11NovemberBOA CrA4tl. iY4�P.y vy^f iiia MINUTES RANDOL.1'H COUNTY ZONING BOARD OF ADJUSTMENT November 7 , 1989 There was a meeting of the Randolph County Zoning Board of Adjustment on Tuesday, November 7, 1989 , at 7 : 00 p.m. , in Courtroom B, Randolph County Courthouse, 145 Worth Street, Asheboro, North Carolina. 1 . Chairman Charles Adams called to Order the Randolph County Zoning Board of Adjustment meeting at 7:00 p.m. 2. Hal Johnson, Planning Director , called roll of the members: Charles Adams, Chairman, present; Aweilda LitI•1.eg Vice _Chad1.711aii. _absent ; Lynden Craven, present; Doyl? Stout ._ absent ; Guy Troy, present; Bill Dorsett, present; Jim Routh, present; Arlie Culp, Alternate, present (substituting for regular . member Aweilda Little) ; and Maxton McDowell,. Alternate, absen . 3 . Chairman Adams announced that there was a request for a lot size Variance from Clyde Curl before the Board. Hal Johnson, Planning Director , gave a brief summary of the case. Johnson stated that Clyde Curl, Pleasant Garden, North Carolina, was requesting a Variance to allow the subdivision of an approximate 1 acre lot with no State Road frontage in lieu of the minimum lot size require- ment of 5 acres . Tax ID#777800060465. (Property Location: Hidden Forest Subdivision, Section 2, tract 4/5, Level Cross Township, off SR 2102, Zoned RR, Map #7773. ) Johnson stated that this 1 acre would be cut from an approximate 3 1/2 acre tract. Johnson reminded the Board that in 1986 a Variance • was granted (by the Board) to the adjoining property owner (to this tract) to subdivide a 5+ acres tract into 4 lots with the condition that the . • access road (to `_hese 4 lots) be built to State standards and gravelled. Johnson stated that it was Curl ' s intention to use this private road for access to this 1 acre division. Clyde Curl was present at the meeting and explained to the Board that he was building a house for his son and planned to deed him 1 acre with this house. Bill Dorsett, Board member , asked Curl what type of hardship would denying this Variance cause . Dorsett added that the Board was required by law to grant a Variance only if by denying the Variance the property owner would suffer a hardship. Janice Curl explained to the Board that the house was all ready under construction. Janice Curl stated that when she came to the Zoning Department for a Permit to locate the home she was not informed of needing a Variance or she would have applied for one at that time. Hal Johnson stated that Curl ' s property fronts on a State maintained road and it was the impression of the Zoning Department that the house would front November 7, 1989 Page 1 this :Mate roar:( and the access to the residence would be from this State road. Clyde Curl stated that he has worked out a maint- enance agreement with the owners of this private • road and that the deed (to this 1 acre) would include this agreement. Arlie Culp, Board member , stated that since the house was under construction and there was a maintenance agreement worked out for the road he felt this Variance should be approved. Culp made the motion, seconded by Jim Routh, to approve this request for a Variance. The motion passed unanimously. 4 .
