MINUTES
RANDOLPH COUNTY PLANNING BOARD
September 11 , 1990
There was a meeting of the Randolph County Planning
Board on Tuesday, September 11 , 1990 , at 7 : 00 p.m. , in the
Commissioners Meeting Room, in the County Office Building,
707 McDowell Road, Asheboro, North Carolina:
1 . Chairman Charles Adams called to Order the Randolph
County Planning Board meeting at 7:00 p.m.
2. Hal Johnson, Planning Director , called roll of the
members: Charles Adams, Chairman, present; Aweilda
Little, Vice Chairman, present; Bill Dorsett,
present; Lynden Craven, present; - Doyle Stout,
present; JimBD thy__dbsent ; Phil Brower, present;
Arlie Culp, Alternate, present (substituting for
regular member Jim Routh) ; and Maxton_McDowelll.
A1teinate1 absent .
3. Lynden Craven made the motion, seconded by Aweilda
Little, to approve the Minutes of the Randolph
County Planning Board meeting and the Randolph
County Zoning Board of Adjustment meeting of August
14, 1990 . The motion passed.
4 . SPECIAL USE PERMIT REQUESTS :
A: JAMES A LAMBETH , Asheboro, North Carolina,
requested a Special Use Permit to add 1
additional space to an existing mobile home
park located on approximately 11 1/2 acres on
SR 1408 (Hoover Hill Road) , Tabernacle. Town-
ship, Zoning Map #7712, Zoning District RM.
James Lambeth was present at the hearing and
explained to the Board that he would like to
add 1 space to his mobile home park . Lambeth
stated this space would be occupied by his
grandson .
There was no one present in opposition to this
request .
Bill Dorsett, Board member , stated that this
is the cleanest, neatest mobile home park he
has visited since he has been on this Board.
Dorsett added that this is what the County has
been striving for and for this reason Dorsett
made the motion this Special Use Permit be
approved. Lynden Craven seconded this motion
and the motion passed unanimously.
B: HAROLD R. MITCHELL , High Point, North
Carolina, requested a Special Use Permit to
obtain a dealers license and operate a sales
office at his residence located on SR 1617
(Cedar Post Road) , Trinity Township, Zoning
Map #6798, Zoning District RA. (Cars will not
be displayed on this property.)
Harold Mitchell was present at this hearing
and told the Board that the State Department
of Motor Vehicles requires him to obtain an

office (96 sq. ft . ) prior to the issuance of
his Dealers License. Mitchell stated that his
business would be strictly wholesale or
vehicles and there would be no vehicles
displayed on the property. Mitchell added
that there would be no repair of vehicles at
this location.
There was no one present in opposition to this
request.
Lynden Craven made the motion to approve this
request with the following restrictions:
*No display of vehicles on the property
*No automotive repair
Phil Brower seconded this motion and the
motion passed unanimously.
5. REZO 7INg_Up TS :
A: ROBERT E. STROUD , Trinity, North Carolina, is
requesting that approximately 32 .5 acres
located on SR 1303 (approximately 800 ft. east
of SR 1303/SR 1306) , Concord Township, be
rezoned from Residential Agricultural to •
Highway Commercial/Conditional Use. Zoning
Map #6698. It is the desire of the applicant
to construct a 75 ' x 40 ' building to rebuild/
repair heavy duty trucks/parts.
Robert Stroud was present with his Attorney,
Bill Ivey. Ivey addressed the Board stating
Stroud is a businessman from Greensboro who
has owned this tract of land near the
Davidson/Randolph County line for 18 years.
Ivey stated the natural buffer (40 ' to 50 ' ) of
trees would be maintained on the property and
no clearing of trees would be required. Ivey
stated that their would be a temporary
location of large trucks (for parts) on the
property, with a regular basis of removal of
every 30 days. Ivey said this business would
employ 4 people and the building would be
located approximately 150 ' off the State Road.
Aweilda Little asked Stroud to discribed the
amount of traffic this would generate. Stroud
answered approximately 10-15 large trucks
would be worked on a month.
Bill Dorsett asked Stroud to elaborate on the
hours of operation. Stroud answered 5 1/2
days a week from 8-5 pm.
Hal Johnson asked Stroud to describe the
surrounding area. Stroud stated this area has
some residential structures with mainly
farming operations and open land.
Mark Powers, adjoining land owner, expressed
concerns of Stroud' s intentions for the
property if he plans to rezone the entire
tract but only plans to occupy 1/3 of the
property with this business. Powers added his
concerns for the children in the area, and the
added traffic hazards that could occur .
Powers also added that he owns the only
business in the area (which is in Davidson
County) 3 miles down the road.
Whitman Garner , adjoining property owner,
expressed his concerns for the children,

