C020695 FT County Attny_1q0A RANDOLPH COUNTY COMMISSIONERS CLOSED SESSION MINUTES February 6, 1995 At 12:30 a.m. the Board went into closed session to consider the qualifications, competence, performance, character, fitness, conditions of appointment, or conditions of initial employment of an individual public officer or employee or prospective public officer or employee; and also to establish or instruct the staff or agent concerning the negotiation of the price and terms of a proposed contract concerning the acquisition of real property, pursuant to NCGS §143-318.11(a)(5)(6). Commissioners Kemp, Frye, Davis, Holmes and Comer were present. Also present were Frank Willis, County Manager; Alice Dawson, Clerk to the Board; Alan Pugh, County Attorney; Hal Scott, Jr., County Personnel Director; and Billy Chilton, Tax Assessor. Chairman Kemp explained that the County had advertised for a full-time county attorney position and that five candidates were interviewed. One candidate had county government experience and was offered the position. He declined Randolph County's offer. It was the consensus of the Board not to hire a full-time attorney at this time, but to reassess the need for this position during 1995-96 budget deliberations. Mr. Willis discussed the need to clarify what services provided by Mr. Pugh are covered through retainer and what services will be billed for at an hourly rate. The Board directed Mr. Willis and Mr. Pugh to work out a plan for attorney services, including costs associated with each service. Chairman Kemp advised the Board that Richard's Home and Garden and a lot 150' x 100' behind it are for sale. This building is the only portion of the old Harris Teeter Shopping Center that the County does not own. The current tax value for this property is $105,900. Richard Luther, owner, has offered to sell for $138,000. After a brief discussion, the Board authorized Chairman Kemp to negotiate terms of a contract with Mr. Luther and to offer him up to $110,000 for the building and lot.
