04AprilBOA = � - . 1 +�3 MINUTES RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT April 3, 1990 There was a meeting of the Randolph County Zoning Board of Adjustment on Tuesday, April 3 , 1990 , at 7 : 00 p.m. , in the Commissioners Meeting Room, Randolph County Office Building, 707 McDowell Road, Asheboro, North Carolina . 1 . Vice Chairman Aweilda Little called to Order the Randolph County Zoning Board of Adjustment meeting at 7 :00 p.m. 2. Hal Johnson, Planning Director , called roll of the members: Chari es Adjn , absent ; Aweilda Little, Vice Chairman, present; Lynden Craven, present; Doyle Stout, present; Bill Dorsett, present; Jim Routh, present; Maxton McDowe111 Altern ems _absent ; and Arlie Culp, Alternate, present. 3. Bill Dorsett made the motion, seconded by Doyle Stout to approve the Randolph County Zoning Board of Adjustment Meeting Minutes of March 6, 1990 . 4 . Hal Johnson gave a brief summary of the request (lot size variance) before the Board. DALE M. BYRNES , Archdale, North Carolina, is requesting a Variance to allow the division of a 3 . 30 acre lot into two lots fronting on a private road (a corner section of this lot fronts on a State Maintained Road) in lieu of the required 5 acre minimum tract size. Location: Caraway Hills Subdivision, part of lot 7, New Market Township, at the end of sr 1729 (Clover Drive) on the left at pavement end, Zoning District RR, Zoning Map #7725 . Hal Johnson stated that the division of this lot (if the Variance was granted) would allow a 1 . 2 acre tract to front on the State Maintained section of SR 1729 and a 2 .02 acre tract to front on a private road (extension to 1729) . State Road Maintenance would end at the corner of this new lot. Vice Chairman Little asked for arguments in favor of granting this request . Dale Byrnes was present at the hearing stated that he would like to purchase this 2 acres from Richard Coleman to construct a site built residence that would meet to restrictive covenants of Caraway Hills Subdivision . Byrnes stated that his driveway would be approximately 18 ft. from the State Maintained Road. Bill Dorsett, Board member, stated that Byrnes must establish a hardship, that the zoning laws are written to prevent just this sort of division. Richard Coleman, property owner , stated that he could not cut land to allow this 2 acres to front on the State Maintained Road because of the loca- tion of his well . Coleman stated that he needed to sell this land because he and his wife are retired April 3, 1990 Page 1 and this would prevent the Coleman ' s from loosing their home. Vice Chairman Little asked for arguments against granting this request . There was no one present in opposition of this request. Board member Lynden Craven stated that he felt a hardship had been proven (because of where the well is situated on the property) and for this reason Craven made the motion to approve this request for a Variance. Arlie Culp seconded this motion. The Variance was approved with a 5/1 vote. Bill Dorsett voted against the motion. 5 .
