RANDOLPH COUNTY PLANNING BOARD
September 12, 1989
There was a meeting of the Randolph County Planning
Board on Tuesday, September 12, 1989, at 7 :00 p.m. , in
Courtroom B, Randolph County Courthouse, 145 Worth Street,
Asheboro, North Carolina.
1 . Chairman Charles Adams called the Randolph County
Planning Board meeting to Order 7:00 p.m.

2. Hal Johnson, Planning Director , called roll of the
Board members: Charles Adams, Chairman, present;
Aweilda Little, Vice Chairman, present; Lynden
Craven, present; Doyle Stout, absent ; Guy Troy,
present; Bill Dorsett, present; Jim Routh, present;
Arlie Culp, Alternate (substituting for regular
member Doyle Stout) , present; and Maxton McDowe11,
• Alternate, abaent .
3 . Lynden Craven made the motion, seconded by Guy
Troy, to approve the Minutes of the Randolph County
Planning Board meeting of August 8, 1989. This
motion passed.
4. SUBDIVISIONS :
A: KYNWOOD VILLAGE, Section 10 (preliminary
plat) ; Trinity Township; SR 1004; 13 lots.

Zoned RR. . B. R. Clodfelter - Owner/Developer .
Hal Johnson, Planning Director, explained to
the Board that the property is zoned properly
for major subdivision development, therefore
the property would not require rezoning.
Johnson stated that this is an extension of a
major site built housing subdivision.
Lynden Craven made the motion, seconded by Jim
Routh, to approve the preliminary plats for
Lynwood Village, Section 10 . The motion
passed unanimously.
B: HUNTERS WOODS, Section 1, Maps 1 & 2 (final
plats) ; Tabernacle Township; SR 1636; 23 lots .
Zoned RR. B. R. Clodfelter & Lee Stackhouse -
Owners/Developers.
Hal Johnson stated that these final plats were
of the lots that would front on the existing
State Road, and the remainder of the lots
would be developed once the new roads are
built to State Standards.
Jim Routh, Board member, asked Hal Johnson if
the subdivision regulations required the State
Road to be paved if it was dirt. Johnson
answered that if the subdivision major subdi-
vision was developed to front on a dirt State
Maintained Road, the developer would not be
required to pave this road.
Aweilda Little made the motion, seconded by
• Jim Routh, to approve the final plats for

