Unified Development Ordinance (UDO) Darrell Frye, Chairman David Allen, Vice Chairman RANDOLPH COUNTY Kenny Kidd BOARD OF COMMISSIONERS Maxton McDowell Hope Haywood Randolph County Office Building ■ 725 McDowell Road Hal Johnson, County Manager Asheboro, North Carolina 27205 ■ Telephone 336-318-6300 Ben Morgan, County Attorney Dana Crisco, Clerk to the Board P h i ORDINANCE ADOPTING THE RANDOLPH COUNTY l K UNIFIED DEVELOPMENT ORDINANCE e m p WHEREAS, the North Carolina General Assembly finds that the parallel system of separate , city and county statutes regarding planning and development regulation has led to redundancy and V unintended differences in the wording of planning and development regulations on the same i c subject; and e C h WHEREAS, the intent of the North Carolina General Assembly is to collect and organize a existing statutes regarding local planning and development into a single Chapter of the General i Statutes and to consolidate the statutes affecting cities and counties; and r m a WHEREAS, the intent of the North Carolina General Assembly is to neither eliminate, n diminish, enlarge, nor expand the authority of local governments to exact land, construction, or Ph P money as part of the development approval process or otherwise materially alter the scope of the h local authority to regulate; and i l K WHEREAS, the Randolph County Board of Commissioners intends to provide citizens, e residents, and visitors to the county with adequate light and air; to prevent the overcrowding of m p land; to avoid undue concentration of population; to lessen congestion in the streets; to secure , safety from fire, panic, and dangers; to facilitate the efficient and adequate provision of V transportation, water, sewage, schools, parks, and other public requirements; and to promote the i c health and well-being of the community; and e C WHEREAS, the Randolph County Board of Commissioners intends to continue the practice h a of planning and development regulation in Randolph County; and i r WHEREAS, the Randolph County Planning Board has held public meetings on the proposed m a amendments required by North Carolina General Statute 160D and recommends to the Randolph n County Board of Commissioners that these amendments be adopted: P h i 1. The Randolph County Board of Commissioners does hereby repeal any previously adopted l planning and development regulations and hereby enacts all provisions contained in the K e Randolph County Unified Development Ordinance as reviewed and recommended by the m Randolph County Planning Board. p , V 2. The Randolph County Board of Commissioners does hereby repeal the existing Addressing i Ordinance and the Ordinance is incorporated into the Randolph County Unified c Development Ordinance. e C h a i r m www.randolphcountync.gov a n 3. The Randolph County Board of Commissioners does hereby amend all previously approved Conditional Use Permits, noted on the Official Zoning Maps as “CU” districts, to become Conditional Districts, noted on the Official Zoning Maps as “CD.” THEREFORE, BE IT ORDAINED that the Randolph County Board of Commissioners concludes that the proposed Randolph County Unified Development Ordinance amendments are reasonable and in the public interest because they bring the existing Randolph County Unified Development Ordinance into compliance with applicable North Carolina laws. Additionally, the proposed Randolph County Unified Development Ordinance amendments support the policies and goals in the comprehensive Randolph County Growth Management Plan; and BE IT FURTHER ORDAINED that the changes as required by North Carolina General Statute 160D and recommended by the Randolph County Planning Board are hereby adopted as the Randolph County Unified Development Ordinance and shall take effect and have full power on July 15, 2021. th Adopted this the 15 day of July 2021. ______________________________ (SEAL) Chair, Board of Commissioners ______________________________ Clerk to the Board www.randolphcountync.gov