school buses traveling on this road, and the
added traffic hazards.
Steve Nance, adjoining property owner, told
the Board that 21 children reside in the 1/4
mile stretch and 5 school buses travel on this
road. Nance said that with all due respect
�... there is an emotionally disturbed child that
lives in the residence directly in front of
the proposed entrance of this business. Nance
expressed his concerns for the property values
and what effect this type of business may
have.
There were 7 persons present AL1 oppQsition to
this request.
Hal Johnson referenced this area as being one •
of the final proposed sites for the Hazardous
Waste Site for North Carolina (prior to the
two final sites selected out of Randolph) .
Johnson said the County did extensive studies
of this area at that time and ruled this area
as being basically a rural/agricultural
community with no plans for industrial or
commercial development .
Aweilda Little made the motion to recommend to
the Commissioners that this request be denied
because this request would not be in keeping
with the nature of the land uses in this
Community.
Lynden Craven stated that in 1987 this was one
of the reasons (this type of development)
zoning was adopted as a necessary tool to
Craven seconded this motion.
Bill Ivey pointed out to the Board that this
request was not for a large industrial busi-
ness, only for a small repair garage of large
trucks, and that Mr . Powers business
(discussed earlier in the meeting) was more
dangerous (created more traffic) than. this
site.
The motion passed unanimously.
B: JAMES R. CRAVEN , Greensboro, North Carolina,
is requesting that approximately 4.10 acres
located on SR 1952 (Old High Point Street)
approximately 1000 ft. from Hwy 311 , Randleman
Township, be rezoned from Residential
Restricted/Residential Agricultural to Resi-
dential Agricultural/Conditional Use. Zoning
Map #7755. It is the desire of the applicant
to located a single wide manufactured home on
the front portion of the property.
James Craven was present and explained his
intentions of locating a mobile home on the
site for rental purposes prior to the
construction of his residence at this site.
Craven added the income received from this
site would help in the construction of his
home in the future. Craven stated that his
daughter currently lives in a mobile home on
the back portion of this property.
Frances Brown, adjoining property owner ,
stated that it was the Community' s under-
standing that he would construct a house on
this property. Brown stated that Craven' s
daughter had told someone in the Community his
plans were to develop a mobile home park .

Brown added that there are several widows
residing in this area and they do not want to
be frightened by a mobile home park .
Mrs . Allred, neighboring property owner ,
stated that she was against the development of
mobile homes in this area. •
Bobby Conner , adjoining property owner , stated
that he has lived in this area for 26 years
and that this is a nice area that does not
need this type of development.
There Here 15 persons present in opposition to
this request__
Bill Dorsett stated that a mobile home would
be incompatible to this area. Dorsett stated
that he would not be against the temporary
location of a mobile home for the applicant ' s
residence until his home was constructed, but
he would not be for a mobile home to located
on this property just for rental purposes.
For these reasons Dorsett made the motion to
recommend to the Commissioners this request be
denied . Phil Brower seconded this motion and
the motion passed unanimously.
**At this time Bill Ivey re-entered the meeting and asked the
Board to postpone the request (the Commissioners consi-
deration of this request in October) because his client would
not be able to attend the October 1st Public Hearing. The
Board stated the hearing would be postponed.**
C: TRIPLE H ASSOCIATES , Lexington, North
Carolina, (Bill Hedrick, Owner , and Little &
Little, Lanscape Architects) is requesting
that approximately 55 acres out of a 375 acre
tract, located on the west side of SR 1108
(King Mountain Road) , New Hope/Union Township,
Randolph County, Tax Map #7614, Parcel ID

