Commissioners Meeting Minutes - 10/3/94
The Randolph County Board of Commissioners met in regular session at 2:00 p.m. on October 3,
O1994 in the Commissioners Meeting Room, 725 McDowell Road, Asheboro, NC. Commissioners Kemp,
Langley, Comer, and Frye were present. Commissioner Petty came in where so indicated in the minutes.
Invocation was given by Amos Allen, Asheboro Church of Christ.
Chairman Kemp welcomed Nicole Michaels, reporter for the High Point Enterprise, who is taking the
place of Crystal Baity, who has resigned. Also welcomed was Jason Williams, new reporter for the
Greensboro News & Record.
Changes to the Agenda
Chairman Kemp announced the following changes to the agenda: Or Item H. of the Consent Agenda
becomes Item J. under New Business, and O Add Item K. Closed ! Session - Industrial Expansion under
New Business. '
Consent Agenda
On motion of Comer, seconded by Langley, the Board unanimously approved the consent agenda, as
follows:
• approve the minutes of the September 6, 1994 meeting
• adopt proclamation (ATTACHED) declaring October Family Violence Prevention Month
• adopt proclamation (ATTACHED) declaring October 22-31 Red Ribbon Week
• appoint J.R. Ewing, H.S. Spencer, and Vernal Gibson to the realigned Archdale Planning and Zoning
Board and Board of Adjustment

Firemen's Relief Fund Appointments
Alice Dawson, Clerk, explained that in order to participate in the Firemen's Relief Fund, each fire
department must appoint a 5 -member board of trustees, two of which must be appointed by the County
Commissioners. Each department submitted nominations for the Board's consideration. They are as
follows:

On motion of Frye, seconded by Langley, the board unanimously approved the nominations as
presented. Commissioner Frye asked that Rick Davis, County Fire Marshal, be at the November, 1994
meeting to further explain the responsibilities of the Firemen's Relief Fund Board of Trustees, and that in
Othe future the Board of Commissioners be given more notice before having to make appointments to this
board.
Tolaram Fibers, Inc. Expansion Project
On motion of Frye, seconded by Comer, the Board unanimously approved that $170,000 be
appropriated from the fund balance of the General Fund during the 1994-95 fiscal year to match State of

County Economic Development Corporation (EDC) when requested by the EDC. The Randolph County
EDC will request the funds when Or certification is given by the architect and/or engineer that Tolaram O
Fibers, Inc. is 100% complete and the Certificate of Occupancy has been issued by the City of Asheboro
to the Company; and Wolaram Fibers, Inc. delivers a legally binding statement that their new facility's
Phase One investment, for property tax purposes, shall be no less than $37,000,000. The $170,000 from
the County shall be used to partially reimburse Tolaram Fibers, Inc. for the cost of construction of a rail
spur. The Board of Commissioners, in its discretion, finds that Tolaram Fibers, Inc. will increase the
population, taxable property, and business prospects of Randolph County.
Budget Amendment # 13 - Tolaram Fibers, Inc.
On motion of Frye, seconded by Langley, the Board unanimously approved Budget Amendment #13
(ATTACHED) which reflects O $170,000 appropriated from the Fund Balance payable to the Randolph
County EDC and shall be used to partially reimburse Tolaram Fibers, Inc. for the cost of construction of a
rail spur, and ® $120,000 from the Industrial Recruitment Competitive Fund (usually referred to as the
Governor's Discretionary Fund) which will flow through the County to Tolaram Fibers, Inc.
Commissioner Pett entered the meeting at this oint.

Public Hearing for Cablevision Benchmark Rates and Inflation Adjustment Rates
Chairman Kemp opened a public hearing for Cablevision benchmark rate changes and inflation
adjustment rate changes.
David Harris, Regional Cable TV Administrator, Piedmont Triad Council of Governments, explained O
that the FCC ordered all U.S. cable companies to reduce their rates by 7%. (In May of 1994, the rates
were reduced 10%.) He announced that Time -Warner Cable has complied with all rate regulation rules
and orders and has reduced rates accordingly. He also explained that the FCC allows local cable operators
to request an annual adjustment for inflation, based on changes in the Gross National Product Price Index.
He then read aloud the new proposed benchmark rate schedules and the inflation adjustment rate sche-
dules for both the Asheboro and Archdale cable systems.
Chairman Kemp asked for comments on the new rates.
No one spoke.
Chairman Kemp closed the public hearing.
On motion of Langley, seconded by Frye, the Board unanimously approved (2) resolutions
(ATTACHED) setting new benchmark rates and (2) resolutions (ATTACHED) reflecting inflation
adjustments for both the Asheboro and Archdale cable systems.
Animal Cruelty Investigator ID Badge
Wandora Lewis, Animal Cruelty Investigator, showed a picture of the proposed badge to the Board
and stated that Sheriff Hurley had approved it. O
On motion of Petty, seconded by Comer, the Board unanimously approved the badge design for the
Animal Cruelty Investigator.
Bid Award for Lifepak 11 Monitors for EMS
Patty Sykes, Purchasing Agent, explained that the Emergency Services Dept. has budgeted funds for

the purchase of (2) Lifepak 11 Monitors. Each monitor includes 12-lead EKG capabilities and are
Ocompatible with Lifepak Defibrillators currently.being used by EMS. They are available only from Physio
Control, Inc. at a cost of $7,355.40 each, total purchase, $14,710.80.
Quotes were also received from Southeastern Emergency Equipment on Marquette Responder 1500
equipment. The Marquette Monitor sells for $8,321.05. It includes a defibrillator but no 12 -lead EKG. It
is not compatible with current equipment. In order to use the Marquette model, the County would have
to buy the Marquette Monitor/defibrillator for $8,321.05 plus add a 12 -lead EKG for $4,648.00 for a total
cost of $12,969.05 each (total, $25,938.10). The current Lifepak defibrillators would no longer be
useable. Ms. Sykes requested that the Board award the bid for monitors to Physio Control, Inc., this
being the least expensive alternative for upgrading current equipment.
On motion of Langley, seconded by Petty, the Board voted unanimously to award the bid for (2)
Lifepak 11 Monitors to Physio Control, Inc. at a total cost of $14,710.80.
County Schools Capital Reserve Fund Ordinance
Frank Willis explained that a Capital Reserve Fund must be established for the purpose of
accumulating funds to pay debt service on a financing plan that will pay for the following Randolph
County Schools construction projects: Coleridge Elementary, Tabernacle Elementary, Level Cross
Elementary, Maintenance Garage. An initial amount of $411,550 will be transferred from the General
Fund into this Capital Reserve Fund.
On motion of Frye, seconded by Petty, the Board unanimously approved the Randolph County
Schools Capital Reserve Ordinance (ATTACHED).
Anulication for Voter Registration Grant for Implementation of National Voter Registration Act of
1993
Maria Bliss, Board of Elections Supervisor, explained that Randolph County is eligible to apply for a
one-time grant-in-aid program for the implementation of the National Voter Registration Act of 1993.
Ms. Bliss stated that the grant would also increase the efficiency of the Elections office in preparing for the
advent of a statewide voter registration system to which the Randolph County office would be connected
and would also fund a personal computer network system which the State Board of Elections has stated
would be required in the future. The total grant amount that the Randolph County Board of Elections
office is requesting is $17,054.
Ms. Bliss also explained that an additional 25% may be requested to be allocated to the agencies
required to participate in voter registration activities by mandate of the National Voter Registration Act of
1993, these agencies being Randolph County Dept. of Social Services and Randolph County Health Dept..
On motion of Petty, seconded by Frye, the Board unanimously approved the Voter Registration Grant
Application, including the proposed budget.
On motion of Langley, seconded by Petty, the Board unanimously approved the additional 25% to be
Oadded to the grant application to be allocated to the Dept. of Social Services and Health Dept. to aid in
voter registration activities.
Critical Habitat
Walter Sprouse, President, Randolph County Economic Development Corporation, announced that
the N.C. Wildlife Resources Commission (WRC) has established a rule that could lead to severe limits on