Section 1 of Hunters Woods Subdivision.
Motion passed.
5 . ,SPECIAL., USZ 2ERr4IT 2i12101.IRSTS :
A: Gene Allred, Randleman, North Carolina,.
• requested a Special Use Permit for a Rural
Family Occupation to construct a building (40 '
�... x 60 ' ) to operate a machine shop at his
residence located on SR 2132 (George York
Road) approximately 1 mile from SR 2261 (Old
Liberty Road) , Franklinville Township, Zoning
Map #7774, Zoning District RA.
Gene Allred was present at the hearing and
explained to the Board that this business
would only be a family operation.
Bill Dorsett, Board member, asked Allred how
much traffic could he expect and what type of
machine operation business did he propose.
Allred stated that he contracted machine parts
and there was very little traffic because he
delivered the orders .
There was no one present in opposition to this
request.
Lynden Craven made the motion, seconded by
Aweilda Little, to approve this request for a
Special Use Permit. The motion passed
unanimously.
B: Centel Cellular Company, North Carolina,
requested a Special Use Permit to construct a
Cellular Telephone Tower (Public Utility
Station) on approximately 5 acres of land
located on SR 1404 (Finch Farm. Road) just
south of the intersection of SR 1404 (Finch
Farm Road) /SR 1555 (Gumwood Road) , Trinity
Township, Zoning Map #6795, Zoning District
RA.
Harlan Sexton (agent) was present with Keith
Roberson, Chief Engineer for this project.
Roberson explained to the Board the Tower
would be approximately 315 ft. in height and
the nearest house will be 100 ft. from the
• Tower .
Hal Johnson asked Roberson if he would foresee
any problems with ice forming on the guide
wires; Roberson answered no.
Roberson stated that there would be a fence
around the building and tower, and each guide
wires would have fencing circling the wire at
the ground. These fences will be 10 ft in
height and have barbed wire on top of the
fencing. Roberson added that the site would
be located 1000 ft. from the road and the
tower would be 250 ft. back from this.
Bill Dorsett asked Johnson if the Planning
Department had received any calls; Johnson
answered no.
Guy Troy made the motion, seconded by Jim
Routh, to approve this request for a Special
Us Permit. The motion passed unanimously.
6. REZONING REQUESTS :
A: Derick Apple, High Point, North Carolina, is
requesting that approximately 19 acres located
September 12, 1989 Page 2
on the west :_;ide of SR 1564 (Rabbit Town Road)
just south of the intersection of SR 1564
(Rabbit Town Road) /SR 1565 (Ronniedale Road) ,
Trinity Township, be rezoned from Residential
Agricultural to Residential Mixed/Conditional
Use . Zoning flap #7707. It is the desire of
the applicant to expand his existing mobile
home park with 4 additional spaces.
Derick Apple was present and explained to the
Board that he has 7 spaces at the present
time, but would like to make addition of 4
spaces. Apple told the Board this property
was his grandmother ' s home place and she
developed the park approximately 20 years ago.
Hal Johnson told the Board that the majority
of the development in this area was site built
structures, and from Apple' s property to 1-85
is primarily zoned Residential Restricted.
Joel Farlow, adjoining property owner ,
expressed his concerns of adding additional
spaces to this mobile home park, located next
to a restricted development with homes valued
$100 ,000+. Farlow stated that this type of
development would be detrimental to the
adjoining property values and could set a
precedent for the future. Farlow showed the
Board a petition of 39 signatures (from this
area) of persons in opposition to this request
for rezoning .
Tony Williams, adjoining property owner ,
expressed his concerns of the perking problems
the Health Department has had in this area.
Vaughn Williams and Bob Hoback, adjoining
property owners, expressed there concerns of
the effect this type of development would have
on the property values in this area.
Ron Wilkins, adjoining property owner, showed
the Board photographs of the area and stated
that he felt this would be detrimental to
property values in this area.
Guy Troy, Board member, asked Apple if his
residence was in this area. Apple answered
that he was raised in this area, but he now
• resides in High Point.
Chairman Adams asked for a show of hands of
persons present in opposition to this request .
There were six people present.
Aweilda Little stated that this mobile home
park operation is considered a non-conforming
use, and did not need to be rezone prior to
operation. But that this area is now
basically a restricted residential community
and this type of rezoning would not be in the
communities best interest (in her opinion) .
Aweilda Little made the motion to recommend to
the Commissioners that this request be denied
because it would not be compatible with the
Land Development Plan for this area. Guy Troy
seconded this motion and the motion passed
unanimously.
B: Dwight Meredith, Trinity, North Carolina, is
requesting that approximately 23 acres located
off SR 1404 (Finch Farm Road) at the dead end
of SR 1554 (Wright Road) , Trinity Township, be
rezoned from Residential Agricultural to

Residentialnixed/Conditional Use. Zoning Map
' 6795. Tt is the desire of the applicant to
develop a 12 space mobile home park .
Dwight Meredith was present at the meeting and
stated that he had purchased this property
(originally 33 acres) in June of 1986.
Meredith stated that he built up the old
private road (at the end of SR 1554) and paid
for Davidson County Water to be installed to
this property. Meredith stated that he could
not sell the land as tracts for homes because
the property is surrounded by mobile home
development . Meredith stated that he had
employed a real estate agent to try to sell
this land (as tracts for homes) from May, 1989
up until the date of this hearing= no lots
were sold. Meredith stated that he owns
Ashley Park Mobile Home Park (which adjoins
this property) and that his park is well kept
with all the trailers underpinned, no animals
allowed, and weekly garbage service. Meredith
stated that there were two accesses to this 23
acre tract, (1) through the private drive at
the end of Wright Road, and (2) at the back of
Ashley Park Mobile Home Park . Meredith
presented the Board with a deed of proof of
this statement concerning easements. Meredith
stated that it would not be financially
feasible to enter onto this property through
Ashley Park, because it would require a bridge
to be built in order to construct the road.
Ruth Williams, adjoining property owner,
stated that she owns 1000 ft of this private
road and that she would not agree to maintain
this road for a neighboring 12 space mobile
home park. Williams stated that this would be
too costly.
Dennis Williams, adjoining property owner,
expressed his feels that this 'easement (on
Meredith' s deed) was falsely notarized.
Wright stated that he has employed an attorney
to prove this. Wright stated that Meredith
removed the road tile from the old access
through Ashley Park. Wright told the Board
that the State told him the tiles he removed
would cost approximatey $2700 today.
Bill Dorsett stated that if an easement is
recorded in the register of deeds the Board
would not be responsible for its legality (the
Board would view the easement as legal) .
Dwight Meredith addressed the Board again and
stated that he would help maintain the road if
the agreement was legal and binding, but he
would not accept total responsibility for the
maintenance of this road because the Wright' s
also had a mobile home park of approximately
16 spaces that used this road.
Doris McCannon, adjoining property owner,
(entered the meeting late) stated that she is
in favor of this request being approved.
McCannon stated that she owns a site built
home, and would enjoy the 12 new neighbors.
McCannon stated that she owns a house and land
on this easement, and that the road has
improved greatly since Meredith began working
on it.
Bill Dorsett advised the Board that the Zoning
Ordinance requires the Board to insure proper