#761400752303, be rezoned from Residential
Agricultural to Heavy Industrial/Conditional
Use. If approved, the Conditional Use
Rezoning will allow the Owner to apply to the
State of North Carolina for a Mining Permit
which would enable on-site milling and removal
of mineral ore deposits.
Steve Pease (Landscape Architect) and Bill
Hedrick (Property Owner) were present at the
meeting and explained there intentions for the
property. Pease presented a site plan to the
Board and discussed preliminary plans of
digging. Pease stated that the traffic would
only be 2-3 cars per day with a maximum of 10
cars . Pease described the State applications
for Mining Permits as very restrictive and
because of all the regulations an applicant is
required to follow, takes approximately a year
to be issued.
Bill Hedrick stated that the milling site
would be used for crushing rocks on-site and
separating minerals. Hedrick stated this is
done by either grinding or concentrated
materials. The minerals would be separated •
from the invaluable portion of ore.
Hal Johnson asked if there would be any
cyanide used in this separation process.
Hedrick stated cyanide is not allow for this
use in the State of North Carolina. Hedrick
said at one time (around the 1840 ' s) there
were approximately 80 to 100 mines in Randolph

County but because of the gold rush in
California these mines were abandoned. The
preliminary exploration of samples has been on
going for 1 to 1 1/2 years now at this site to
see if the site would be feasible Hedrick said
it was not their plans to quarry, the plan is
to obtain quality from this mine not quantity.
Hal Johnson asked if there would be any
federal laws to comply with, with this site
being located in the Uwharrie National Forest.
Hedrick was not sure, but he did tell the
Board that in 1971 Congress passed a law to
encourage mining in national forests.
Hal Johnson asked Pease if he and Hedrick were
aware of Poison Fork Creek being designated by
the State as a High Water Quality (HWQ) stream
and their responsibilities in protecting the
integrity of this Creek. Pease stated that
this operation would have no discharge into
this Creek or its tributaries and the water
would not be damaged in any way.
Hal Johnson asked Pease to describe what a
Reclamation Plan is . Pease stated this is a
Plan required by the State as to how the land
would be left once the mine is no longer
operational . Pease stated that typically
holes left are so large it is not feasible to
fill in so often the holes become lakes.
Pease said these Plans are normally issued by
the State as to the required preparation.
Bill Dorsett asked Hedrick to describe what
types of security measures would be taken to
protect the public' s safety. Hedrick answered
the property would be fenced and posted and
possible someone to guard the area.
Arlie Culp asked when a Mining Permit is
required. Pease stated once 1 acre has been
disturbed.

Pease stated that the main bulk of the permit
is a soil erosion plan.
Bill Hedrick stated that high quality minerals
is being found from this site (such as:
silver , copper, gold, etc. ) .
Jessie Overton, who lives 1 1/2 miles from
site, stated his concerns would be of the
added traffic to this narrow road. Overton
stated trucks could not pass other vehicles on
this narrow road.
Barbara Bulla, Community resident, stated that
this area is used by the U.S . Army for
maneuvers. Bulla stated her concerns of under
ground water systems being effected and road
problems with the very curvy mountain road.
Cecil Bulla, Community resident, expressed his
concerns of traffic hazards.
Jerry Sykes, property owner in the Community,
expressed his concerns of noise because he
plans to construct a home on SR 1109.
June Overton, SR 1109, expressed concerns of
noise level, traffic hazards, road problems,
etc. Overton added that this type of develop
ment would spoil the natural beauty of the
area.

David Bennett, adjoining property owner,
expressed concerns of problems with the water
systems (wells) in this area. Bennett wanted
to- know if he would have any recourse if
chemicals got into the water or if the well
went dry. Bennett added his concerns of the
hours of operation possibly being late at
night and disturbing adjoining residents.
Bill Hedrick stated that he did not want to be
limited to the hours of operation, but he
would not disturb his neighbors. Hedrick
added the noise would be compatible to a
sawmill operation.
Pease stated the owners would be willing to
work with adjoining property owners.
Barbara Bulla stated that as a resident and
taxpayer of Randolph County she realized that
their best chance in stopping this type of
operation would be on a local level (at this
time during rezoning hearings) .
Jerry Brown, father owners adjoining property,
stated that most of the houses in the area are
over 2 miles from this site. Brown added he
would hate to see any man turned down and not
be able to use their property as they wish.

