RANDOLPH COUNT'Y COMMISSIONERS
August 5, 1985
The Randolph County Board. of Commissioners met in regular session at 2:00 p.m.
on August 5, 1985 in Courtroom B, County Courthouse, Asheboro, NC. Commissioners
Frye, Langley, and Davidson were present. Commissioners Comer and Petty were absent.
Invocation was given by Dr. John Gamble of Fayetteville Street Baptist Church.
On motion of Langley, seconded by Davidson, the minutes of the July 8 meeting
were approved.
On motion of Davidson, seconded by Langley, Giant Oaks Subdivision was approved
for addition to the State System of Roads. Copy of resolution included by reference.
On motion of Langley, seconded by Davidson, a proclamation of appreciation for
Brent Hanner on her retirement was adopted. Copy included by reference.
On motion of Davidson, seconded by Langley, Doyle Stout was reappointed to a
three-year term on the Randolph County Planning Board.
On motion of Langley, seconded by Davidson, capital reserve ordinances were
adopted for Randolph Technical College and for the jail. Copies included by reference.
Marion Smith, Director of Social Services, came before the Board to request a
new position on a temporary basis in the AFDC program. He explained that most of
the workers in that program are new, many more applications are being processed
than last year, and they will have to pay penalties if applications are not processed
within the alloted time period. On motion of Langley, seconded by Davidson, the
Board agreed to add a temporary position in AFDC.
The Board discussed a bill introduced by Senator Craven to create a correctional
facilities finance authority. This matter was tabled until the September meeting.
On motion of Langley, seconded by Davidson, the Board adopted a resolution to
dispose of surplus property. Resolution included by reference.
On motion of Langley, seconded by Davidson, the Board agreed to support
Montgomery County in its efforts to have Highway 134 extended to Rockingham.
The Board held a general discussion of the Garcia decision, a supreme court
decision which brought local government under the Fair Labor Standards Act, known
as the Federal Wage and Hour Law. The effect of this decision is that state and
local governments will have to begin paying overtime to those employees not exempted
from this law. Major Larry Emerson spoke on the effect this law will have on the
Sheriff's Department. Neil Allen spoke on the effects to Emergency Services.
The Commissioners set their September meeting for September 9.
The Board discussed the noise ordinance introduced by County Attorney Ed Gavin
at the July meeting. Citizens in the audience requested to speak concerning noise
problems in the county. Margie Harvell, Route 2, Trinity, stated that in her trailer
park there is constant loud music, even during the night. She cannot relax or sleep
because she can't drown out the noise. She has aked the people to turn down the
music, but they won't. Armetta Robbins of Ramseur is in a trailer park and has
experienced the same problems with loud music and motorcycles. She has asked the
offenders to stop. They have harrassed her and her husband and have threatened to
burn down their trailer if the Robbins take legal action. Attorney Gavin and Major
Emerson emphasized that a noise ordinance in itself will not be a deterrent to
noise offenders. Citizens must be willing to take out a warrant and to testify in
court. On motion of Davidson, seconded by Langley, the Board unanimously adopted
the proposed noise ordinance. Copy included by reference.

WHEREAS, the County of. Randolph has in its possession the
attached list of surplus property.
AND, WHEREAS, the County of Randolph deems it advisable
to dispose of this property;
NOW, THEREFORE, BE IT RESOLVED that the sale of this
property be authorized by the Board of Commissioners of: the
County of Randolph for the 21st day of September, 1985 at
10:00 a.m. in the parking lot of. the Randolph County Courthouse.

AMENDMENT TO THE
RANDOLPH COUNTY BUDGET ORDINANCE
FISCAL YEAR 1985-1986
WHEREAS, the Randolph County Budget Ordinance for the Fiscal Year 1985-1986
was adopted by the Randolph County Board of Commissioners on June 24, 1985 and;
WHEREAS, it is deemed necessary to make amendments to this Ordinance;
NOW, THEREFORE, BE IT RESOLVED that the following necessary amendments be
modified in the Budget Ordinance for Fiscal Year 1985-1986:

WHEREAS, the Department of Transportation has investigated
Giant Oaks Subdivision (Plat Book 19, Page 33); and
WHEREAS, the subject streets have been found to meet
minimum requirements for addition;
NOW, THEREFORE, BE IT RESOLVED by the Randolph County
Board of Commissioners that Giant Oaks Subdivision be added to
the State System of Roads.