economic development across wide stretches of North Carolina in order to protect streams and rivers that
harbor rare freshwater mussels and clams. The critical habitat rule would require 12% impervious O
coverage. If the rule remains in effect, 93% of Randolph County would fall under the 12% impervious
coverage.
North Carolina Citizens for Business and Industry (NCCBI) is objecting to the critical habitat rule and
has sought an opinion from the N.C. Rules Review Commission, which concluded that WRC lacks
authority to promulgate the regulation. The WRC, however, will publish the rule in the December issue of
the N.C. Register. This will allow opponents with good standing to file suit in Wake County Superior
Court. The filing deadline is 12/22/94. The N.C. League of Municipalities and the N.C. Economic
Developers Association are expected to sue.
The Board asked Mr. Sprouse to have Craig Bromby, N.C. Citizens for Business and Industry, come
to the November 7, 1994 Commissioners meeting to update and advise the Board on this matter.
Rezoning Public Hearing
At 4:00 p.m. the Board adjourned to a duly advertised public hearing to consider rezoning requests.
Hal Johnson, Zoning Administrator, presented the following requests:
1. Paul Staley, Julian, North Carolina, is requesting that 39 acres located on Shiloh Road, Liberty
Township, be rezoned from Residential Agriculture to Residential Restricted in order to develop an 8 lot
restricted subdivision. The Planning Board recommended approval of this request.
2. Gerald Parker, Greensboro, North Carolina, is requesting that 19 acres located on Mount Lebanon O
Road, Union Township, be rezoned from Residential Agricultural to Residential Restricted in order to
develop a restricted 11 lot subdivision. The Planning Board recommended approval of this request.
3. Lee Roberts, Asheboro, North Carolina, is requesting that 38 acres located on Wayne White Road,
Providence Township, be rezoned from Residential Agricultural to Residential Restricted in order to
develop a 20 lot restricted residential subdivision. The Planning Board recommended approval of this
request.
4. LARCO Construction, Winston-Salem, North Carolina, is requesting that 10 acres located off Bus.
Hwy 2205, Richland Township, be rezoned from Residential Agricultural to Heavy Industrial/Conditional
Use in order to operate a temporary asphalt plant. The Planning Board recommended approval of this
request.
5. Jeff Crotts, Sophia, North Carolina, is requesting that 3.85 acres located at 5742 Branson Davis
Road, New Market Township, be rezoned from Residential Restricted to Residential Agricultural/ Condi-
tional Use in order to place a 1973 single -wide mobile home on the property. The Planning Board
recommended approval of this request.

OPat Waugh, 3517 Wayne White Road, adjoining property owner, said she had lived there 34 years,
has 110 acres, and raises cows and chickens. She said it should be kept rural. The road already has a
trailer park and a housing development on it.

Ken Allee, appraisal assistant, spoke in support of the request. He said DOT will require them to
reclaim all land as they found it.

Commissioner Frye expressed concern regarding density and the number of subdivisions being built
more quickly than we can build schools to accommodate the rapidly increasing population, especially in
the northern part of the county.
Closed Session
On motion of Frye, seconded by Petty, the Board voted to go into closed session at 4:50 p.m. to
discuss industrial expansion, pursuant to N.C.G. S. 143-31& 11(a)(4).
At 5:10 p.m. the regular session reconvened. No action was taken concerning closed session.
Budget Amendment- Elderly & Handicapped Transportation Assistance Program Grant
On motion of Frye, seconded by Petty, the Board unanimously approved Budget Amendment #14,
(ATTACHED) which reflects $37,951 from the North Carolina Department of Transportation to be used
to provide additional trips for the elderly and handicapped citizens of Randolph County.

PROCLAMATION
FAMILY VIOLENCE AWARENESS MONTH
WHEREAS, family violence continues to be one of the fastest growing
violent crimes in North Carolina and the United States and affects persons
of any age, ethnic group and social status; and
WHEREAS, family violence is a public health issue, with twenty years
of data indicating that physical and sexual violence against women is an
enormous problem; and
WHEREAS, Family Crisis Center delivers a valuable service to victims
and other citizens by sponsoring educational programs on prevention and
providing a safe place to stay for abused women and their children.
OTogether with law enforcement, social services and other agencies, they
work to protect citizens from becoming victims of violence.
O
NOW, THEREFORE, the Randolph County Board of Commissioners does
hereby proclaim October as Family Violence Awareness Month in Randolph
County, and urges all citizens to learn more about the problem of family
violence and insidious violent crimes.

