071188RANDOLPH COUNTY HOARD OF COMMISSIONERS MINUTES July Il, 1988 The Randolph County Board of Commissioners met in regular session at 2 p.m. on July 11, 1988 in Courtroom B, Courthouse, Asheboro. Commissioners Frye, Langley, Davidson, and Comer were present. Commissioner Petty entered late where noted in the minutes. Invocation was given by Rev. Richard Crider of Oakhurst Baptist Church in Asheboro. Chairman Frye recognized Crystal Baity as the new reporter from the Courier Tribune. On motion of Davidson, seconded by Comer, the minutes of the June 6, 13, 20, 21, and 27 meetings were approved. Proclamations Honoring Merton Branson and Ed Smith on their Retirement Chaixman.Frye recognized Merton Branson, retiring president of Randolph Community College, and Ed Smith, retiring animal control officer for the County, and read proclamations in their honor. On motion of Comer, seconded by Langley, both proclamations were approved. Copies are included by reference. Nursing Home Beds Kim Dawkins, Long -Term Care Ombudsman for PTCOG, explained to the Board the nursing home beds certificate of need application process. Charles Trefzger of Highland Health Care made a presentation on his applica- tion for Randolph County's allocated 68 nursing home beds. Additions to the County Pay Plan Sara Baker, Personnel Officer, reported that the Regional Personnel Office had recently completed a study of some Mental health positions and recommended that the following be reclassified based on current duties and responsibilities: Social Worker Supervisor I (Grade 68) be reclassified to Human Services Coordi- nator III (Grade 68) and Staff Psychologist II (Grade 71) be reclassified to Substance Abuse Program Director I (Grade 71). These reclassified titles are not in the County's Pay Plan. On motion of Langley, seconded by Comer, the Board approved the addition of these two titles to the County's Pay Plan, effective July 1, 1988. Annual Tax Settlement Report Billy Chilton, Tax Supervisor/Collector, presented the Tax Collector's Settlement Report for 1987. On motion of Comer, seconded by Davidson, the Board accepted the Tax Collector's Settlement Report for 1987. A copy of the Settlement Report, including ambulance fees, is included by reference. Commissioners Minutes July 11, 1988 Page 2 Charge to Collect T�Lxes On motion of. Langley, seconded by Davidson, the Board charged Billy Chilton as Tax Collector to collect the taxes for 1988. A copy of this charge is included by reference. Sale of Foreclosed Property Billy Chilton informed the Board that he had received an offer to purchase some property that the County has foreclosed on. State law says foreclosed property may be sold to the former property owner or.to someone having a previous interest in the property. The current offer of $569.35 is from John Randolph Ingram, who had a deed of trust to the property (owned by Nancy Baldwin, et al). The County must sell the property for an amount not less than its interest in it, which in this case is $569.35. On motion of Langley, seconded by Comer, the Board adopted a resolution authorizing the sale of the foreclosed property to John Randolph Ingram for $569.35. A copy of the resolution is included by reference. Countywide Growth Patterns Hal Johnson, Planning Director, gave the Board a synopsis of the growth patterns and rezoning activity in the past year: total zoning permits issued: 1850 new subdivisions processed: 60 total rezoning cases: 36 special use permits: 11 fastest growing townships (based on zoning permits issued): Trinity, Grant, Tabernacle, New Market, Cedar Grove new single -wide mobile homes: 857 new double -wide mobile homes: 227 new site -built homes: 494 industrial/commercial buildings: 41 accessory buildings: 226 Commissioner Petty entered at this point and was present for the remainder of the meeting. --------------------------------------------------------------------------------- Proposed Changes in Zoning & Subdivision Ordinance Regulations Mr. Johnson stated that many citizens have expressed their concern about water supply, septic tank seepage, etc. when large subdivisions come into rural agri- cultural communities. Recent requests for high-density subdivisions prompted the Planning Board to recommend some changes in Zoning and Subdivision regulations, following a meeting at which over 175 citizens attended to express their concerns over new high density residential developments. School officials have also expressed their concern that this high-density development would create a critical overcrowding problem in existing schools. The Planning Board felt that there were three major areas of concern that could be addressed by upgrading the County's existing Zoning and Subdivision regulations: (1) quality of housing in new major subdivisions, (2) environmental impact (water supplies/quality), (3) school system planning impact. Commissioners Minutes July 11, 1988 Page 3 Proposed changes included increasing minimum lot size to 40,000 square feet with 125' minimum lot width at all building lines; providing a copy of the pre- liminary plat to the superintendent of schools along with information on the type of development so that the school system can provide the County with an impact study; requiring that all new major subdivisions be located in Restricted Resi- dential zoning districts, which would require either site -built homes or Class A double -wide manufactured houses on permanent foundations; requiring that each new road be paved before any development could begin within a subdivision. Jack Beck, attorney representing subdivision applicants Kearns and McDowell, stated that they na,d spent a lot of money on the property they purchased for development and that they objected to changing the rules in