08AugustPB 4M Y. /4 ly MT NUT ES 1779 RANDOLPH COUNTY PLANNING BOARD August 8, 1989 There was a meeting of the Randolph County Planning Board on Tuesday, August 8, 1989,. at 7:00 p.m. , in Courtroom B, Randolph County Courthouse, 145 Worth Street, Asheboro, North Carolina. 1 . Chairman Charles Adams called the Randolph County Planning Board meeting to Order at 7:00 p.m. 2. Hal Johnson, Planning Director , called roll of the Board members: Charles Adams, Chairman, present; Aweilda Little, Vice Chairman, present; Lynden Craven, present; Dov.le Stoutg absent ; Guy Troy, present; Bill Dorsett, present; Jim Routh, present; Maxton McDowell , Alternate, present (substituting for regular member Doyle Stout) ; and Arlie Culp, Alternate, present . 3. Lynden Craven made the motion, seconded by Guy Troy, to approve the Minutes from both the Zoning Board of Adjustment meeting and Planning Board meeting of July 11, 1989 . Motion passed. 4. SUBDIVISION : A: KEYAUWEE FOREST, Section 2 (Final Plat) ; SR 1525; Back Creek Township. 10 Lots. James Leroy Walker & D. E. Hill - Owners. �. Hal Johnson, Planning Director, stated that this would be a restricted site built resi- dential subdivision. Guy Troy made the motion, seconded by Aweilda Little, to approve the Final Plat for Keyauwee Forest Subdivision (Section 2) . The motion passed unanimously. 5. REZONING REOUEST$ : A: Frank Edmonson, III , Asheboro, North Carolina, is requesting that approximately 3 acres located off SR 1004 fronting on the east side of SR 1418, Back Creek Township, be rezoned from Residential Agricultural to Light Indus- trial. Zoning Map #7732. It is the desire of the applicant to use the property for indus- trial purposes. Bob Wilhoit, Attorney (for Frank Edmondson) , was present at the hearing and provided the Board with a survey plat of the property and 10 photographs of the surrounding properties. Wilhoit stated that residential development would not be the highest and best use for this property for two reasons: (1) due to the - shape of the tract, the land could not be subdivided, and (2) because of development of surrounding properties (private airstrip, warehouse building, welding shop, and a Randolph Electric substation) . Wilhoit stated that the highest and best use of the land August 8, 1989 Page 1 would be for the property to be zoned Light Industrial. Wilhoit stated that in the Randolph County Zoning Ordinance there is a wide variety of proposed usages for Light Industrial zoned property, but Residential Agricultural limits the property development proposals. Wilhoit advised the Board that his client is a member of Lakewood (an •adjoining private nature type, recreational tract of an approximate 250 acres) and would never develop any offensive type of business on this pro- perty. Wilhoit closed by saying his client was only seeking to use his property as his neighbors have . Page Hoover (owner of the welding shop) , adjoining property owner , expressed his concerns of this type of development in this area. Hoover stated that the welding shop was a one man business and he did not consider it industrial. Mr. & Mrs. Joseph Spencer addressed the Board with their concerns of opening this community up to commercial development. Mrs. Spencer stated that once property had been rezoned its hard to turn the zoning back to residential. Joseph Spencer stated that he owned the private airstrip. Spencer stated that he had two antique airplanes and only flew approxi- mately 25 hours this year (very little activity in his opinion) . There were 10 persons present in opposition to this request, and a petition of 39 names also in opposition was presented. Guy Troy made the motion to recommend that this request be disapproved because of an unknown entity of use and that this unknown entity could effect the quality of life in this rural agricultural community. Lynden Craven seconded this motion and the motion passed unanimously. B: Kermit Morgan, Trinity, North Carolina, is requesting that approximately 6 acres located on SR 1534 (1/2 mile west of Marlboro Church Road) , New Market Township, be rezoned from Residential Agricultural to Residential Mixed/ Conditional Use. Zoning Map #7726. It is the desire of the applicant to develop a 19 space manufactured home park with central water and sewer. Hal Johnson, Planning Director, explained to the Board that Morgan' s original request to develop a mobile home park of 25 spaces was • denied by the County due to density of development concerns. Morgan has resubmitted plans with a reduced number of spaces . Morgan was present at the meeting and explained to the Board that one side of this property is bordered by Countryside Mobile Home Park with a total of 65 mobile homes (owned by Walt Daniels) , and the other side is bordered by a scrap metal yard (owned by Cecil Tate) . Morgan stated that Davidson County Water, Inc. will supply the water for the park and Walt Daniels (Countyside Mobile Home Park) would provide sewer disposal into his central system designed for 100 mobile homes (at present 65 mobile homes are using this system) . Morgan stated that the property August 8, 1989 Page 2 would perk for individual septic systems . Morgan told the Board that he plans to con- struct a fence (14 ' high) 3 