101088RANDOLPH COUNTY BOARD OF COMMISSIONERS MINUTES OCTOBER 10, 1988 The Randolph County Board of Commissioners met in special session at 7:00 p.m. on October 10, 1988 for the purpose of holding a public hearing on rezoning requests. Commissioners Frye, Langley, Davidson and Comer were present. Com- missioner Petty was absent. Chairman Frye declared the public hearing in session. Planning Director Hal Johnson announced that the request of H & F Associates had been withdrawn. He then presented the following rezoning requests: 1. Martha Gallimore, Denton, is requesting that approximately 20 acres located off SR 1103 in Deer Trail Acres Subdivision, New Hope Township, be rezoned from Residential Agricultural to Mixed Residential/Conditional Use (Zoning Map 7605). It is the desire of the applicant to develop a 5 -space mobile home park. The Planning Board recommended that this request be denied as inconsistent with the rural character of the land. 2. Robert 0. Mason, Jr., Asheboro, is requesting that approximately 13 acres located at the end of SR 2674, Grant Township, be rezoned from Residential Agricultural to Mixed Residential/Conditional Use (Zoning Map 7699). It is the desire of the applicant to develop an 8 -space mobile home park. The Planning Board recommended that the original request of 15 mobile home spaces be reduced to 8 individual spaces allowed on the 13 -acre tract. 3. Sherrill Lambeth, Trinity, is requesting that approximately 272 acres located on SR 1547, Tabernacle Township, be rezoned from Residential Agricultural to Mixed Residential/Conditional Use (Zoning Map 6795). It is the desire of the applicant to make an.addition of 20 spaces to Sterling Estates Mobile Home Park (5 existing spaces). The Planning Board recommended approval and noted that there was no opposition at their public hearing. 4. Ellen Lineberry, Climax, is requesting that approximately 7 acres located north of Grays Chapel on Highway 22, Providence Township, be rezoned from Residen- tial/Agricultural to Mixed Residential/Conditional Use (Zoning Map 7796). It is the desire of the applicant to make a 5 -space addition to Ellenwood Park Mobile Home Park (3 existing spaces). The Planning Board recommended denial as not con- sistent with the rural agricultural character of the community. 5. Donald Lanier, Asheboro, is requesting that approximately 60 acres located on SR 2843 behind Happy Hollow Community Building, Richland Township, be rezoned from Residential Agricultural to Mixed Residential (Zoning Map 7667). It is the desire of the applicant to develop a site built/manufactured housing resi- dential subdivision of 10 lots (average tract size, 5.72 acres). The Planning Board recommended approval, noting that the large tracts would be appropriate for mixed housing in this rural area. 6. H & F Associates - This request has been withdrawn. 7. Walter Lee Roberts, Asheboro, is requesting that approximately 34 acres located approximately 1500 ft. south of Highway 64 on the west side of SR 2605, Franklinville Township, be rezoned from Residential Agricultural to Residential Restricted (Zoning Map 7781). It is the desire of the applicant to develop a site- Commissioners Minutes October 10, 1988 Page 2 built residential subdivision of 24 lots (average lot size, 1.3 acres with public road development). The Planning Board recommended approval. 8. H. Wade Yates, Asheboro, is requesting that approximately 108 acres located on Highway 64 west of Asheboro, Back Creek Township, be rezoned from Residential Agricultural to Residential Restricted (Zoning Map 7731). It is the desire of the applicant to develop a site built/Class A manufactured housing residential subdivision of 74 lots. The Planning Board recommended approval and noted that no development will be allowed within the flood zone. 9. Harry Chamberlin, Asheboro, is requesting that approximately l2/ acres of land located on the south side of Highway 64 (between SR 2666/SR 2692), Fr.anklin- ville Township, be rezoned from Residential Restricted to Light Industrial/ Conditional Use (Zoning Map 7771). It is the desire of the applicant to construct a 50' x 50' building to operate a machine shop and a gun shop. The Planning Board recommended approval. 10. Glenn R. Davis, Ramseur, is requesting that approximately 4i acres located just outside of Ramseur city limits on the east side of Highway 22, Columbia Township, be rezoned from Residential Agricultural to Highway Commercial (Zoning Map 8701). It is the desire of the applicant to use the property and a 4040 sq. ft. building existing on the property for commercial purposes. The Planning Board recommended approval. Comments - #1 C.P. Davis, Route 3, Denton, adjoining property owner, spoke in opposition to this request on behalf_ of about 14 people in the audience. He said the road to the proposed site is a private road kept up by the property owners. They asked Mrs. Gallimore recently to contribute to the cost of some road work and she refused to do so. He also said that a mobile home park that close to them would devalue their property. He presented a petition with over 100 signatures of area residents opposing this