07JulyPB MINUTES RANDOLPH COUNTY PLANNING BOARD July 7, 2020 The Randolph County Planning Board met on Tuesday, July 7, 2020, in the Courthouse, 145-C Worth Street, Asheboro, NC. Vice-Chair Wayne Joyce called the meeting to order at 6:35 p.m. Jay Dale, Planning Director, called the roll of the members: Reid Pell, Chair, absent; Wayne Joyce, Vice Chair, present; John Cable, present; Keith Slusher, present; Kemp Davis, present; Melinda Vaughan, present; Ralph Modlin, present; and Reggie Beeson, Alternate, absent. County Attorney, Ben Morgan was also present. Dale informed the Vice-Chair that there was a quorum of the members present for the meeting. Joyce called for a motion to approve the consent agenda as presented. Consent Agenda: Approval of minutes from June 23, 2020, Planning Board meeting. Approval of agenda for July 7, 2020, Planning Board meeting. Approval of Special Use Orders for the requests of Hubert Edward Willis, Jr. Approval of Consistency Determination and Finding of Reasonableness and Public Interest for Rezoning Request by Craig and Rebecca Brady. Approval of Consistency Determination and Finding of Reasonableness and Public Interest for Rezoning Request by William A Jarman. Approval of Consistency Determination and Finding of Reasonableness and Public Interest for Rezoning Request by James Michael Long. Cable made the motion to approve the consent agenda with one correction to the June 23, 2020, the Chair was absent for this meeting), with Modlin making the second to the motion. The motion was adopted unanimously. Randolph County Planning Board Minutes July 7, 2020 Page 1 of 14 Joyce called for any old business to be brought before the Board. Hearing none, Joyce asked the Board to move forward with the cases on the agenda. Dale presented the first case of the night along with site plans and pictures of the site and surrounding properties as follows: REZONING REQUEST #2020-00000182 BARRY G AND MELISSA H LAWRENCE, Thomasville, NC, are requesting 11.09 acres located at 7246 Wright Rd, Trinity Township, Tax ID# 6786918575, be rezoned from LI-CU, Light Industrial-Conditional Use to LI-CD, Light Industrial-Conditional District to amend the existing Conditional Use Permit and allow the addition of a 13,000 sq. ft. building for warehouse and manufacturing along with a 38.90% SNIA in Lake Reese Watershed as per site plan. Joyce opened the public hearing and asked if anyone was present to speak in favor of the rezoning request. Barry Lawrence, 7246 Wright Rd., Thomasville, stated that he is obviously there to support the request and would be happy to answer any questions the Board may have. Davis asked what type of industry takes place on the property and what would the proposed building be used for. Lawrence said they do injection moldings and the new building would be used for material storage. Cable asked if there were any hazardous materials involved with the business. Lawrence answered no. Joyce asked about the hours of operation. Lawrence said they have operated 24 hours a day, 5 days a week for approximately 30 years. Davis asked if additional nuisances would be created for the neighbors. Lawrence answered no. Cable asked Lawrence how long he has been in operation. Lawrence said he has been in business for approximately 45 years total, with 30 years at this location. Joyce asked if there was anyone else present to speak in favor of the request. Hearing none, Joyce asked if there was anyone that would like to speak in opposition. James Sheffield, 7182 Wright Rd., Thomasville, said he lives on the adjacent property and has dealt with a lot of issues with Lawrence Industries over the past seven years due to noise, especially during third shift disturbing their sleep and property damage as well as tree loss due to excessive water run-off from Lawrence property. He said he has complained to the County multiple times including the Planning Department and County Commissioners with no results although the County has taken the time to send him a certified letter telling him that he is required to have his property rezoned to park his own Randolph County Planning Board Minutes July 7, 2020 Page 2 of 14 personal work trucks in his yard. Sheffield said after receiving the letter, he checked on the rezoning process and was told he would have to install a 30 ft. buffer of evergreen trees along the property line where it meets residential property to meet regulations and does not understand how Lawrence can run a heavy industrial operation in a residential neighborhood 24 hours a day with no required buffer. Dale proceeded the current buffer requirements. requirements for the hours of operation. Sheffield said the Noise Ordinance states there should be no noise in a residential area after 11 p.m. Dale explained to Sheffield that the Noise Ordinance is enforced by the S and he would have to contact them. Sheffield said he has contacted them forty to fifty times. Sheffield said there was only one building located on the property with a few employees until 2013 and has now increased to over one hundred employees and hundreds of