11/05/84RANDOLPH COUNTY BOARD OF COMMISSIONERS MINUTES November 5, 1984 The.Randolph County Board of Commissioners met in regular session at 2:00 p.m. on November 5, 1984, in Courtroom B of the County Courthouse, Asheboro, NC. Present were Chairman Darrell Frye, Floyd Langley, Kenyon Davidson, Richard Petty and Richard Pugh. Chairman Frye opened the meeting with invocation. On motion of Kenyon Davidson, seconded by Floyd Langley, the minutes of the October 1 meeting were unanimously approved. Billy Chilton, Tax Supervisor, gave a report on changes he is recommending for personal property valuation. The Commissioners, without formal vote, supported these changes. Copy of report included by reference. On motion of Richard Pugh, seconded by Richard Petty, the Commissioners unanimously approved a proclamation of appreciation for Hilda Bulla, Veterans Service Officer, who is retiring November 30, 1984. Copy included by reference. On motion of Richard Pugh, seconded by Richard Petty, the Commissioners unanimously approved the addition of the following streets to the State System of Roads: Canterbury Trail and Carriage Lane in Briarcliff Subdivision; Red Fox Trail, Forest Lake Drive and Dogwood Drive in the Lake Forest Estates Subdivision; Linda Lane and Mountain View Drive in the Mountain View Farms Subdivision. Copies of resolutions included by reference. On motion of Richard Pugh, seconded by Floyd Langley, the Commissioners unanimously approved the addition of the class of Health Care Technician I and the class of Rehabilitation Therapy Aide to the County Pay Plan. On motion of Floyd Langley, seconded by Kenyon Davidson, the Commissioners adjourned to a public hearing at 2:30 p.m. for the purpose of naming six roads in Piedmont Estates. No one was present to speak for or against the proposed names. The hearing closed at 2:31 p.m. On motion of Floyd Langley, seconded by Kenyon Davidson, the Commissioners unanimously approved the following names for streets in Piedmont Estates, Climax area: Piedmont Street (SR 2529); Nance Drive (SR 2530); Frank Street (SR 2531); Pepperidge Road (SR 2532); George Road (SR 2400); Sunrise Avenue (not on the State System). Chairman Frye advised those present that a year ago the Commissioners had established a water task force to study the County's involvement in extending water to industries and to consider the water needs of Randolph County and what could be done to address those needs. Mr. Frye further stated that the Water Task Force had been approached by Evan Minier, consulting engineer in Asheboro, with a proposal for a county water system. The Water Task Force felt, after hearing Mr. Minier's proposal, that the Commissioners should hear it. r Mr. Minier presented his proposal for a county water system which would establish water districts and which would utilize water supply from the City of Asheboro and Town of Ramseur. Mr. Minier recommended financing the project with funds from the local option one-half cent sales tax. Projected cost for Phase I of this project is $6.5 million. On motion of Richard Pugh, seconded by Richard Petty, the Commissioners unanimously voted to proceed with a feasibility study and to approve the concept of Mr. Minier's proposal. Commissioners Minutes November 5, 1984 Page 2 A discussion followed concerning the obligation to allow more than one firm to present a proposal for a feasibility study. The Board instructed the County Manager to contact other firms. On motion of Richard Pugh, seconded by Kenyon Davidson, the Commissioners unanimously voted that firms must present their cost of a feasibility study based on the concept presented by Mr. Minier and that bids must be presented at the December meeting. On motion of Richard Petty, seconded by Richard Pugh, the Commissioners adjourned to a scheduled public hearing at 4:00 p.m. Hal Johnson, Planning Director, presented a request from Howard Realty, which was continued from the Commissioners' last meeting. At the Commissioners' request, the Planning Board reviewed the request again last week and made the following recommendations: 1. Rezone the entire 20 -acre tract from Residential -Suburban to Light Industrial. 2.. Using the the Tax Department air photograph taken in 1982, allow the following for automotive salvage and storage: A. No cars can be stored within 400 feet of Uwharrie Road. B. Beginning at the 400 -foot setback from Uwharrie Road, that portion of the property to a depth of 400 feet and a width of 400 feet can be used for automotive salvage and storage. C. Any automobiles that are currently be stored outside of this area must be removed to within the 400 -foot area mentioned above. It is the intent of this Conditional Use Permit not to allow stored automobiles to be placed on top of each other or "stacked." D. An 8 -foot chainlink fence with green vinyl plastic slats placed within the chainlink in a manner as to restrict view of adjoining property shall be installed next to property being used for residential purposes. The fence shall be placed along the borders of the property being used for junk vehicle storage. E. No automotive storage shall be placed within 50 feet of an adjoining property line whthout the screening fence being installed. F. Existing trees and foliage connected to adjoining property shall be left in place to