midstream. He cited a North Carolina Supreme Court case (287 -NC -493) in which the court upheld a citizen's right to develop land under the laws in effect at the time. Joe Craig, an attorney residing in Providence Township and spokesman for a group of Providence Township citizens, asked Commissioners to consider buffer zones around feeder streams flowing into reservoirs.and allow no buildings inside the buffer zones. He encouraged the County's regulation of land and development, citing General Statutes which authorize counties to regulate land for the health, safety and welfare of citizens. He also suggested that environmental impact studies be required for proposed development, as well as studies showing the impact on schools and fire and police protection. Rezoning Requests Public Hearing Hal Johnson, Planning Director, advised the Board that Howard Neal Testerman, whose rezoning request was scheduled for public hearing today, had asked that this item be tabled until next month because neither he nor his attorney could be present today. One person was present for this item. Chairman Frye announced that this item would be considered at public hearing on August 1. At 4:00 p.m. the Board held a duly advertised public hearing on rezoning requests. Mr. Johnson presented the following requests: 1. Velma Cox Pate, Ramseur, is requesting that approximately 50 acres of land located at the intersection of SR 2669/2668, Columbia Township, be rezoned. from Residential Agricultural to Light Industrial (Zoning Map 8712). It is the desire of the applicant to use the property for industrial development. The Planning Board unanimously recommended that this request be approved as consistent with the County Land Development Plan. 2. James H. Keeling, Asheboro, is requesting that approximately 5 acres of land located on the south side of Highway 64 approximately 1/4 mile east of SR 2222, Franklinville Township, be rezoned from Residential Agricultural to Light Industrial/Conditional Use (Zoning Map 7781). It is the desire of the app- licant to construct an automotive body repair shop. The Planning Board unan- imously recommended that this request be approved as consistent with the County Land Development Plan. 3. Donald W. Lanier, Asheboro, is requesting that approximately 2i acres of land located on Business 220 in front of Highway 159, Cedar Grove Township, be rezoned from Residential Agricultural to Highway Commercial (Zoning Map 7657). It is the desire of the applicant to use the property for commercial development. The Planning Board unanimously recommended that this request be approved as consistent with the County Land Development Plan. June Beane, Mayor of Ramseur, spoke in support of this request. Comments - Request #2 James Keeling spoke in support of his request. Comments - Request #3 Don lamer spoke in support of his request. No one else asked to speak. Chairman Frye declared the public hearing closed. Action on Rezoning Requests On motion of Petty, seconded by Comer, the Board approved the request of Velma Cox Pate. On motion of Davidson, seconded by Langley, the Board approved the request of James Keeling. On motion of Langley, seconded by Comer, the Board approved the request of Donald Lanier. Setting a Public Hearing on Zoning Ordinance Admendment .On advice of the County Attorney, the Board requested that the proposed amendments to the Zoning and Subdivision Regulations be legally prepared with exact wording and presented to them at their August 1 meeting. At that time, a public hearing date will be set. D.O.T. Request for Abandonment On motion of Petty, seconded by Comer, the Board approved a resolution abandoning SR 1600. A copy of the resolution is included by reference. Randleman Dam Capital Project Ordinance ordinance County Manager Frank Willis explained what a capital project/is and how it works. It must be adopted before the project is begun and must be approved unanimously with all Commissioners present if adopted when it is first introduced. Mr. Willis introduced a capital project ordinance for the Randleman Dam project Randolph County has agreed to participate in. On motion of Petty, seconded by Comer, the Board unanimously adopted the Randleman Dam Capital Project Ordinance. A copy is included by reference. Appointments - Nursing Hage Advisory Committee On motion of Davidson, seconded by Langley, the Board approved the appointment of Susan Behr and Cindy Hilliard (to replace Jim Prevo and Ann Neely) to the Nursing and Domiciliary Home Adivsory Committee for one-year terms. Appointment - Asheboro Planning Board On motion of Comer, seconded by Petty, the Board approved the appointment of Allen Holt as an outside member on the Asheboro Planning Board, filling the unexpired term of Steve Brown, term expiring January, 1991. Commissioners Minutes July 11, 1988 Page 5 Resolution of Endorsement for Nursing Home Beds The Board discussed the endorsement of Richard Bennett's application for Randolph County's 68 nursing home beds, based on his being a Randolph County applicant. On motion of Langley, seconded by Davidson, the Board approved a resolution. of support for Richard Bennett & Associates' application for Randolph County's allocation of 68 nursing home beds, with the stipulation that the proposed facility be built in the Archdale area and that strong emphasis be placed on making beds available for Randolph County citizens. A copy of the resolution is included by reference. Executive Session - Personnel Matter. On motion of Comer, seconded by Petty, the Board voted to go into executive session to discuss a personnel matter at 5:00 p.m. At 5:20 p.m., regular session reconvened. No action was taken concerning executive session. Adjournment On motion of Davidson, seconded by Comer, the Board adjourned.