contractors rotating on and off the property, vehicles lining up along his property line at 5 a.m., a boiler system kicking on and off 24 hours a day and a smoking building located next to his home with loud employees, yelling and laughing all hours of the day and night making it difficult to sleep. He said he has video proof of the activity that takes place and has attempted to speak to Commissioner Haywood about bringing it before the Commissioners and has received no response from her. Cable asked Sheffield where his property is located. Sheffield described the location of his property to be located to the house being located closer to Davis asked Sheffield if he operates a business on his own property. Sheffield said he had to move his trucks from his property to prevent a daily fine of five hundred dollars without correct zoning. He said he was told as part of the rezoning, he would have to plant a large buffer so he chose to send the trucks home with his employees and prevent the rezoning requirements and fines. Cable asked if he had discussed the water issues with Mr. Lawrence. Sheffield said he has discussed the problems with him and was promised that it would be fixed and nothing has been done. Sheffield said he feels the Board has already made a decision regarding the request because the building has already been delivered, the concrete pad has already been poured and nothing that can be said to change the outcome. Cable interrupted Mr. Sheffield and told him he disagrees. He said tonight is the first time he has heard about any of this situation and his mind is not made up. Cable told Sheffield that the Board does not come to a hearing with a pre-determination of the outcome and asked for some courtesy to allow them to review the facts. Randolph County Planning Board Minutes July 7, 2020 Page 3 of 14 Sheffield expressed his frustration with the whole process and said would like the opportunity to get sleep at night. He asked if it was normal to have a building delivered, the pad poured and then ask for permission to do so. Dale said it was his understanding that Mr. Lawrence was under the assumption that he had already been approved for the additional building square footage during his previous zoning approval and ordered the building and prepared the site with a concrete pad. He said when Lawrence made application for a building permit for his inspections, he was informed that he would have to come before the Board to amend his existing site plan. through. Sheffield asked for an explanation as to how the boiler system, air compressor, sewage pump, the smoking building and the access drive have all been allowed on his property line without a buffer being required and a 50-ft. no-cut buffer is required along the property line adjoining Southgate Estates as part of the previous Conditional Use permit. He said he feels his rights as a homeowner are being overlooked. Dale said he was not the Planning Director at that time and could not answer his question. Sheffield said he respects the fact that Mr. Lawrence has put a lot of money into the community and provided employment but at the cost of whom. He said he no longer enjoys his home and has bought property in another State to have peace and quiet. Davis asked Sheffield how long he has lived on his property. Sheffield said he moved there around 2011 but has lived on Wright Rd. for 33 years. He said moved into his current home in 2011, it was very peaceful, he never heard noise or saw anyone outside. He on his property without being seen by someone at Lawrence Industries. He said he gets woke up every morning at 5 a.m. because of employees and sub-contractors that pick up materials are lining up along his property line. He said there should be some type of noise buffer required along his property line. Modlin asked Sheffield how much property he owns and how close his home is to the property line of Mr. Lawrence. Sheffield said he owns almost 5 acres and his home is approximately 100 ft. from his property line. (closest to him) is approximately 25 ft. off of his own property line. Sheffield said the with some type of noise buffer to help when there are barrels being thrown around, cars are driving through and when the air compressors and boiler system is turning off and on. Modlin asked if cars park in the drive area along his property line near his home. Sheffield said it is a drive-through where trucks pick up materials, drive further down the property toward the proposed building will be and then drive back up and park toward the front at his property line. Sheffield told the Board that Mr. Lawrence has also had hundreds of loads of dirt brought in for the property with no silk fencing in place to help with water run-off which is causing damage to his property and killing his trees due to flooding. Modlin asked about the elevation of the property in relationship with his. Sheffield said both properties used to be somewhat level at one time and now is about 20 ft. higher. He also said when Lawrence built the first building, he ran the drain tiles from the roof of the Randolph