RED RIBBON CAMPAIGN PROCLAMATION
Whereas, alcohol and other drug abuse in this nation has reached
epidemic stages; and
Whereas, it is imperative that visible, unified prevention
education efforts by community members be launched to eliminate the
demand for drugs; and
Whereas, THE NATIONAL FEDERATION OF PARENTS FOR DRUG FREE YOUTH,
INC., a national parent/community organization, and Randolph County are
sponsoring the National Red Ribbon Campaign offering citizens the
opportunity to demonstrate their commitment to drug-free lifestyles (no
use of illegal drugs, no illegal use of legal drugs); and
Whereas, the National Red Ribbon Campaign will be celebrated in
every community in American during "Red Ribbon Week," October 22 -October
31, 1994; and
Whereas, business, government, parents, law enforcement, media,
medical, religious institutions, schools, senior citizens, service
organizations, and youth will demonstrate their commitment to healthy,
drug-free lifestyles by wearing and displaying Red Ribbons during this
week-long campaign; and
Whereas, the community of Randolph County further commits its
resources to ensure the success of the Red Ribbon Campaign;
Now, therefore, be it resolved, that the Randolph County Board of
Commissioners does hereby proclaim October 22 -October 31, 1994, as RED
RIBBON WEEK, and encourages its citizens to participate in drug
prevention education activities, making a visible statement that we are
strongly committed to a drug-free community.
Be it further resolved, that the Randolph County Board of

BE IT ORDAINED by the Randolph County Board of Commissioners that
the Randolph County Budget Ordinance for the Fiscal Year 1994-1995,
which was adopted on June 27, 1994, be amended as follows:
Section 1. The following appropriations shall be made:

WHEREAS, the County of Randolph has been duly certified to regulate

requesting an increase in rates for inflation; and
WHEREAS, aforementioned FCC forms submitted by TIME -WARNER CABLE have
been examined by the Piedmont Triad Council of Governments in accordance
with an agreement between the Council of Governments and the County of
Randolph; and
WHEREAS, the calculation of rates for basic cable programming
O services, is consistent with the applicable rate calculation rules;

WHEREAS, the County of Randolph has been duly certified to regulate
cable rates for TIME -WARNER CABLE outside the municipal limits in its
franchised area of the County of Randolph; and
WHEREAS, the BOARD OF COMMISSIONERS OF RANDOLPH COUNTY has held a
public hearing for the purpose of receiving public comment on SETTING
MAXIMUM INITIAL PERMITTED RATES FOR REGULATED CABLE SERVICES for
TIME -WARNER CABLE; and
WHEREAS, on August 31, 1994, TIME -WARNER CABLE filed an FCC Form

OCAPITAL RESERVE ORDINANCE
(Randolph County Schools)
BE IT ORDAINED by the Board of Commissioners of Randolph County, North
Carolina that the following Capital Reserve Fund is hereby established:
Section 1. The Board of Commissioners hereby creates a Capital Reserve Fund
for the purpose of accumulating funds to pay DEBT SERVICE on a
Financing Plan that will pay for the following Randolph County
Schools construction projects: Coleridge Elementary, Tabernacle
Elementary, Level Cross Elementary, Maintenance Garage.
Section 2. This fund will remain operational for a period not to exceed seventeen
fiscal years (beginning July 1, 1994 and ending June 30, 2011).
Section 3. A transfer of money from the General Fund and the accumulation of
interest earned will serve as sources of revenue for the Capital
O Reserve Fund. The Randolph County Board of Commissioners will
transfer money from the General Fund to the Capital Reserve Fund in
accordance with the following schedule:

Section 4. The Randolph County Finance Officer is hereby granted the authority O
to withdraw from the Capital Reserve Fund the amount required to
pay the annual DEBT SERVICE (both principal and interest) on the
Financing Plan referred to in Section 1.
Section 5. This Ordinance shall become effective upon its adoption.

CLOSED SESSION MINUTES
October 3, 1994
At 4:50 p.m. the Board went into closed session to discuss matters relating
to the location or expansion of business in the area served by this body,
pursuant to NCGS 143-315.11(a)(4). Commissioners Kemp, Frye, Langley, Petty,
and Comer were present. Also present were Frank Willis, County Manager; Alice
Dawson, Clerk to the Board; Walter Sprouse, President of the Randolph County
Economic Development Corporation.
Mr. Sprouse advised the Board that the contractor for Southcor has
requested incentives from the County. They are building a $10,000,000 plant in
phase one, which will employ 40-45 people. Phase two is a $2,000,000 warehouse.
Mr. Sprouse stated that he had never promised them anything. He also noted that
a portion of this property is in the City.
The Board instructed Mr. Sprouse to obtain specific information on what
incentives the contractor for Southcor is asking for and how much of the
property is in the City and to bring that information back to the November 7
meeting.
