RANDOLPH COUNTY PLANNING BOARD
October 3 , 1989
There was a meeting of the Randolph County Planning
Board on Tuesday, October 3, 1989 , at 7 : 00 p.m. , in Courtroom
B, Randolph County Courthouse, 145 Worth Street, Asheboro,
North Carolina .
1 . Chairman Charles Adams called the Randolph County
Planning Board meeting to Order at 7:00 p.m.
2 . Hal Johnson, Planning Director , called roll of the
Board members : Charles Adams, Chairman, present;
Aweilda Little, Vice Chairman, present; Lynden
Craven, present; DQyi_e__Stout1__absent ; Guy Troy,
present; Bill Dorsett, present; Jim Routh, present;
Arlie Culp, present (Culp entered the meeting late
- during the Tony Farlow case) , Alternate substi-
tuting for regular member Doyle Stout; and Maxton
3 . Lynden Craven mace the motion, seconded by Guy
Troy, to approve the Minutes of the Randolph County
Planning Board meeting of September 12, 1989. The
motion passed.

A: WOODFIELD ACRES, Map 2 (final plat) ; Provi-
dence Township; SR 2113/2106; 17 lots; Zoned
RR. Herman N. McDowell & W. Reid Kearns -
Developers .
B: INDIAN CREEK, Section 4 (final plat) ; Taber-
nacle Township; off SR 1549; 19 lots; Zoned
RM. Britt, Maynard, & Clodfelter -Developers.
The Board noted that the preliminary plats for
these subdivisions were approved during the
rezoning process . Hal Johnson stated that the
subdivisions meet the County' s minimum Subdivision
requirements .
Guy Troy made the motion, seconded by Lynden
Craven, to approve the final plats for both Wood-
field Acres , Map 2, and Indian Creek, Section 4 .
The motion unanimously passed.
5 . R:.OU. $?'a
A: Dwight Meredith, Trinity, North Carolina, is
requesting that approximately 23 acres located
off SR 1404 at the dead end of SR 1554 (Wright
Road) , Trinity Township, be rezoned from
Residential Agricultural to Residential
Mixed/Conditional Use. Zoning Map- #6795. It
is the desire of the applicant to develop a 12
space mobile home park .
Hal Johnson reviewed the information presented
to the Board (9/12/89) concerning the access
or easement to this property (from Wright
Road) . Johnson explained that property has an
• alternate access from Old Mountain Road (SR

1404) , :but the applicant proposes to use the
access from Wright Road.
Dwight Meredith was not present at this
hearing.
Frank Wells , Attorney representing Dennis
Wright, refreshed the Board' s awareness that
the State Maintenance of Wright Road ends at
Wright' s property and the remainder of the
road is owned and maintained by Wright. Wells
stated that Meredith has an easement to this
property (from Wright Road) recorded in the
Register of Deeds Office. Wells stated that
Wright retained him to investigate the
validity of this easement. Wells determined
by his investigations that the validity of
this easement is questionable and explained
that the easement was signed by Sylvia Wright
and her husband. Wells presented an affidavit
from Sylvia Wright (her husband is deceased)
stating that she thought the paper she signed
was for the addition of gravel to the road and
she never intended to grant this easement and
was never Present before a Notary Public.
Wells stated that his client was not against
the development of this property (to a mobile
home park) , but rather against this access
being used. Wells urged the Board to delay
action on this request and explained that a
law suit should be filed within the next
month. Wells stated that to change the status
of the land based on this access could be
creating problems for the future because if
the Wright ' s win their court case the access
would be closed leaving no entrance/exit for
the possible tenants of this park.
Dorsett, Troy, and Craven expressed their
concerns of making a recommendation to the
• Commissioners with the proposed access pending
a court case .
Guy Troy stated that he felt if the request
was approved there should be a stipulation
that Meredith could not use the Wright Road
access to the property until the matter of the
easement has been dissolved.
Hal Johnson stated that as Planning Director
he would not issue any permits to develop the
• park with the access being questionable.
Guy Troy stated that he felt the Board should
delay, any action until Meredith could be
present and agreeable to using the Old
Mountain Road access.
• I3i11 Dorsett made the motion to delay action
on this request until an appropriate,
uncontested right-of-way could be approved by
the Board. Aweilda Little seconded this
motion and the motion passed by a 5/1 vote.
Jim Routh voted against the motion.
B: John R. Chilton, Asheboro, North Carolina, is
requesting that approximately 2 1/2 acres
located on the east side of Highway 42
(approximately 4 3./2 miles from Highway 64,
Asheboro) , Grant Township, be rezoned from
Residential Agricultural to Residential
Agricultural/Conditional Use. Zoning Map
47689 . It is the desire of the applicant to
operate a used car sales business in order to
�-- obtain a North Carolina Dealers License.

