Johnson
asked if Charles Royal was Present .
Charles Royal stated that when he first purchased
this lot, the sire was approximately l acre. Royal
explained that the State Highway Commission had
asked him to sign for right of way to be granted in
order to pave the road. Royal stated that he was
told (by the State Highway Commission) that (by
signing for this right of way to pave the road)
this would enhance this area and make his lot more
valuable. Royal presented the Board with photo-
graphs of the property, a copy of the old survey, .a
copy of the new survey, a copy of the approved
septic tank permit , and a copy of the right of way
(he signed) . ' oya'-, stated that there is a creek and
a portion of the Uwharrie River on this property,
and that a mobile home (by former owner Albertson)
been located on this lot for at least 15 years (lot

is vacant at thi.:. Royal stated there was a
-sone house that dated .back to the {Civil War on
this pr onerty p.r'. s : to the mobile home.
Hal Johnson, Plannine Director , told the Board thate
stumps and other types of fill-in garbage had been
applied to the lot to try to bring the ground level
above the flood plain. Johnson added that- the only
problem with this was that it would be difficult to
find a solid base to locate the manufactured home.
Guy Troy, Boar, :nembe_ , asked Royal when he dis-
covered his lot had been reduced in size. Royal
stated that he found out approximately 6 months ago
when began trying to locate the mobile home on the
lot. Royal stated that at that time he had a
survey done on the lot that cost approximately $800
because the previous survey/deed had been done so
many years ago that trees, stones in the creek,
etc . had been used for markers (in approximately
1962) . The new survey showed the lot had been
reduced from 1 acre to . 455 acre .
Sill Dorsett, Board member , asked Royal if the
septic tank system was located entirely on his lot
or if a portion was on the State right of way.
Royal answered Cy saying that it was entirely on
his lot. Royal stated that he paid $6,000 for the
lot and now has approximately $10,000 invested in
the property. Royal added that he had not been
contacted by the State concerning any reimbursement
for slaughtering the lot so drastically for this
right of way. Royal stated that the lot was
serviced by County Water, Inc. ) water and
the filling in of
the lot began approximately 1
year ago.
Lynden Craven, Vice Chairman, asked if there was
anyone present in opposition to this request .
Doris Moore, Coltrane Road, (one of the Charlie
Moore heirs) expressed her concerns of the type of
mobile home (new or used, rented or owned) , con-
cerns of this lot flooding, and this type of
development having an adverse effect on the pro-
perty values in this area .
Royal answered her question concerning the mobile
home by saying he would live in a new mobile home
with his daughter and her son. Royal also stated
that Mr. Albertson (who he purchased the lot from)
told him that the lot had never had flooding
problems.
Xay Albertson, Stones Throw Subdivision, stated
that she lived in Stones Throw Subdivision and
owned land across the road from this lot. Albert--
son stated that she had concerns of the fill-in
materials that , ere used and added that she had
seen this property flood before.
Cynthia Alexander ,, Stones Throw Subdivision, stated
that this area does flood. Alexander explained
that this was a restricted area and would hate to
see a single wide manufactured home located on this
lot .
Scott Lashburn, Stones Throw Subdivision, stated
that he was very aware of the flooding in this area
and added that he Aid not think any permit should
be issued for this lot until an environmental
survey could prove that this lot can be developed.
Aweilda Little, board member, stated that the old
plat appears to show part of the lot originally was

located is the ;ea. , so actually Royal did not
really have an .a'"_ _ to begin with.
Hill Dorsett , 1 _3:_d member , stated that the Ordi-
nance clearly st_ t es that the fact that the man has .
$10 ,000 invested in the property cannot enter into
the decision the ?oard must make. Dorsett added
that he felt that becaurse the neighbors had lived
in this area longer , that there testimony held more
wait than :Royal ' s . Dorsett made the motion to deny
this re< uest for a Variance because of the real
possibility that this lot will flood. Charles
Adams seconded this motion and the motion passed
unanimously.
Hal Johnson, Planning Director, told Royal that he
would receive the Order of the Board of Adjustment
for the Planning Office within the next couple of
days .
5 . The Zoning Board of Ajustment meeting adjourned at
7 : 30 p.m.