feet off his property line that borders the scrap metal yard and the road (on this property) would be re-worked. Betty Tutterow, adjoining property owner , said that the septic system Morgan is planning to use already releases terrible odors. Tutterow added that the children from this existing mobile home park have bikes and roller skates in the road because they have no where else to play. There were 3 people present opposed to this request . Hal Johnson stated that he was not an engineer but that in several cases an engineer has explained to this Board that these central sewer system worked properly if the number of residences the system was designed for uses the system. Bill Dorsett, Board member , stated that the sewage disposal system was one concern he had in denying the original request. Dorsett said that the property probably could not be used . for any other type of development, but the children should have a place to play. Bill Dorsett made the motion to recommend that this request be approved with an appropriate specified park area for children to play. Hal Johnson stated that the Planning Depart- ment would assist Morgan in specifying a recreational area. Aweilda Little seconded the motion and the motion passed unanimously. C: B. R. Clodfelter , Archdale, North Carolina, is requesting that approximately 55 acres located at the intersection of SR 1408/SR 1636, Tabernacle Township, be rezoned from Resi- dential Agricultural to Residential Restricted. Zoning Map 17713 . It is the desire of the applicant to develop a site built residential subdivision. Clodfelter was present at the meeting and stated that there would be a maximum of 54 lots in this subdivision and all the lots would be served by Davidson Water, Inc. Clodfelter stated that he was in the process of developing restrictive convenants for the subdivision . Linda Hill, Trinity, asked if the road would be paved (the State Road in front of this subdivision) . Hiram Marziano, Engineer (for Clodfelter) , stated that the Department of Transportation has committed to paving the road eventually (within the next two years) , but if not Clodfelter , his partners, and other land owners (on this road) will join in with the DOT to have the road paved. Lynden Craven made the motion, seconded by Guy Troy, to recommend to the Commissioners that this request be approved. The motion passed August 8, 1989 Page 3 unanimously. D: G. Thomas Moore, Liberty, North Carolina, is requesting that approximately 32 acres located on SR 2417, Liberty Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #8737 . It is the desire of the applicant to develop a residen- tial subdivision. Moore was present at the hearing and stated that he would restricted the lots to no junk vehicles, no chicken houses, no commercial activity, etc. Moore stated that Duke Power had a 200 ' right of way that borders this property on the south. Jim Routh asked Moore if there were any type of restrictions involved with building a road near Duke Power ' s Right-of-Way. Moore answered that he would not be able to build the road down the right-of-way, that he could cross the right-of-way, but his plans (of building the road) would not involve this right-of-way. Tom Crutchfield, realtor (for Moore) , stated that this would be a single family residential subdivision. There was no one present in opposition to this request. Guy Troy stated that this area would be very appropriate for a restricted residential development, and made the motion that the Board recommend that this request be approved. Aweilda Little seconded this motion and the motion passed unanimously. E: Jay S. Hohn, High Point, North Carolina, is requesting that approximately 10 acres located on SR 1927, New Market Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #8737. It is the desire of the applicant to operate a Go-Cart Track . Hohn was present at the meeting and explained that the track was in operation 10 years ago but has been closed since 1982. The track is located approximately 1500 sq. ft. of the road in the center of 150 acres surrounded by corn fields. Guy Troy asked Hohn how many cars would be racing at this track . Hohn stated that there were different classes, but all together approximately 50 cars a night. Hohn stated that there were approximately 250 spectators at these seasonal events. Hohn said that the races were only on Saturday nights from April to October . Bill Dorsett asked Hohn how what time the racing began and ended. Hohn stated from 7pm to approximately 11pm. Troy asked Hohn if the cars practiced any before racing and Hohn stated that the practicing began around 3: 30pm. Elbert Canter, adjoining property owner, stated that he was the closest neighbor to this track and that he had never lost sleep over this operation. August 8, 1989 Page 4 Mark Stroud, adjoining property owner (on the backside of the track) stated that track caused problems such as noise, traffic, and races that lasted up until 12 : 30/1 pm at night. Leonard Stroud, High Point, stated that he could hear the noise from Muddy Creek Road. A petition of 60 names was presented in opposition to this request. Vallen Weaver , High Point, stated that she hated to see this property rezoned because the community would loose the