request. Comments - #2 Robert O. Mason, Jr...,.Rt.1, Asheboro, applicant, said he had cleaned up property and had agreed to ask for fewer spaces than originally requested. assured the Board that he would have a nice, clean park. the He Roy Brown, Route 1, Box 393A, Asheboro, presented a petition with 62 signa- tures of area residents opposing this request. He said they fear one mobile home park in the area will attract other such development. He also said it would be at the end of a dirt road and the extra traffic would create excessive dust and mud. He questioned the suitability of the rocky, unlevel land for septic tanks. He spoke for about 14 people present in the audience. Gary Hester, Greensboro, spoke on behalf of his employer, Piedmont Minerals, who owns 400 acres adjacent to the site in question. He said his company would beginning mining this 400 acres within the next 10 years and that they would follow a reclamation plan for the land when they have finished mining the site. They want their property to be high in value so they can sell it and they fear a mobile home park, and others which might follow if this one is allowed, would devalue their property. Stuart Albright, Route 1, Box 401, Ramseur, said he had just inherited land nearby and doesn't want the type of people who live in trailer parks to be nearby. Commissioners Minutes October 10, 1988 Page 3 Comments - #3 Sherrill Lambeth, applicant, said he would live on the site and look after all the property. Michael D. Pugh, Route 1, Box 820, Trinity, spoke on behalf of about 25 people in the audience and presented a petition with 76 signatures of area residents opposing this request. He said no neighbors saw a sign or knew anything about the Planning Board public hearing on this request and that was why no one was present to oppose it. He said Homewood Acres next door to the request includes 475 acres with beautiful homes, each on about a 5 -acre lot. The land represents $1 million in sales, while improvedments to property represent about $2 million. Mr. Pugh said the request is not compatible with the neighborhood and any additions would further damage their property. He presented photographs of some of the homes in Homewood. Acres. Gail Harris, Route 1, Box 837, Trinity, said no one saw the sign for the Planning Board meeting and that the sign for this meeting was not seen until last Thursday, and then that sign was down on Saturday. She presented photographs of the 5 existing mobile homes in Sterling Estates and said they see no reason to think the additional 20 would look any different. Jimmy Jones, Route 1, Box 823, Trinity, voiced his conern over a dangerous curve in the road approaching the entrance to Sterling Estates. He said a car coming around that curve would not be able to stop in time if a stopped school bus was boarding or unloading at the entrance to Sterling Estates. He also said that Sterling Estates is very near the head of the Uwharrie River and slopes down to the river, which feeds into the Asheboro reservoir. Jim Browning, Route 1, Box 819, Trinity, said he is a developer and he doesn't believe the acreage in the request could pass a perk test.in places. Glenn Connor, Route 1, Box 824, Trinity, expressed concerns over sewage getting into the Uwharrie, congested traffic on a dangerous road, influx of more children in the schools, and disruption of the aesthetic nature of the neighborhood. Comments - #4 Jana Correll, 902 Old Liberty Road, presented a petition with signatures of area residents opposing the request. She spoke on behalf of about 10 people in the audience. Ms. Correll said the community as a whole opposes this request and that their goal is to preserve the quality of the land. Comments - #5 Donald Lanier, applicant, said the proposed tracts would be over 5 acres each. Comments - #7 Phil Henley, Asheboro, spoke on behalf of the applicant. He said Mr,. Roberts will have a nice development and all houses will be stick -built. Comments - #10 Glenn Davis, applicant, said he bought the property in 1983 and has had a business there since that time. Action on Rezoning Requests On motion of Comer, seconded by Langley, the Board unanimously denied the request of Martha Gallimore. On motion of Langley, seconded by Davidson, the Board approved the request of Robert 0. Mason. Commissioner Comer voted to deny this request. On motion of Davidson, seconded by Comer, the Board unanimously denied the request of Sherrill Lambeth. On motion of Comer, seconded by Davidson, the Board unanimously denied the request of Ellen Lineberry. On motion of Langley, seconded by Comer, the Board unanimously approved the request of Donald Lanier. On motion of Langley, seconded by Davidson, the Board unanimously approved the request of Walter Lee Roberts. On motion of Davidson, seconded by Comer, the Board unanimously approved the request of H. Wade Yates. On motion of Comer, seconded by Langley, the Board unanimously approved the request of Harry Chamberlin. On motion of Davidson, seconded by Comer, the Board unanimously approved the request of Glenn R. Davis. Adjournment On motion of Davidson, seconded by Comer, the Board adjourned.
