05MayBOA Zoning Board of Adjustment Minutes May 4, 2021 Page 1 of 3 RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT MINUTES May 4, 2021 There was a meeting of the Randolph County Zoning Board of Adjustment on Tuesday, May 4, 2021, at 6:30 p.m. in the 1909 Historic Courthouse Meeting Room, 145-C Worth St, Asheboro, NC. Chairman Joyce called the meeting to order at 6:30 p.m. and welcomed those in attendance. Joyce called for a roll call of the members. Jay Dale, Randolph County Planning and Zoning Director, called the roll of the members.  Reid Pell, Chairman, absent;  Wayne Joyce, Vice Chairman, present;  John Cable, present;  Keith Slusher, present;  Kemp Davis, present;  Melinda Vaughan, present;  Ralph Modlin, present; and  Reggie Beeson, Alternate, present. County Attorney, Ben Morgan, was also present. Dale informed the Chairman there was a quorum of the members present for the meeting. Joyce called for a motion to approve the consent agenda as presented. Consent Agenda:  Approval of agenda for May 4, 2021, Zoning Board of Adjustment meeting. Slusher made the motion to approve the consent agenda as presented with Cable making the second to the motion. The motion was adopted unanimously. Dale presented the case along with site plans and pictures of the site and surrounding properties. VARIANCE REQUEST #2021-00001085 Zoning Board of Adjustment Minutes May 4, 2021 Page 2 of 3 WILLIAM R HARGETT, JR, Asheboro, NC, is requesting a Variance to allow a division of 2,508 sq. ft. from parcel 7659863901 and add to the square footage of parcel 7659872085. Enabling the division will result in parcel 7659863901 becoming smaller than the required lot size as permissible under the literal terms of the Randolph County Unified Development Ordinance. Cedar Grove Township, Tax ID# 7659872085 and 7659863901, Zoning District RE – Residential Exclusive. Property owners include Carson W and Elaine W Shaw (1131 Hayes Dr, parcel 7659863901), and William R and Rachel F Hargett (1121 Hayes Dr, parcel 7659872085). Morgan administered oath to William Hargett. William Hargett, 1121 Hayes Dr, Asheboro, said for years, his neighbor has allowed him to use a portion of her property adjoining his back property line, for the disposal of leaves to prevent having to burn. He said his neighbor recently mentioned the possibility of selling her property and he is not sure a new property owner would allow him to continue using that portion of the property and asked if he could purchase that small corner before she sells. Dale mentioned the property was previously in Asheboro City’s ETJ which the County inherited. Modlin said it appears if the variance was approved and the small section of property is obtained by Mr. Hargett, the remaining neighboring property of Shaw would still be larger than Mr. Hargett’s property. Dale said that was correct and if the County had not inherited the property from Asheboro City zoning, this would not be an issue. Joyce asked if there was anyone else that would like to speak in favor of the request. Hearing none, Joyce asked if there was anyone that would like to speak in opposition to the request. Hearing none, Joyce closed the public hearing for discussion among the Board members and a motion. Cable asked if any septic restrictions needed to be considered for the request. Dale answered no. Beeson said the property lines would appear more natural if the split were allowed. Slusher said when considering the factors required for a variance, there are no issues and he would make a motion. Slusher made the motion to approve the variance from the Randolph County Unified Development Ordinance on the specified parcel(s) on the Variance application, based upon the sworn witness testimony that is included in the minutes, as well as the site plan(s) with all agreed- upon revisions, that unnecessary hardship would result from the strict application of the Ordinance, that the hardship results from conditions that are peculiar to the property, or that the hardship did not result from actions taken by the applicant or the requested variance is consistent with the spirit, purpose, and intent of the Ordinance such that public safety will be secured and substantial justice is achieved. Vaughan made a second to the motion to approve the Variance. Having no further business, Joyce adjourned this meeting for the Randolph County Zoning Board of Adjustment and moved forward with the Randolph County Planning Board meeting.