C_hilton ' present-ed pictures of his home to the
Board and stated that he has a nice brick home
and has no intentions of operating a business
that would be detrimental to the property
values of this nice area. Chilton said that
he plans to use an existing building for his
office and sale primarily one-ton dump trucks .
Chilton stated that his wife currently
operates a greenhouse business full-time and
the sale of automobiles would not add to the
traffic entering the property. Chilton said
there would be a rare display of vehicles on
the property.
There was no one present to speak in
opposition to the request.
Guy Troy expressed his reservations of
allowing the display of vehicles (for sale) in
this nice residential area. Troy stated that
he was looking at the broad picture for
Randolph County and his concerns were of
several used car lots of this kind all over
the County.
Troy stated that he did not see a problem with
Chilton parking vehicles in the back near the
office building. Troy asked Chilton if he
• would be agreeable to not displaying cars in
front of the residence. Chilton stated that
he did not want to be limited to no display in
the front yard because on occasion he would
like to park a vehicle on the west side of his
drive.
Chilton stated that he has three neighbors in
view of his property - his in-laws and two
elderly neighbors and none of the three have
any opposition to this request.
Troy stated that he believed Chilton would
operate a nice neat business, but that if the
Board approved this rezoning it would allow
anyone to operate a used automotive business
on the property.
Bill Dorsett stated that he felt there would
be no problem in allow a limited number of
vehicles to be displayed in front of the
residence. Dorsett asked Chilton how many
vehicles would he display at any one time.
Chilton stated approximately 2 or 3 at the
most.
Bill Dorsett made the motion to recommend to
• the Commissioners that this request be
approved with the restriction of no more than
• 3 vehicles (for sale) be located in front of
the residence. Jim Routh seconded this motion
and the motion passed.
C: Tony Farlow, Sophia, North Carolina, is
requesting that approximately 1 acre (from a 2
1/2 acre tract) located on the southeast
corner of SR 1524 (Beckerdite Road) /SR 3109
(Piedmont Dairy Road) , New Market Township, be
rezoned from Residential Agricultural to
Highway Commercial. Zoning Map #7745. It is
the desire of the applicant to use the
property for commercial development.
Hal Johnson explained to the Board -that Farlow
• currently owns and operates a gas station on
•
the property between this property and Highway

311 . Jo_hnt;.n stated that the State plans to
add turning lanes to several intersections on
Highway 311 and the State would take the
property his current business is on for this
project .
Farlow told the Board that his business was
started by his father and uncle, and because
of the improvements to Highway 311 he would
need this new location to continue his
business .
Lynden Craven asked Farlow if he knew when the
State plans to begin this project. Farlow
answered by saying he was not sure, but that
the right-of-way would be cleared in May,
1990 .
There was no one present in opposition to this
request.
Aweilda Little made the motion, seconded by
Guy Troy, to recommend to the Commissioners
that this request be approved. The motion
passed unanimously.
D: Charles Powell, Archdale, North Carolina, is
requesting that approximately 26 1/2 acres
located at the northwest corner- of SR 1408
• (Hoover Hill Road) /SR 1636 (Cashatt Road) ,
Tabernacle Township, be rezoned from Resi-
dential Agricultural to Residential
Restricted. Zoning Map #7713. It is the
desire of the applicant to develop a residen-
tial subdivision of 23 lots.
Charles Powell was not present at the hearing .
Fletus Carter, adjoining property owner ,
stated that he was not against. the zoning
• change, but he did want to knowwhat type of
subdivision this would be.
Hal Johnson stated that the type of zoning
that was being requested would only allow site
built residences or Class A ' Double Wide
Manufactured homes with permanent foundations.
Lynden Craven made the motion, seconded by Guy
Troy to recommend to the Commissioners that
this request be approved as consistent with
the Land Development Plan for this area. The
motion passed unanimously.
E: 1Zeith & Wanda Aikens, High Point, North
Carolina, is requesting that approximately 1
acre (from a 7 . 11 acre tract) located on the
northwest corner of Highway 62/SR 1882 (Old
Turnpike Road) , Trinity Township, be rezoned
from Residential Agricultural to Light
Industrial/Conditional Use. Zoning Map #7707 .
It is the desire of the applicant to construct
a warehouse (100 ' x 100 ' ) for the storage of
furniture.
Hal Johnson stated that a mobile home park
(non-conforming use) is existing on this
property. Johnson described the area as
mainly residential with some small businesses
in the general vicinity.
Wanda Aikens explained that approximately 5
employees would be at this building for
loading purposes and the parking and entrance
would be on the Highway 62 side of the

Frank Brewer: , adjoining property owner , stated
that this property has low lying areas that
floods and washes during rains. Brewer
expressed his concerns traffic problems, .
perking (septic tank) problems, and drainage
problems .
Bill Dorsett stated that he did not feel this
was an unreasonable request (Light Industrial)
for this area and anything other than this
would be more detrimental to this area.
Hal Johnson asked the Aikens if they
understood that manufacturing would not be
allowed at this building, that this request
would only be allowing the storage of
furniture. Wanda Aikens answered yes and
added that she was also aware that if they
- • decided to manufacture at a later date they
could make a new request to the Board.
• Aikens stated that they plan to erect a fence
around this property.
Aweilda Little made the motion to recommend to
the Commissioners that this request be
approved with the requirement of a 25 ' buffer
of undisturbed natural area between the
industrial development and the residential
development on Old Turnpike Road. Bill
Dorsett seconded this motion and the motion
was approved unanimously.
F: Charles & Peggy Fletcher , Archdale, North
Carolina, is requesting that approximately 1
acre located. on SR 1685 (Zelma Blvd.) , Trinity
Township, be rezoned from Residential Mixed to
Residential Agricultural/Conditional Use.
Zoning Map 46798. It is the desire of the
applicant to construct a garage with an office
for an automotive wholesales business (to
obtain a dealers license) .
Charles Fletcher explained to the Board that
this business would be operated by his son.
• Fletcher stated that his son would fix the
cars up and carry them to a wholesales lot.
Fletcher stated that no more than 2 or 3 cars
would be on the property at one time and there
would be no sales lot. Fletcher added that
there is a beauty shop directly across the
street and a massage parlor down the road.
Fletcher presented a picture of the type of
building proposed for this site.
There was no one present in opposition to this
request.
Arlie Culp made the motion, seconded by Jim
Routh, to recommend to the Commissioners that
this request be approved. The motion passed.