ingress and egress to property that is being
rezoned.
Jim Routh made the motion to delay action on
this request for 30 days to give the applicant
time to work out an agreement on the private-
road maintenance and the Wright' s time to
disprove the legality of the easement. Arlie
Culp seconded this motion. The motion passed
with a vote of 6/1 with Bill Dorsett voting
against the motion (Dorsett stated that he did
not feel the Board shouldpostpone a decision
on those grounds) .
C: Bill Lineberry, Denton, North Carolina, is
requesting that approximately 5 1/2 acres
located on the north side of Highway 49 just
west of the intersection of Highway 49/SR 1171
(Grange Hall Road) , Concord Township, be
rezoned from Residential Agricultural to
Highway Commercial/Conditional Use. Zoning
Map #7618. It is the desire of the applicant
to construct a printing plant (approximately
15,000 sq. ft. ) . (Property Owners - Charles &
Pauline Bescher) .
Becky Lineberry, Vice President of Label Line
Limited, was present at this hearing and told
to the Board that the business employs
approximately 25 persons. Lineberry stated
that the Health Department has approved this
• location for a septic tank. Lineberry told the
Board that the business is considered a non-
poluting industry (using water based inks) .
Lineberry told the Board that this business is
located (at present) beside the Post Office in
Denton and is a very low noise operation.
Hal Johnson advised the Board that a Special
Use Permit for the new Farmer Elementary
School was issued (by the Board) recently.
Johnson added that the School Board, in the
past, has asked the Planning Board to closely
examine any type of commercial/industrial
rezoning request that may effect the Public
Schools to protect the safety of the students.
Lineberry told the Board that no residence or
industry could be seen from this tract.
Lineberry stated that this tract is located
approximately 500 yards from the intersection
of 49/SR 1171 (the School is proposed on SR
1171 close to this intersection) .
Aweilda Little expressed her concerns of
business or industrial development spreading
on these vacant tracts of land across from the
proposed School site.
Chairman Adams asked if there was any opposi-
tion to this request. There was no one
present at the hearing and Johnson stated that
the Planning Staff had not received any calls.
Arlie Culp made the motion, seconded by Guy
Troy, to recommend to the Commissioners that
this request be approved. The motion passed
unanimously.
D: Faye Leonard & Debra Burgess, Liberty, North
Carolina, is requesting that approximately 3
acres fronting on Highway 49 and backs up to
SR 2503 (Kivett - Council Road) , Columbia
Township, be rezoned from Residential Agricul-
tural to Highway Commercial/Conditional Use.

Zoning Map (3724 . It is the desire of the
applicant to construct a warehouse building
for the storage of furniture. (Property
Owners - Henry & Betty Wright) .
Faye Leonard, Debra Burgess, and Henry Wright
were all present at the meeting. Wright
showed the Board the plat of the property and
the proposed location of the building site.
Wright stated that this tract would be cut
from a larger tract that backs up to SR 2503 ,
but this 3 acre tract will not.
Faye Leonard stated that the building would be
approximately 10,000 sq. ft. and would be used
for distribution . The business would employ
only 1 employee (other than themselves) .
There was no one present in opposition to this
request .
Arlie Culp made the motion to recommend that
this request be approved as consistent with
the Land Development Plan. Lynden Craven
seconded the motion and the motion passed
unanimously.
E: William T. Cox (Contractor/Agent for Richard
Kunz) , Ramseur , North Carolina, is requesting
that approximately 1/2 acre (out of a 7 1/2
acre tract) located on SR 2628 (Parks Cross-
roads Church Road) approximately 1000 ft.
south of "The Farm" Subdivision, Columbia
Township, be rezoned from Residential Agricul-
tural to Residential Agricultural/Conditional
Use. Zoning Map #8721. It is the desire of
the applicant to operate a car sales business
(and obtain a dealers license) at his
residence.
• William T. Cox, Mr . and Mrs. Richard Kunz was
present at the meeting. Cox stated that the
Kunz did not plan to have a used car lot on
the property, that they planned to purchase
cars, clean the cars up, and resale the
vehicles wholesale (at car sales) . Cox showed
the Board the house plans and stated that the
• home would be 2, 693 sq. ft. home, sit approxi-
mately 300 ft. off the road, with the garage
in back of the residence (at a total cost
exceeding $150,000) . Cox stated that the deed
would restrict the property to no junk
vehicles and no more than 6 cars on the
property. Cox stated that he owns a
restricted development in close proximity of
this property (The Farm) and would not be for
this request if he thought it would be detri-
mental to the community.
Aweilda Little asked Cox how much of The Farm
Subdivision had been sold. Cox answered
approximately 30% .
Richard Kunz stated that he does only
mechanical work , no body work (to the
vehicles) .
C. H. Burgess, adjoining property owner ,
stated that if there wasn't a car lot located
on the property and the business was not
visible from the road, he would not be against
the rezoning .
Gilbert Buchner, adjoining property owner,
stated that he would not be in favor of any

type of commercial rezoning in this area,
because this community is made up of private
residences and farms only.
Jack Carter , resident of The Farm Subdivision,
• stated that he and his wife purchased land
here because of the restrictions placed on the
property (one being no commercial activity) .
W. L. McIntosh and William Eckerd expressed
their concerns of property values being
effected by this type of rezoning.
Elvin and Linda York, adjoining property
owners, expressed there concerns of this type
of rezoning setting a precedents in this
community.
Mrs. Kunz addressed the Board by stated that
this would be a concealed business (could not
be seen from the road) . Kunz stated that they
would not be asking for the property to be
rezoned, but the State of North Carolina
requires a person to have a commercial
location prior to issuance of a dealers
license .
There were 10 persons present in opposition to
, this request.
Guy Troy made the motion to recommend to the
Commissioners that this request be denied
because it would not be in keeping with the
Land Development Plan for this community.
Lynden Craven seconded this motion and the
motion passed by a vote of 5/2 with Jim Routh
and Aweilda Little voting against the motion.
F: Delmer Morgan, Trinity, North Carolina, is
• requesting that approximately 1/2 acre (out of
a 6 acre tract) located on SR 1558 (Hopewell
Church Road) across from the intersection of
SR 1558 (Hopewell Church Road) /SR 1557 (Morris
Road) , Trinity Township, be rezoned from
Residential Agricultural to Residential
Agricultural/Conditional Use. Zoning Map
#7706. it is the desire of the applicant to
• operate a car sales business at his residence.
Delmer Morgan was not present at the meeting.
Brown Cumby, adjoining property owner, stated
that the residents in this area built nice
homes here to get away from town (and
business) . Cumby stated that the this
property adjoins the Hopewell United Methodist
Church and this type of rezoning could be
detrimental to the community. Cumby added
that one of the Sunday School classes has
adopted the road from the Department of
Transportation and clean all the trash up that
is thrown out on the road.
Tracy Bryson, Paul Darty, and Terry Lohr asked
for their names to be put of record opposing
this rezoning request.
There were 12 persons present in opposition to
this request.
Bill Dorsett made the motion to recommend to
the Commissioners that this request be denied
as not consistent with the Land Development
• Plan. Jim Routh seconded this motion and the
motion passed unanimously.