farming/residential type area. Weaver expressed her concerns also of the noise, traffic, and air pollution. Hal Johnson, Planning Director, explained that a Conditional Use Rezoning does not set a precedent, each individual case is based on its own merit. Jackie Stroud, High Point, stated that the Planning & Zoning Board and Board of Commis- sioners worked hard to develop County Zoning and this type of spot zoning would defeat its purpose. Board member , Guy Troy, stated that he lived within 1 mile of the Go-Cart Track at Liberty with a buffer zone of trees between his property and the Track. Troy stated that the Track near his residence was nicely operated by a family organization. Troy, added that these go-cart engines have a high frequency roar and in his opinion this is noise pollution at its worst. Jimmy Canter, adjoining property owner , stated that he operated this track with Hohn (10 years ago) and had no complaints from anyone. Canter went on to say that he was familiar with the Track in Liberty, but that this Track was no were near the size operation of Liberty. Linda English, adjoining property owner, stated that the trees around the track allowed a buffer that muffled the sound of the go-cart engines to a low noise. There were approximately 30 persons present in favor of this request. Jackie Stroud asked the Board why he was allowed to start up his operation without any type of permits. Chairman Adams answered by saying that Hohn was not in compliance with Zoning regulations, so the Planning Department notified him, and that is why he is here tonight. Hal Johnson stated that this operation is a temporary activity and Hohn is requesting a rezoning for a seasonal business every year . Guy Troy made the motion to recommend this request be denied because of the noise pollution. Bill Dorsett stated that there are two sides to this case: (1) is the Board going to subject the neighbors to certain amount of noise and (2) children need activities to August 8, 1989 Page 5 track would be located on 150 acres 1,500 feet off the road. Dorsett added that he would be in favor of this request because he did not feel that this activity would be detrimental to this neighborhood. Aweilda Little said that she felt this would be a activity would have a positive effect on this community. Little stated that this would provide children and parents with an activity that they could share together . Guy Troy withdrew his motion. Lynden Craven said he felt our children needed activities other than sitting on hoods of cars up and down North and South Fayetteville Street (Asheboro) . Craven added that he felt sure this would be a good family oriented recreation and would be operated in a nice manner because of this over-whelming support of Hohn' s friends and neighbors. (Approxi- mately 30 . people) Craven made the motion to recommend -that this request be approved with the restrictions of racing only on Saturday night and cut off time would be 11 pm. Jim Routh expressed his reservations of setting a restriction of a cut off time. Routh stated that he did not believe it would be possible to police such a restriction. Guy Troy stated that this restriction could be police, that the community to call the Sheriff' s Department. Troy added that the go- cart races would be allowed to go on late into the night. Troy said you can' t sleep through this type of noise. Jim Routh stated that he lived within 1 mile of Caraway Speedway and that Caraway begins to wind down around 11 pm, but that sometimes the races run past that time. Guy Troy stated that if you put the restric- tion on the Track then the owner can schedule the races to be through by 11 pm. Aweilda Little express her opinion that the restriction could be hard to enforce. Maxton McDowell seconded the motion. The motion passed by a 4/3 vote, with Guy Troy, Jim Routh, and Aweilda Little voting against the motion. F : Cliff Hoyt Loflin, Asheboro, North Carolina, is requesting that approximately 1/2 acre located on the southeast corner of SR 1181/SR 1177, New Hope Township, be rezoned from Residential Agricultural to Residential Agricultural/Conditional Use. Zoning Map #6697 . it is the desire of the applicant to use the property for an automotive sales lot. Cliff Loflin was present at the hearing and stated that he was operating a body shop at this location prior to zoning and he would now like to apply with the State for a dealers license. Loflin stated that he resides on this property. August 8, 1989 Page 6 Bill Dorsett asked Loflin why he has asked for two different locations to be rezoned. Loflin answered that he already has a preliminary approval from the State on this location, but eventually plans to move the car sales (part of his business) to the location on Highway 49 because it would be more visible to more traffic. Dorsett asked Loflin what he did with the cars after he has all the parts off of them that he plans to use. Loflin stated that he carries the shell of the car to a salvage yard and sells it. Hal Johnson stated that he has had several phone calls in opposition to this request, and was surprised that there was no one present to speak to the Board. Johnson asked Loflin if he was aware that this Conditional Use would limit him to only the 