RANDOLPH COUNTY BOARD OF COMMISSIONERS
CAPITAL RESERVE ORDINANCE
(Randolph Technical College)
BE IT ORDAINED by the Board of Commissioners of the County
of Randolph, North Carolina that the following Capital Reserve
Fund is hereby established:
Section I. The Board of Commissioners hereby creates
a Capital Reserve Fund for the purpose of
the acquisition of land and buildings for
Randolph Technical College.
Section 2. The Randolph County Board of Commissioners
will make appropriations from this fund to
Randolph Technical College in order to
enable Randolph Technical College to
exercise an option to purchase land and
buildings currently being leased from Vend -
A -Matic, Inc. under the provisions of a
contract entered into on the 4th day of
February, 1985.
Section 3. This fund will remain operational for a
period not to exceed five fiscal years
(beginning July 1, 1985 and ending June
30, 1990) or until a cumulative sum not
to exceed Four Hundred Thousand Dollars
($400,000.00) has been accumulated..
Section 4. The Randolph County Board of Commissioners
will transfer an amount of no less than
Sixty Thousand Dollars ($60,000.00) each
fiscal year to this fund.
Section 5. A transfer of money from the General Fund
and the accumulation of interest earned
will serve as sources of revenue for the
Capital Reserve Fund.
Section 6. This Ordinance shall become effective
upon its adoption.
Upon. motion of Commissioner Floyd Langley , seconded
by Commissioner Kenyon Davidson the foregoing Ordinance
was passed by the following vote:

CAPITAL RESERVE ORDINANCE
(Jail Renovation)
BE I1' ORDAINED by the Board of Commissioners of the County
of Randolph, North Carolina ,that the following Capital Reserve
Fund is hereby established:
Section 1. The Board of Commissioners hereby creates a
Capital Reserve Fund in order to accumulate.
money that: will be used for the purpose of
making necessary renovations and additions
to the Randolph County jail.
Section 2. This fund will remain operational for a
period not to exceed seven fiscal years
(beginning July 1, 1985 and ending June 30,
1992).
Section 3. It is estimated that One Million One Hundred
Thousand Dollars ($1,100,000.00) will be
accumulated in this fund for the purpose of
making necessary renovations and additions
to the Randolph County jail.
Section 4. A transfer of money from the General Fund
and the accumulation of interest earned will
serve as sources of revenue for the Capital
Reserve Fund as follows:
The Randolph County Board of Commissioners
will appropriate from the General Fund Sixty
Thousand Dollars ($60,000.00) for each of
the first five fiscal years (beginning July 1,
1985 and ending June 30, 1990) and One Hundred
Twenty Thousand Dollars ($120,000.00) for each
of the last two fiscal years (beginning July 1,
1990 and ending June 30, 1992) to this Capital
Reserve Fund;
The Randolph County Board of Commissioners
will transfer accumulated court facility fees
money from the General Fund to this Capital
Reserve Fund under the provisions of G.S. 7A -
304(a)(2) in accordance with its availability.
It is estimated that One Hundred Thousand
Dollars ($100,000.00) will be available in the
1985-86 fiscal year and Twenty -Five Thousand
Dollars ($25,000.00) will be available for each
of the last six fiscal years (beginning July 1,
1986 and ending June 30, 1992);
It is estimated that Three Hundred Ten Thousand
Dollars ($310,000.00) will be provided from
interest earned in the Capital Reserve Fund.
Section 5. This Ordinance shall become effective upon its
adoption.
Upon motion of Commissioner Floyd Langley , seconded
by Commissioner Kenyon Davidson , the foregoing Ordinance
was passed by the following vote:
