Library AN ORDINANCE GOVERNING THE RANDOLPH COUNTY PUBLIC LIBRARY AND PROVIDING FOR ITS BOARD OF TRUSTEES WHEREAS, Chapter 153A of the North Carolina General Statutes authorizes counties operating a library system to provide by ordinance that such system be operated pursuant to Article 14 thereof; and WHEREAS, The Board of Commissioners of Randolph County have been requested by the Randolph County Library Board of Trustees to enact such an ordinance; NOW, THEREFORE, be it ordained and enacted that the Randolph County Library System be operated pursuant to Article 14 of Chapter 153A of the General Statutes of North Carolina, as follows: Section 1. BOARD OF TRUSTEES A. Membership The Randolph County Board of Commissioners shall appoint the Randolph County Public Library Board of Trustees. The Board shall consist of nine Trustees who geographically represent Randolph County. Not more than two Trustees should be appointed from the same census township. Each Trustee shall serve a six-year term. The Trustees shall elect a chairman, vice- chairman and secretary, who will serve two-year terms. Ex-officio (non-voting) members include the County Library Director and Assistant Director; a liaison representing the Asheboro City Council, appointed by their mayor; and a liaison representing the Friends of the Library, appointed by their president. These appointments shall be made annually. B. Meetings The Trustees shall meet on a regular basis with a specific meeting schedule to be determined by the Trustees from time to time as needed. Any Trustee missing three meetings in one year shall relinquish the appointment unless excused by majority vote of the Board of Trustees. Trustees may be reimbursed for mileage to and from meetings at the current County-approved rate and may be paid a meeting fee as set by the Randolph County Board of Commissioners. C. Powers and Duties Trustees serve as a bridge of communication between the community and the library and, as such, should solicit input concerning the library from patrons. The Trustees should, in their role as advocates, aid in presenting the library perspective to local, state and federal lawmakers. Trustees shall approve library policies and should be familiar with Standards for North Carolina Public Libraries. The Trustees, on majority vote may request a performance evaluation of the Library Director from the County Manager. The Trustees shall control and administer the Library Trust Fund as set forth in the resolution adopted by the Randolph County Commissioners on September 1, 1992. The Trustees shall establish a schedule of fines and charges for late return of, failure to return, damage to, and loss of library materials, and shall take other measures to protect and regulate the use of such materials. If any library materials are challenged as being objectionable by any individual or group, and if the challenge is presented in written form through library procedures, the Trustees shall be the final authority concerning the disposition of said materials. Section 2. LIBRARY DIRECTOR A. Progress/Financial Reporting The Library Director or his designee shall present an oral report on progress and change concerning the library at each meeting of the Trustees. The Director shall also submit to the Trustees a quarterly financial report showing budget expenditures. B. Policy Changes The Director shall bring to the attention of the Trustees any recommended changes or additions to current library policies and shall implement in a timely manner any policy changes after approval by the Trustees. Section 3. REPEAL OF PRIOR ORDINANCE The "Library Ordinance," enacted August 4, 1975, is hereby repealed. Section 4. EFFECTIVE DATE This ordinance shall become effective June 7, 1993. Upon motion of Commissioner Kemp, seconded by Commissioner Petty, the foregoing ordinance was passed by the following vote: Ayes: Frye, Kemp, Langley, Petty, Comer Noes: None I, Alice D.