County Planning Board Minutes July 7, 2020 Page 4 of 14 building to the edge of the property where their property adjoins each other causing his property to flood, killing about forty of his trees and causing his pond to double in size due to excess water. Modlin asked Sheffield if the pond shown on their maps were on his property. Sheffield answered yes. Cable asked if the pond was still on the property. Sheffield said yes and has doubled in size over the years due to the run-off from Modlin asked Sheffield if he had reached out to the agency that handles these problems. Sheffield said he has contacted anyone and everyone he can think with no results. He said no one will return calls with information as promised. Cable asked Sheffield if he were given the opportunity to work out an agreement with Mr. Lawrence, what problems would he like to see fixed. Sheffield said there would be some sort of buffer for the noise and the water problems fixed. He said Mr. Lawrence knows what it would take to fix the water issues and has done nothing. Joyce asked Sheffield what type of buffer is requesting. Sheffield said any type of buffer that would help with noise would be acceptable. He said privacy is one thing but noise is totally different. Modlin asked if there was room for a plant screen of some sort. Sheffield said yes although there would have to be adjustments to the driveway. Modlin asked Sheffield about the possibility of putting the planted buffer on his property. Sheffield willing to give up area on his own property and these considerations should have been Joyce asked if anyone else was present to speak in opposition to the request. Hearing none, Joyce asked Lawrence to come forward to address questions and concerns Lawrence said he moved in approximately thirty years ago and Mr. Sheffield bought his property with full knowledge of the business next door. He said the Sherif has been called out three times on Mr. Sheffield for communicating threats and having guns on his property. He also told the Board that Mr. Sheffield is conducting a business on his own property and in violation of zoning which he has never complained about or reported. Lawrence said the water flow and elevations were established in the very beginning and have never changed. He said the only change that has taken place for Mr. Sheffield is his attempt to increase his pond size. He explained the natural flow of water on both properties and told the Board that Mr. Sheffield has raised his pond over a foot prohibiting the water to flow to the front of his property. He said no water is being directed toward Mr. y the natural flow of water. Lawrence said there is no one that shows up for work before 8 a.m. because there is no early morning traffic is untrue. Lawrence said he has tried to be a good neighbor and the neighbors have been good to him as well. He said there were no issues between him and Mr. Sheffield until he refused to purchase when it was offered to him. Randolph County Planning Board Minutes July 7, 2020 Page 5 of 14 Lawrence said Sheffield dug a trench from his pond toward the overflow from the pond from heavy rains to wash toward a retaining wall with intensions of sabotage. Cable asked Lawrence if he had contacted Sheffield to talk to him about these situations and if he had contacted the Planning Department to file a complaint. Lawrence said he has tried to talk with Sheffield but has not filed a complaint against him for running an illegal business on his property. Cable asked Lawrence if he ran a third shift. Lawrence answered yes and said that he had measured noise levels with a decibel reader with no abnormal readings. Davis asked Lawrence which direction the water would flow from his property after construction of the new building. Lawrence said water would flow toward the church, Modlin asked Lawrence if he would be guttering the new building and directing the water away from Sheffield. Lawrence answered yes. Cable repeated , asking if any water would be directed toward Sheffield as a result of the construction for the new building. Lawrence said there would be no water directed Cable asked Lawrence if he would be willing to install some type of buffer to help with noise along the property line. Lawrence told Cable he would not be able to install a buffer there would be enough room where the second building is located due to the drive that runs beside the building and property line. He said he would be able to install a buffer at the property line near the new building although there would be no noise generated from the building because it would be used for storage only. Modlin asked if the drive to the east side of the second building was used for loading materials and asked if there were loading docks on that side of the building. Lawrence said that drive is used strictly for traffic flow from 8:00 a.m. until 5:00 p.m. Modlin asked why that side of the building would have to be used rather than using the left side of the building which is . Lawrence said the Fire Department required them to leave a drive for access in the event of a