Aweilda Little stated that she thought
possibly the fear (by adjoining property
owners) was early on and if mining is not done
at this site then where. Little stated that
we have to get our minerals from some where.
Little added that this type of operation may
persuade the State to improve the road condi-
tions.
Doyle Stout stated that this is not an easy
decision to make and that he felt the his
intentions for this County would be what would
be best for this Community and for this reason
Stout made the motion to recommend to the
Commissioners that this request be denied .
The motion was seconded by Arlie Culp and the
motion passed with a 6-1 vote with Aweilda
Little voting against the motion.
D: M. G. FOSTER , High Point, North Carolina, is
requesting that approximately .6 acres located
on SR 1627 (Old Thomasville Road) , Trinity
Township, be rezoned from Residential Agricul-
tural to Highway Commercial . Zoning Map
#6798. It is the desire of the applicant to
use the property for commercial development.
M. G. Foster was present and explained to the
Board that he owns a used car sales business
and he plans to use this site for a storage
holding site (over flow from his existing car
lot) . Foster stated a 6 ft. fence would be
constructed on the property. Foster stated
the entire road is going commercial, that
there is a convenience store in the area and a
garage in front of this site.
There was no one present in opposition to this
request.
Bill Dorsett made the motion to recommend to

the Commissioners that this request be
Approved as consistent with the Land Use Plan
for this area. Phil Brower seconded this
motion and the motion passed unanimously.
E: THOMAS MERRITT Pleasant Garden, North
Carolina, is requesting that approximately 2
acres located on SR 2103 (approximately 500 ft
west of SR 2106) , Providence Township, be
rezoned from Residential Agricultural to
Highway Commercial/Conditional Use. Zoning
Map #7778. It is the desire of the applicant
to construct facilities to operate a real
estate office and a fence company with a
storage yard.
Thomas Merritt was present at this meeting and
stated that this building would have the
appearance of a small residential structure
wit a two car garage attached to the back of
this structure. Merritt stated that the
outside storage would be behind this
structure. Merritt stated that if this
venture fails it is his plan to renovate the
building to a residence. Merritt added that
this is a 2 acre site out of approximately 50+
acres that he owns.
There was no one present in opposition to this
request.
Lynden Craven made the motion, seconded by
Phil Brower , to recommend to the Commissioners
that this request be approved . The motion
passed unanimously.
F: BOYD HAYES & WAYNE BRADY , Asheboro, North
Carolina, is requesting that approximately 4 . 3
acres located at the west end of SR 2713
(Trogdon Hill Road) next to Brady Dodge,
Franklinville Township, be rezoned from
Residential Agricultural to Highway
Commercial . Zoning Map #7771 . It is the
desire of the applicants to use the property
for commercial development.
Wayne Brady was present and explained that the
property would be mainly used for future
expansion of his existing dealership, but
there is a possibility of a mobile home sales
lot.
Hal Johnson asked Brady if he planned to
maintain the buffer of trees between the
residences and the commercial development.
Brady answered yes .
Arlie Culp asked Johnson if the request would
be compatible with the Land Use Plan. Johnson
answered the area is planned to be generally
commercial but the main concern of the County
would be to maintain the buffer between
commercial development and residential
development.
Johnson asked Brady what type of access would
this property have. Brady stated that
property would only use an access through the
existing dealership.
Susan Upchurch, adjoining property owner,
expressed her concerns of the soil erosion of
the bank at the back of the property.
Upchurch described the bank as having black
drain pipes coming out of the bank that drains