1/2 acre and he could not expand beyond the 1/2 acre. Jim Routh asked Johnson if the Conditional Use (Loflin is asking for) would have an effect on his body shop operation. Johnson stated that he would still be able to operate the body shop within the building. Guy Troy made the motion, seconded by Aweilda Little, to recommend to the Commissioners that this request be approved. The motion passed. G: Cliff Hoyt Loflin, Asheboro, North Carolina, is requesting that approximately 5 acres located on the southside of Highway 49 (where to four-lanes end) approximately 100 yards from the County line, New Hope Township, be rezoned from Residential Agricultural to Highway Commercial/Conditional Use. Zoning Map #6686. It is the desire of the applicant to construct a sales off and have a car sales lot. Loflin stated that he would have approximately 2 or 3 cars on the lot most of the time. Hal Johnson asked Loflin to describe the nature of the area. Loflin stated that it is a rural agricultural community. Rex Shaw, adjoining property owner, stated that this would not serve the best interest of the community, and that he and his neighbors would like to see development on this lot that would be in keeping with the rural agricul- tural nature of the community. Shaw stated that a car lot could grow into an eyesore and other types of business. Shaw added that he would just like to see the area remain a quiet community. Steve Scarboro, adjoining property owner , stated that Loflin has a couple of cars on the lot at this time and because no one is at the lot, people are beginning to come up to the neighboring houses to ask questions concerning these cars . Elwina Shaw expressed her concerns of this type of development in this community. There were approximately 12 persons present opposed to this request. L ' August 8, 1989 Page 7 Maxton McDowell made the motion to recommend that this request be denied due to the impact it would have on the community. Guy Troy seconded this request and the motion passed unanimously. H: Steve A. Vestal, Thomasville, North Carolina, is requesting that approximately 1 acre located on the corner of SR 1627/SR 1629, Trinity Township, be rezoned from Residential Mixed to Light Industrial. Zoning Map #6799. It is the desire of the applicant to use the property for industrial purposes. Steve Vestal was present at the meeting and explained to the Board that on both the High Point and Randolph County sides of this property are commercial and industrial activities. Vestal stated that he plans to construct a brick industrial building. Vestal stated that this lot is beside Allred Metal Stamping and in front of Phimco. Hal Johnson told the Board that the Land Development Plan shows this area as becoming commercial/industrial. There was no one present in opposition of this request. Bill Dorsett made the motion, seconded by Jim Routh, to recommend to the Commissioners that this request be approved. The motion passed unanimously. I : Rodney Brown, Franklinville, North Carolina, is requesting that approximately 1 acre (out of 49 acre tract) located on the west side of SR 2141, Franklinville Township, be rezoned from Residential Restricted to Highway Com- mercial/Conditional Use. Zoning. Map #7784. It is the desire of the applicant to construct a warehouse and small office for storage of general construction materials. Rodney Brown was not present until after opposing citizens expressed their views. Hal Johnson stated that this was primarily a site built residential community and Brown was planning for a small pre-fabricated building. James Reeder , adjoining property owner , stated that he was against spot zoning in this nice residential area, and that if the County approved this zoning it will begin to snow- ball . There were 4 people present in opposition to this request . Rodney Brown entered the meeting late and addressed the Board. Brown stated that he lives on the property and that the building would be used primarily for storage. Brown said that at the present time he rented a building just up the road from his property for his storage, but because the business needs more storage he would like to build near his residence. Brown stated that there would be no selling from this building and there would only be a sign on the front of the building and not at the road. Louise Reeder asked how many employees would August 8, 1989 Page 8 be at this building. Brown answered that there would be 1 secretary for the office. Guy Troy stated that he felt that if outside storage was allowed it would be detrimental to the community. Jim Routh stated that he felt that vehicles should not be considered storage, but that the building materials should. Jim Routh made the motion to recommend that the request be approved with no materials stored outside the building. Lynden Craven seconded the motion. The motion did not pass the vote was 3/4, with Guy Troy, Bill Dorsett, Charles Adams, and Aweilda Little voting against it. Bill Dorsett made the motion to recommend to the Commissioners that this request be denied because it would alter the nature of the community. Guy Troy seconded this motion. The motion passed with a 4/3 vote, with Maxton McDowell, Jim Routh, and Lynden Craven voting against the motion. 6.