fire. Dale said he would be willing to work out the buffering possibilities with Mr. Lawrence, leaving the required access for the Fire Department. Lawrence said he would plant some trees even though he feels it will not be beneficial to Sheffield. Cable asked if the drive could be maintained for fire access without being used as a driveway. Lawrence answered yes. Cable said this is the first time the Board has been presented with all of this information and they try to ask questions that will result in a common solution when there are existing problems. He said there looks like there is a possibility of planting some Leyland cypress or some type of buffer that will assist in noise reduction. Lawrence said if he could install Randolph County Planning Board Minutes July 7, 2020 Page 6 of 14 a buffer and still have access for cars to get through, he would be more than happy to install some trees. Cable said the cars can use the drive on the left side of the building, leaving the right side for access in the event of an emergency as it was originally intended. Lawrence said he needs the drive on the right side of the first building. Modlin said the second Lawrence said there is no noise from the second building. Cable asked if most of everything was done in the building located closest to Wright Rd. Lawrence answered yes and said the only activity in the second building is assembly operations with no noise other than fans running for ventilation. Cable asked Lawrence if he would be willing to install Leyland Cypress on his side of the property along the property line from the second building down to the new building to assist with noise reduction as long as the Fire Department is not denied. Lawrence said he did not have any objection with installing the trees as long as it does not restrict the access to the building. Cable said it would be good will toward the neighbor to minimize the noise Dale said the Planning Department would be glad to work with Mr. Lawrence on the buffer requirements. Joyce asked if there were any additional questions for Mr. Lawrence regarding the request. Hearing none, Joyce asked if there was anyone else present that would like to speak in opposition of the request. Hearing none, Joyce closed the public hearing for discussion among the Board members and a motion. Cable said this situation has built up over time and the Board is trying to fix the problems in just a few minutes. He said he would like to go on record again and say mind is made up prior to hearing these cases, he said the Board listens to the arguments, they ask questions and try to come up with solutions when needed. He said in this case, he feels it is important to have some type of buffer to help with noise reduction and do right by both parties. Joyce agreed. Slusher asked Dale if he had received any other complaints regarding this request. Dale notification signs were posted. Sheffield said he had photos that would be arriving in about three minutes that would felt it was only fair they take a look at them. Joyce informed Sheffield that the public portion of the hearing had been closed to allow discussion among the Board members. Modlin asked about the previous approvals Dale said previous buildings requested by Mr. Lawrence required a site plan to request SNIA which was approved. He said although the buildings were not the exact footprint to the site plan, they were still covered under the SNIA approval. He said he feels Lawrence thought this proposed building would also be covered and ordered his building and prepared the building site before realizing that he needed additional approval from the Board. Randolph County Planning Board Minutes July 7, 2020 Page 7 of 14 Modlin asked if changing the original approved site plan would allow the Board to require the current regulations for zoning. Dale said he believed it could. Modlin said if the drive that was mentioned at the second building was only to be used for emergency access, there should be enough room to put a buffer in. Dale said there should be enough room for at least one row of Leyland Cypress. Modlin said Leyland Cypress were outdated and asked not to use those. He said there are a lot of sound deadening plants used by municipalities and NCDOT that work well that can be used. Dale said he would look into it. Joyce said to keep in mind the space needed for the fire truck and the clearance required to access the building when making their decision. Davis asked if it is required as part of the fire code that there be access around that building. Dale said he was not familiar with the fire code requirements. Modlin said he agrees with Cable and would like to help both parties if possible. Dale said in regards to he may have would have to be handled through a State agency such as DENR (Department of Environmental and Natural Resources). Joyce announced to Mr. Sheffield that his three minutes for the arrival of his photos had expired. Cable said he feels the growth of this property can occur and the good neighbor policy can prosper in conjunction with each other. He said he would make