into the subdivision. Upchurch expressed her
concern of the property values and discussed
the problems the neighborhood has experienced
with the PA System used by the dealership.
Upchurch added she would like to see a buffer
zone maintained to protect the housing
development from visibility.
Johnson stated that the main concerns seem to
be the PA System which Brady agreed to
correct, maintaining a buffer zone (which
Brady agreed to) , and correcting the soil
erosion problems on this embankment (which
Brady agreed to work on and correct) .
Arlie Culp made the motion, seconded by Lynden
Craven, to recommend to the Commissioners that
this request be appy ovgd . The motion passed
unanimously.
G: HAROLD BROWER , Staley, North Carolina, is
requesting that approximately 3 acres (out of
a 20. 3 acres tract) located on Hwy 49 just
north of Hwy 49/SR 2480 , Columbia Township, be
rezoned from Residential Agricultural to
Highway Commercial/Conditional " Use. Zoning
Map #8713. It is the desire of the applicant
to construct a 36 ' x 60 ' building to operate
an automotive supply sales business.
Harold Brower was present at this hearing and
stated this business would employ two people,
there would be no outside storage, and no
automotive repair work from this location.
Frank Lednum, adjoining property owner ,
expressed his concerns of junk vehicles being
located on the premises.
Brower stated that this business would be for
the sale of new parts, no used parts would be
maintained and no junk vehicles would be on
the property.
William Lednum, adjoining property owner, told
the Board this a rural area and he moved to
the country for peace and quiet .
L. W. Conner , adjoining property owner , asked
if there would be a large amount of grading to
locate this building and if this would effect
his taxes.
Brower stated that he would have to grade a
great deal to locate the building on the site.
Hal Johnson stated that it could effect your
taxes if this property was in a predominantly
commercial area, but since this is a type of
low impact development in a rural area Johnson
said he did not feel it would effect the taxes
of adjoining property owners.
Lynden Craven made the motion to recommend to
the Commissioners that this request be
approved with the following restrictions:
*No outside storage
*No repair of vehicles
*No junkyard, just new part sales
Doyle Stout seconded the motion and the motion
passed unanimously.

H: STEVE A. VESTAL , Thomasville, North Carolina,
is requesting that approximately . 65 acre
located on northwest corner of SR 1627/SR
1631 , Trinity Township, be rezoned from
Residential Agricultural to Light Industrial .
Zoning Map #6788. It is the desire of the
applicant to use the property for industrial
purposes .
Steve Vestal was present at this hearing and
stated his plans to construct a brick building
of 2000 - 2500 sq. ft. on this last lot in
Randolph County. Vestal said the lot has been
perked, has access to Davidson Water Co. , and
has a fire hydrant. Vestal described the area
as having mixed development, with Murrow' s
Trucking Company adjoining this lot.
Alvin Clark, adjoining property owner , stated
that the area has residential structures with
approximately 25-30 homes between Old I-85 and
the County line, and there is a church located
across the road from this lot . Clark
expressed concerns of added lights (being a
problem at night) , traffic hazards (in this
curve) , and so much industry being built up
around the church.
Tony Hunt, adjoining property owner , stated
his concerns of possibly a store being on this
rental property that could sell beer , wine,
etc . Hunt expressed further concerns of
traffic problems caused by a bad curve at in
the road at this location. Hunt told the
Board of disturbances the neighborhood has by
truck drivers making so much noise during the
middle of the night.
Steve Vestal (applicant) stated that the homes
built in this area were constructed several
years ago, no residential structures have been
built in this area in over 15 years . Vestal
stated there is a day-care facility, Dillard
Paper Co. , Murrow' s Trucking Co. , Duke Power,
Diamond Motors, etc. Vestal stated he would
admit this people have a valid complaint, but
the problem of the truckers ' noise will not be
solved by not approving this request, because
Murrow' s Trucking will always be at this
location.

Bill Dorsett, Board member , stated the area is
not conducive to residential development, but
the Board could request the applicant add a
Conditional Use to his application to help
control the type of industrial use.
Vestal said it would be difficult for him to
consider a Conditional Use because of his
intentions to lease the building.
Charles Adams stated that he was personally
against more businesses being developed in
this area.
Aweilda Little made the motion to recommend to
the Commissioners that this request be denied
because the County could not guarantee the
development would be compatible with the
surrounding area. Arlie Culp seconded this
motion and the motion passed unanimously.
