08AugustBOA r '''X''; les -_� _--. - MINUTES RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT August 14, 1990 There .was a meeting of the Randolph County Zoning Board of Adjustment on Tuesday, August 14, 1990, at 7 : 00 p.m. , in the Commissioners Meeting Room, at the Randolph County Office Building, 707 McDowell Road, Asheboro, North Carolina. 1 . Chairman Charles Adams called to Order the Randolph County Zoning Board of Adjustment at 7 : 00 p.m. Chairman Adams explained to the public that tonight the Planning Board was serving in its capacity as the Zoning Board of Adjustment. Final decisions for Variances rests with the Board , of Adjustment and are not forwarded to the Board of County Commissioners as in Rezoning requests. 2 . Hal Johnson, Planning Director , called roll of the members: Charles Adams, Chairman, present; Aweilda Little, Vice Chairman, present; Bill Dorsett, present; Lynden Craven, present; Jim Routh, present; Doyle Stout, present; Phil Brower , present; Arlie Culp, Alternate, present; and Maxton McDowell.., absent . 3 . First Case: Hal Johnson gave a brief summary of the request (side setback variance) before the Board. RAYMOND KENNEDY , Trinity, North Carolina, is requesting a Variance to allow an addition of a garage to his residence approximately 7 feet from his side property line in lieu of the required 10 feet. Property Location : Hwy 62, Trinity Town- ship, Zoning Map #6797 , Zoning District RR. Hal Johnson explained to the Board that this lot was designed prior to any land use plans. Johnson said the Planning Office has received calls in support of this request. Bill Dorsett asked Kennedy why he did not construct his garage in back of this residence instead of to the side. Kennedy said that since retirement he and his wife wanted the convenience of not being exposed to the weather when going to/from the car to the house. Kennedy said that he realized to locate in back of the residence would still be good for the cars but would be of no benefit to him and • his wife. There was no one present in opposition to this Variance . Lynden Craven made the motion, seconded by Doyle Stout, to approve Mr . Kennedy' s request for a side setback Variance because the lot was in existence prior to any land use regulations. The motion passed unanimously. August 14, 1990 Page 1 4 . Second Case: Hal Johnson gave a brief summary of the request (side setback variance) before the Board. WADE VARNER , Thomasville, North Carolina, is requesting a Variance to allow an addition for a carport to his residence approximately 7 feet from his side property line in lieu of the required 10 feet. Property Location : SR 1791 (Ginger Road) , Trinity Township, Zoning Map #6797, Zoning District RR. Hal Johnson explained to the Board that this lot, as in the case of the Kennedy Request, was developed prior to any land use regulations. Johnson added the Planning Office has not received any calls of opposition to this request. Wade Varner said this subdivision was developed in 1962 and he has owned the property for 15 years. Varner said this was the only place he could attach the garage to his residence because the septic tank system is in back and on the other- side of this house. Bill Dorsett asked Varner if he had already begun construction on this addition. Varner answered yes but it was prior to his knowledge of the 10 feet setback requirement . There was no one present in opposition to this request . Doyle Stout made the motion, seconded by Aweilda Little, to approve this request for a side setback Variance because of the lot being in existence prior to our land use regulations. The motion passed unanimously. 5 . Third Case: Hal Johnson gave a brief summary of the request (lot size variance) before the Board. ANTHONY CRAIG GOINS , Asheboro, North Carolina, is requesting a Variance to allow the subdivision of 4 lots among immediate family members fronting on a private drive (lot size variance) . Prpp xty LoQat on : off SR 1144 (Mack Road) , Cedar Grove Township, Zoning Map #7649, Zoning District RA. Craig Goins said that this property was owned by his mother and it was her desire to deed 2.5 acres to each of her four sons. Goins said he presently lives within 50 feet of the new proposed By-Pass 220 (near Seagrove) and he wanted to be able to move away from this area. Goins added that he plans to locate a mobile home on the front tract soon, but the remainder tracts would be vacant for 5 to 10 years. Billy Ludnum, adjoining property owner , spoke in opposition to 4 small mobile home lots being allowed, in this area of nice site built homes. Danny Brower, adjoining property owner , said that this area would be affected by the proposed new Highway 49 Loop and if he is trying to get away from a highway this area would not be for him. Bill Dorsett, Board member , stated that the Board August 14, 1990 Page 2 had not heard any real hardship, just a desire to deed lots to four of the family members. For this reason Dorsett made the motion, seconded by Phil Brower , to deny this request. The motion passed unanimously. 6. Fourth Case: Hal Johnson gave a brief summary of the request (lot size variance) before the Board. CECIL LUTHER Asheboro, North Carolina, is requesting a Variance to allow the subdivision of 3 lots among family members of approximately 4.7 -acres on a private drive (lot size variance) . Prop i ty Location : off SR 1142 (Hopewell Friends Road, Cedar Grove Township, Zoning Map #7639, Zoning District RA. Cecil Luther was present at this meeting and explained his situation to the Board. Luther said this property has been platted for several years on an existing private road. Luther said the road has been in existence for approximately 10 years and he and his son maintains the road. Luther said his plans were to deed the land to his son and two daughters . Luther added there are 4 property owners on this road. Hal Johnson told this Board that this is a unique situation because this would not be a new road, the private road has been in existence for several years . Johnson added that because of development that has occurred no new right-of-way could be obtained to allow state maintenance of the road. Johnson went on to say the road is being well maintained. There was no one present in opposition to this request . Bill Dorsett expressed his opinion that no real hardship has been defined. Lynden Craven stated that seeing no opposition to the request, and the road is in place and has been well maintained, and this is an immediate family situation he did not see a problem with this request. For these reasons Craven made the motion, seconded by Jim Routh, to approve this lot size Variance. The motion passed unanimously. 7 .