a motion based on the installation of a good solid buffer that will be determined and enforced by the Planning Department, to be located at the second building, leaving room for Fire Department access and down the remaining property line past the new building. Cable made the motion to approve the rezoning request to rezone the specified parcel(s) on the rezoning application to the requested zoning district based upon the Determination of Consistency and Findings of Reasonableness and Public Interest statements that are included in the Planning Board agenda, submitted during the rezoning presentation and as may be amended, incorporated into the motion, to be included in the minutes, as well as the site plan(s) with any and all agreed upon revisions, also incorporated into the motion and that the request is also consistent with the Randolph County Growth Management Plan. Slusher made a second to the motion to approve the rezoning request. Joyce called the question on the motion to approve the rezoning request and the motion was adopted unanimously and the rezoning was granted. Joyce informed Lawrence that his rezoning request had been approved by the Randolph County Planning Board and that he would need to work out the buffering requirements as required with Jay Dale. Dale presented the second case of the night along with site plans and pictures of the site and surrounding properties as follows: Randolph County Planning Board Minutes July 7, 2020 Page 8 of 14 REZONING REQUEST #2020-00001665 A PLACE IN THE HEART, INC, Sophia, NC, is requesting that 52.07 acres located on Beckerdite Rd, Back Creek Township, Tax ID# 7734172251, be rezoned from RA, Residential Agricultural and CLOE-CD. Conventional Subdivision Overlay Exclusive-Conditional District to RA-CD, Residential Agricultural- Conditional District to specifically allow the operation of a multi- use conference center with dining, lodging and related activities as per site plan. Joyce opened the public hearing and asked if there was anyone present to speak on behalf of the rezoning request. Mark Trollinger, 350 N. Cox St., Suite 24, Asheboro said he has been involved with this ministry over twenty-five years, serves on the Board of Directors and has been the general contractor for some of their projects. He said an 80 ft. wide strip of land to the left of theirs was gifted to them by the developer of the adjoining subdivision. He said, not realizing there was conditional zoning for the gifted property, they went to obtain a building permit for the proposed building and was informed that correct zoning would be required. He said in addition to the request for that portion of property, they are also requesting that the original tract, currently zoned RA, be rezoned to RA-CD Residential Agricultural- Conditional District, to allow multiple structures as shown on the proposed site plan provided. He said what they are requesting will be less intrusive than its full potential possibilities. Jonathan Helser, 4206 Beckerdite Rd., Sophia, NC, said his father founded the ministry in 1986 and he stepped in as President approximately five years ago. He said he would be glad to answer any questions the Board may have. There was discussion between Helser and Cable about the location of the property that was gifted to the ministry by the subdivision developer. Helser said that his father had built a chicken coop toward the back of the property, which crossed a property line and the developer gifted the property to the ministry to take care of the issue. Cable asked if it had been the intensions or vision of the ministry several years ago to have a conference center which is now all coming together. Helser said had been their intensions and they have been having summer camp there for the last twenty years. He said they also have a small school on the property. Joyce asked if there was anyone else that would like to speak in favor of the request. Hearing none, Joyce asked if there was anyone that would like to speak in opposition of the request. Hearing none, Joyce closed the public hearing for discussion among the Board members and a motion. Cable said he has known of this ministry for over thirty years and it is a great service to the community and a great ministry. Slusher said he is also familiar with the ministry, the request makes sense and there is Randolph County Planning Board Minutes July 7, 2020 Page 9 of 14 no opposition so he would move forward with a motion. Joyce called the question on the motion to approve the rezoning request for A Place in the Heart, Inc. and the motion was adopted unanimously and the rezoning was granted. Dale presented the third case of the night along with site plans and pictures of the site and surrounding properties as follows: REZONING REQUEST #2020-00001681 TANYA RAYLE COOK, Jamestown, NC, is requesting that 4.09 acres located on Cedar Square Rd, New Market Township, Tax ID# 7737648137, Randleman Lake Critical Area, be rezoned from RA, Residential Agricultural to HC-CD, Highway Commercial-Conditional District to allow the operation and eight dump trucks