provide additional natural screening and buffer areas. Chairman Frye asked those in favor of the rezoning request to speak. Bob Wilhoit, attorney, 200 Worth Street, Asheboro, spoke in representation of Howard Realty. Mr. Wilhoit stated that Mr. Howard has agreed to the screening and foliage restrictions placed by the Planning Board and that he is trying to cooperate fully. He requested that a reasonable time period be allowed to complete the removal of cars from the specified area. Commissioner Pugh asked him to define "reasonable time." Mr. Howard said that it would take 60-90 days since winter and the rainy season are approaching. Chairman Frye advised Mr. Howard that this same time period will be allowed for the construction of a fence. Commissioner Petty asked Mr. Howard how long he had been located at this site and Mr. Howard stated that he bought the property in 1978 and started his business immediately. Chairman Frye asked those opposed to the rezoning request to speak. Ernest Williams, Route 5, Box 119, High Point, stated that the restriction of foliage protects him only half the year, when the leaves are on the trees; furthermore, much foliage has been cleared out already to build a garage. He felt a fence should be placed on the front side, too. Douglas Weant, Route 5, Box 110, High Point, told Commissioners that the junkyard was placed on this property after after the zoning ordinance came into effect and that the aerial photograph was taken in 1982, after the time period being discussed. Commissioners Minutes November 5, 1984 Page 3 Mr. Johnson presented the next rezoning request. Mr. Reid A. Shaw, Asheboro, requested that approximately li acres located on the south side of Dixie Drive across from Randolph Mall, to west of Weeks and Andrews Co., east of Thomas Tire Co., Tax Map 85;Lot 7D; 01-08650 (southern portion only); Asheboro Township, be rezoned from Environmental District 2 to Commercial -Environmental Zoning District. The Planning Board recommended approving this request. Chairman Frye asked those in favor of this request to speak. Wes Moser, attorney, 230 E. Salisbury Street, Asheboro, explained that a portion of this lot is in Asheboro's zoning jurisdiction and the southern part is in the County's zoning jurisdiction. Mr. Moser displayed a map of the Shaw property and pointed out that the surrounding area is zoned for business. No one spoke in opposition to Mr. Shaw's rezoning request. The public hearing was adjourned and regular session reconvened. Concerning the Howard property, Chairman Frye felt the Planning Board's.wording was vague in reference to stacking of cars. He suggested changing the word "intent" to "shall not allow stacking of cars. There was general discussion about requiring a fence with plastic strips on all four sides of the junkyard, but it was decided that the expense would be too great. Mr. Howard offered to put up a steel cable around the designated area. It was the consensus of the Board that 90 days would be sufficient for Mr. Howard to abide by the conditions placed on the rezoning request. On motion of Richard Petty, seconded by Floyd Langley, the Commissioners unanimously voted to approve the Planning Board's recommendations and to change "intent" to "shall not" stack cars and to require that shrubs be set out on the front side parallel to Uwharrie Road. On motion of Kenyon Davidson, seconded by Richard Pugh, the Commissioners unanimously voted to approve the Planning Board's recommendations to rezone the Reid Shaw property to Commercial -Environment. Janice Scarborough of Randolph Community Services gave an update on the proposed Community Action Program for Randolph County. She was not able to meet with Davidson County's Community Action Program Board because the meeting was canceled. Ms. Scarborough advised the Commissioners that the law has been changed regarding this program and that in 1985 there will be some money available to create new agencies. Lester Moore, Director for the Division of. Economic Opportunity, Department of Natural Resources and Community Development, feels that Randolph County may qualify for our own agency, even though we do not quite meet the population requirement of 100,000. (We now have 94,563.) A letter from the State will be sent out to the counties in January giving the guidelines for creating new agencies. Mr. Moore had advised Randolph County to request State funds because he has already started the paperwork. If Randolph gets the State funds, administered by Randolph Community Services, then Randolph Community Services will have to change their charter. The Commissioners would designate four people to serve on their Board of Directors. After discussion, the Commissioners decided to table this matter until the January meeting and requested that Ms. Scarborough proceed with discussions with Davidson County's Community Action Program Board. On motion of Richard Petty, seconded by Kenyon Davidson, the Commissioners unanimously approved the reappointments of Addison Penfield (Consumer), Billie Vuncannon (Provider), and Floyd Langley (Commissioner) to the Piedmont Health Systems Agency Board of Electors. On motion of Kenyon Davidson, seconded by Richard Petty, the Commissioners unanimously approved two budget amendments presented by Frank Willis. Copies included by reference.