in a proposed 20 ft. by 40 ft. building as per site plan. Property owner: Virginia Cranford. Joyce opened the public hearing and asked if there was anyone present to speak on behalf of the rezoning request. Tanya Cook, 4162 Kivett Dr., Jamestown, NC, and Charles Bailey, 4456 Pliney Farlow Rd., Trinity, NC came to the podium together to present the case. Cook said she has eight working dump trucks and needs a location for parking them as well as an office with a restroom for her employees to check in and out. She said the drivers leave out from the site at around 6:00 a.m. and return around 6:00 p.m. each day. Modlin asked if there would be any storage materials on site such as gravel, sand, and other materials for delivery to different sites. Cook answered no. Davis asked if the property would be used only as a depot for parking her trucks. Bailey answered yes. Davis asked if there would be maintenance done on the vehicles at this location or if that would be done off-site. Bailey said the maintenance will be taken care of off-site. Cable asked if they had outgrown their current location for trucks. Bailey said they are currently parking their trucks in different locations and would like to have them all at one Randolph County Planning Board Minutes July 7, 2020 Page 10 of 14 location. Joyce asked if there would be any outdoor lighting. Cook answered yes. Cable asked what they would be doing to make sure not to disturb the neighbors. Bailey said he has explained their plans to the neighbors on both sides the property and they do rty throughout the day, it is only for parking. Davis asked them if they were aware there is livestock on both sides of the property and if the neighbors had any concerns. Bailey said he was aware of the livestock and the neighbors have no problem with their request. Joyce asked how many days a week they would be in operation. Bailey said it would be five to six days a week. Cable asked if there would be dumping of any materials on the property for hauling to different locations or if it would be for parking only. Bailey said it would be for parking trucks only. Joyce asked if there would be a fuel terminal on the property. Bailey answered no. Cable asked how he planned on protecting the trucks and asked again about speaking to the neighbors. Bailey said there is existing fence on both sides of the property and they would be installing a gate across the entrance. He also said again that he had talked to the neighbors and they do not have a problem with the request. Joyce asked if there was anyone else present that would like to speak in favor of the request. Hearing none, Joyce asked if there was anyone present that would like to speak in opposition to the request. Donna Stanley, 6181 Cedar Square Rd., Archdale, NC said she grew up on Cedar Grove Rd and approximately sixteen months ago, she and her husband built a home across the street from the proposed site to retire and live in the country. She said the property has always been agricultural and would like to see it remain that way. She expressed her opposition to the truck traffic going out at 6 a.m. every morning and her concerns for the commercial trucks on a busy narrow road. Wanda Beasley, 6099 Cedar Square Rd., Archdale, NC, said she grew up on that road as well. She expressed her concerns of noise for the neighbors and safety of the people using the road for horse and bike riding. She said that specific area has had multiple traffic accidents and she is opposed to the request. Davis asked Beasley where she lives in relation to the request. Beasley described it to be on the opposite side of the road, down the street (west of the property). She said she rides her horses in that area and there are just narrow paths available for riding. Modlin asked if she rides horses on the edge of the road. Beasley answered yes. She Randolph County Planning Board Minutes July 7, 2020 Page 11 of 14 said the road is used for cyclist throughout the County as well and she would hate to see it made into a commercial road. She said she feels like they are not in the country anymore, it feels like the city is moving in and taking over. Cable asked if she had heard the testimony that the adjoining neighbors were not in opposition and asked if the opposition was on the opposite side of the road. Beasley said she could only speak for herself but she had talked to multiple neighbors that were not in favor of the request. John Nurney Jr., 6099 Cedar Square Rd., Archdale, said his main concern is the adverse effects the request will have on his property values and asked if anyone could give him insight to his concerns. Dale said the Tax Department would have to answer questions regarding property values. Cable asked Nurney if there was anything that could be done to ease his mind regarding the request. Nurney said if it is approved, he would like for the building to be further back on the property to minimize the noise while trucks are running. Jeff Beasley, 6099 Cedar Square Rd., Archdale, expressed his concerns regarding the entrance to the proposed site because of the blind spots in both directions which have caused multiple accidents in the past. He also expressed his concerns of expanding the business to an unlimited number of trucks and other construction equipment and the potential road damage that can be caused by heavy trucks and equipment. He said his concerns of safety, increased traffic and livestock have already been mentioned by others. Beasley said the existing fence that had been mentioned, is not actually on this property, it is located on the adjoining properties for livestock. He also told the Board that he had been asked by Collin Tomlinson, one of the neighbors that could not attend the meeting, to speak in opposition on his behalf as well. Joyce asked if there was anyone else present that would like to speak in opposition to the request. Hearing none, Joyce asked Cook and Bailey if they would like to address any of the concerns and questions of the neighbors. Cook said neither of them have a problem with it. She also said her trucks would not be seen from the road. Modlin asked how far the trucks would be parked off the road. Bailey said the building would be approximately 250 ft. off the road and the trucks would be parked behind the building. Modlin asked what the building would be used for. Bailey said it would be an office for the employees. Cook said she would not be the only business on that road. She said she hauls for Ace Avant which is located down the road and Davis Feed is also located down the road. Cable asked if she is a sub-contractor for Ace Avant. Cook answered yes. Slusher asked how long she has owned the property. Cook said approximately two years. Joyce asked if the building would have any roll-up doors. Cable said he is familiar with the road and asked if it would be possible for the gate to be placed off the road to help with the blind spots. Bailey said the gate would be set back enough to allow the trucks to pull in off the road. Cable property. Bailey said no. Cook said they are good neighbors. Cable asked what their five-year plan looked like because of the concerns of having even more trucks in the future. Bailey said they have been in business for eleven years and they are comfortable with their eight trucks and the sub-contractors they use. Cable asked if the sub-contractors would be using the property for parking as well. Bailey said the sub- contractors would only be dropping off invoices. Davis asked if there were any existing buildings on the property. Bailey answered no. He said the property was previously approved for a septic system to allow a 14x70 mobile home. Davis asked if the septic permit is still active. Bailey answered yes. He said they planned to use that same permit to allow the bathrooms in the proposed office building. Davis asked if the location of the building was based on the septic location. Bailey answered yes and said the existing trees were considered as well. Davis asked if he would consider moving the building further back on the property if asked to do so. Bailey said he could adjust the location somewhat but the topography and creek would have to be considered as well. Davis asked about the entrance gate. Bailey said it would be located approximately one hundred feet off road to allow a few trucks to enter at the same time and get off road. Davis asked if there would be landscaping at the entrance. Bailey said they would keep everything looking nice. Joyce closed the public hearing for discussion among the Board members and a motion. Davis said the property is in his neighborhood and he has observed the property. He said his concern would be the livestock adjacent to the property but according to the applicant, those neighbors have no problem with their request. He said he does understand the concerns for the neighbors across the road but in this situation, the building is located so far back off the road, the gate is also going to be placed off the road and there will only be a small amount of increased traffic so he would make a motion. Davis made the motion to approve the rezoning request to rezone the specified parcel(s) on the rezoning application to the requested zoning district based upon the Determination of Consistency and Findings of Reasonableness and Public Interest statements that are included in the Planning Board agenda, submitted during the rezoning presentation and as may be amended, incorporated into the motion, to be included in the minutes, as well as the site plan(s) with any and all agreed upon revisions, also incorporated into the motion and that the request is also consistent with the Randolph County Growth Management Plan. Cable made a second to the motion to approve the rezoning request. Joyce informed COOK that her rezoning request had been approved by the Randolph County Planning Board. Having no further business, Joyce called for a motion to adjourn the meeting. Slusher made the motion to adjourn with Vaughan making the second to the motion. Joyce called the question on the motion to adjourn and the motion was adopted unanimously. The meeting adjourned at 8:06 p.m. with 17 citizens present.
